HomeMy WebLinkAbout971073.tiffRESOLUTION RE: GRANT MOBILE HOME PERMIT #2059 - RAFF WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 4th day of June, 1997, considered the request of Nancy Raff, 1940 Greeley Mall Avenue #27, Greeley, Colorado 80631, for a mobile home to be used as a principal dwelling, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lot B of RE #712, being a portion of the SW% of Section 12, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant shall acquire a building permit for the mobile home. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved septic system and a legal water supply. 3. The non-commercial junkyard on the site shall be either removed or visually screened from all adjacent properties and public rights -of -way within 30 days after issuance of the certificate of final inspection for the mobile home. 4. The structure which once appears to have been used as a residence, located northeast of the stick -built house, shall be either removed from the property within 60 days after the issuance of the certificate of final inspection for the mobile home, or shall comply with the minimum standards of the Uniform Building Code with all utilities other than electrical removed. 5. The existing stick -built house shall be utilized for storage purposes only. The kitchen sick, oven, refrigerator, and all utilities other than electrical shall be removed from the stick -built house prior to the issuance of the certificate of final inspection for the mobile home. 4. The mobile home shall not be occupied until such time that the applicant has complied with Conditions 1, 2, and 6 stated above. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Nancy Raff for permission to place a mobile home to be used as a principal dwelling on the above described parcel of land, which was found to be in compliance with Section 43 of the Weld County Zoning Ordinance, be, and hereby is, granted subject to the hereinabove listed conditions. PARCEL: 1309 12 000017 PARCEL SIZE: 139 acres, more or less WATER SOURCE: Well SEWER SOURCE: Septic The Department of Planning Services' staff has reviewed this request and recommends that this request be approved for the following reasons: It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 43.2.6 of the Weld County Zoning Ordinance, as follows: a. Section 43.2.6.1.1 - The mobile home will be compatible with the surrounding area. As located, the mobile home is not visible from County Road 22. The mobile home is currently situated where an accessory to the farm mobile home was once placed. There is also an old home located on the property which the applicant intends to turn into storage. An outbuilding, which appears to have once been occupied as a residence, is located to the north of the old house. The structure appears to present a health and safety risk if remaining on the site. �. Section 43.2.6.1.2 - The mobile home appears compatible with the Weld County Comprehensive Plan. The applicant intends to live in the home and maintain the 139 acre property. On the site, there are cattle and what appears to be an old dairy operation. The location of the mobile home will not interfere with the agricultural uses on the land. Section 43.6.1.3 - There is adequate availability of water and sewage disposal facilities for the mobile home. The site is serviced by a new well and an existing septic system. 9710'73 d. Section 43.6.1.4 -The general health, safety and welfare of the inhabitants of the area and the county will not be jeopardized or compromised by the location of the mobile home on this site. The Department of Planning Services' staff recommendation for approval is conditional upon the following: The applicant acquiring a building permit for the mobile home. 2. A structure that sits north of the existing stick -built house, appears to have been used as a dwelling. This structure presents health and safety concerns and should be removed from the site. On the site, there are currently three residences (an existing house, a dilapidated structure which appears to have been once occupied, and the mobile home in question with this permit). There are also dairy structures/outbuildings, corrals, sheds and cattle. The access to the site is off of WCR 22 and is a shared access with the adjacent neighbor to the west. On the site during the inspection, there was a pile of ashes 971073 where the applicant indicated that they have been burning wood. Also in the ashes pile were varying cans and debris. A non -conforming junkyard is located on the north portion of the property. The junkyard consists of a portion of a mobile home, mattresses, tires, wood, refrigerators, and other miscellaneous materials/debris. Kern D. The typical operational life of a septic system is 15 to 20 years. After this time period the lots would likely be developed with out -buildings, corrals, etc. It has been the Department's experience that after development there is not adequate area for replacement systems. Therefore, the Department encourages the applicant to designate an appropriate area on the parcel for a replacement septic system. In addition, the application materials also states the uninhabitable house will be burned. We discussed this with the applicant and advised her of the appropriate procedures she must follow in order to burn this structure. Zip Code 80621 ADDENDUM NEIGHBORHOOD COMMENTS The subject is located in the general area known as Fort Lupton which is north of Adams county, south of Highway 66, east of Interstate 25 and west of Highway 79. The general area consists of mostly single family custom to semi -custom detached homes located on .50 to 80 acres sites. SITE COMMENTS The neighboring property recently had a mobile home placed on it. It appears that this mobile home has less square footage than the stick built home currently on the property. It is the appraisers opinion that by utilizing this mobile home as the main residence and using the stick built home as a storage building would decrease this particular property value and may decrease the property values within the general market area. It is recommended that the stick built home have upgrading completed and utilized as the main residence which will in turn raise its property value. COMMENTS ON SALES COMPARISON Although subject is a typical home for the area, the area itself is comprised of a very diversified size and price range of homes. For this reason comparable 2 was chosen from a competing area and is similar to subject in terms of age, style, size, quality and general market appeal. The Hudson area is within the same market area as subject and commands similar market response. Acreage adjustments were calculated at $500 per acre. Age adjustments were calculated at $100 per year. Conditional adjustments for comparables are based on appraiser's observations and Realtor comments. All comparables were adjusted for their average and good condition relating to subject's above average condition. Comparables 1 and 2 were adjusted for propane hot water heat at $2000 and propane warm air heat at $2500 in comparison to subject's gas forced warm air heat. Although the value exceeds the predominant, it is still well within the value range and doss not constitute an overbuild for the area. Basement adjustment was calculated at $8.00 for square footage differential. Adjustment was rounded to the nearest $100.00. All other adjustments were made to reflect the specific amenities unique to each home and are reasonably self-explanatory within the Freddie Mac form 704. RESEARCH/INSPECTIONS/ASSISTANCE: The appraiser performed an exterior drive -by inspection only.
