The summary of the last regular meeting of the Weld County Planning Commission December 5, 1995 was approved. 1. Consider changes to fee for the Weld County Comprehensive Plan. Monica Daniels -Mika, Director, Department Planning Services, addressed the planning commission that staff recommends approval of $25.00 for the new revised comprehensive plan. The cost implemented was due to printing costs and new improved maps. Ron Sommer moved that the new increase of $25.00 be approved. Marie Koolstra seconded the motion. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. CASE NUMBER: USR-1101 PLANNER: Shani L. Eastin APPLICANT: William J. Martin REQUEST: A Site Specific Development Plan and a Special Review permit for single family dwelling unit on a lot less than the minimum lot size in the A (Agricultural) zone district. LEGAL DESCRIPTION: Located in part of the SE4 of the SE4 of Section 24, Township 12N, R61W of the 6th P.M., Weld County, Colorado. LOCATION: North of and adjacent to Weld County Road 138; west of and adjacent to Weld County Road 99. Shani Eastin, Department of Planning Services, explained this property is located 8 miles northeast of Hereford and 1/2 mile south of the Wyoming border. Shani stated the applicant came in to obtain a zoning permit for a single family dwelling unit on a 40 acre lot which is less than the 80 acre minimum lot size requirement. Shani stated for the record that the location west of and adjacent to Weld County Road 97 should actually read as west of and adjacent to Weld County Road 99. The Department of Planning Services' staff recommends approval with the development standards, conditions of approval with the addition of COA # 6 to read: Weld County reserves the right to reserve 30' of right-of-way from the center line of Weld County Road 97. If at any time in the future Weld County decides to upgrade and build a section of road at this location, the applicant would be required to relocate the well from the right -of-way. The applicant, William Martin, spoke in favor of the application. The applicant was in agreement with staff recommendations. The Chairman asked if there was anyone in the audience who would like to speak for or against the application. No one wished to speak. Kurt Moore moved that case USR-1101 be forwarded to the Board of County Commissioners with Planning Commissions recommendation for approval. Shirley Camenisch seconded the motion. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Motion carried unanimously. 3. CASE NUMBER: USR-1103 PLANNER: Chris Goranson APPLICANT: James A. and Pamela J. Erthal (Richard D. & Dorothy Schild, property owners) REQUEST: A Site Specific Development Plan and a Special Review permit for a cabinet shop building in the A (Agricultural) zone district. LEGAL DESCRIPTION: Lot B of RE -1723, located in part of the NE4 of Section 7, T7N, R67W of the 6th P.M., Weld County, Colorado. LOCATION: West of and adjacent to Weld County Road 15; south of and adjacent to Weld County Road 84. Chris Goranson, Department Planning Services explained the proposal is for a Site Specific Development and a Special Review PernNt for a home business (cabinet shop). The Department of Planning Services' staff has received responses from the Weld County Public Works Department, Weld County Health Department and Poudre Fire Authority. The Department of Planning Services' staff recommends approval for this case for the following reasons: 1) This proposal is consistent with the Weld County Comprehensive Plan and is provided for as a Use by Special Review under a home business; 2) The use will be compatible with the future development of the surrounding area and with future development; 3) The site does not lie within any of the overlay districts; 4) The conditions of approval and development standards will ensure adequate provision for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and County. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. Rob UViinick and Betty Kimberely surrounding property owners had concerns about how large the building size for the cabinet shop would be and what the plans were for the existing land. Chris Goranson, Department Planning Services and applicant Jim Erthal stated the building size would be approximately 100x50 feet and the plans for the existing land were to farm it. Planning Commission members Marie Koolstra had questions concerning how many acres will be used in building on the site and the applicant stated less than 1 1/2 acres. Ron Sommer addressed concerns on the access to the property and if water was purchased with this property. Applicant Jim Erthal explained the existing access to the property would not work due to the sloping of the property and the way the ditch ran for how they would be setting the buildings and that water was purchased with the site and the applicant was looking into purchasing additional shares. Ann Garrison moved Case Number USR-1103 be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval. Arlan Marrs seconded the motion. The Chairman asked the secretary to poll the members of the Planning Commission for their decision.
