RE: GRANT MOBILE HOME PERMIT #1968 - BAROS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 12th
day of July, 1995, deemed it advisable to continue said request of Josie T. Baros, 2501 West 1st
Street, Greeley, Colorado 80631, fora mobile home to be used as a principal dwelling, to July 17,
1995, at 9:00 a.m., to ensure proper legal notification, and
WHEREAS, at said hearing on July 17, 1995, Josie Baros, applicant, was present, and
WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
Lot 5 and N1/2 of Lot 6 of Valley View Subdivision, located in Section
30, Township 5 North, Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board of County Commissioners, having heard the testimony, finds that
said request should be granted subject to the following conditions:
1. The applicant shall apply for a building permit for the mobile home prior to locating
the mobile home on the property.
2. Prior to the occupancy of the mobile home, the mobile home shall be connected to
an approved septic system and a legal water supply.
4. The mobile home shall not be occupied until such time that the applicant has
complied with the above mentioned conditions.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Josie T. Baros for permission to place a mobile home to be
used as a principal dwelling on the above described parcel of land, which was found to be in
compliance with Section 43 of the Weld County Zoning Ordinance, be, and hereby is, granted
subject to the hereinabove listed conditions.

Location: West of and adjacent to McAvoy Avenue; approximately 200' north of
38th Street.
The Department of Plann-ing Services staff has reviewed this request and
recommends that the request be approved for the following reasons:

3. The mobile home shall not be occupied until such time that the applicant

Additional Comments ZPMH-1968
Applicant: Josie Haros
A copy of the letter received from the City of Evans dated June 19, 1995,
submitted by Chad L. Phillips, Planner, regarding future growth of the Valley
View Subdivision is attached. This letter identifies concerns the City of
Evans, recommending the permit be denied due to a conflict with neaby zoning.
The applicant has submitted a complete application with a petition of 70% of
the surrounding property owners' signatures.

This letter is in response to the request for a mobile home that is proposed to be placed on lot 5
and the N2 of lot 6, Valley View Subdivision, Weld County (Case Number ZPMH-1968).
The active Comprehensive Plan shows this land as Medium Density Residential, where a single
family home would be a use by right. However, the Comprehensive Plan for the City of Evans
does not differentiate between mobile homes and stick -built homes. At the City of Evans, our
regulations are set up to ensure that mobile homes or manufactured dwelling not placed on a
permanent foundation are placed in the R -5A Mobile Home Community or R -5B Mobile Home
Park zone districts.
Because of the close proximity of this site to the City, (in fact many people think that this area is
actually within the city limits) the planning staff would recommend that this proposal be denied
because of the conflict with nearby zoning. This area, in all likelihood, will probably become
annexed into the City of Evans within the next ten years and the action that is taken concerning
this proposal could alleviate a non -conforming use in the future.
The staff is currently updating the City of Evans Comprehensive Plan. When approved, the
document will contain language that deals with the placement of mobile homes. Until then, we
would appreciate it if the county will take into consideration the present nearby zoning and the
intent of the proposed Comp Plan updates.
