HomeMy WebLinkAbout972493.tiffORDINANCE NO. 147-M IN THE MATTER OF THE REPEAL AND RE-ENACTMENT OF CERTAIN PORTIONS OF ORDINANCE NO. 147, WELD COUNTY COMPREHENSIVE PLAN ORDINANCE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has the power and authority, under the Weld County Home Rule Charter and Article 28 of Title 30, CRS, to adopt planning goals and policies for the unincorporated areas of the County of Weld, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, previously adopted Ordinance No. 147, Weld County Comprehensive Plan, establishing a comprehensive revision of the planning goals and policies for the unincorporated areas of the County of Weld and has adopted amendments in Ordinance No. 147-A through No. 147-L, and WHEREAS, the Weld County Planning Commission has recommended revisions to the Comprehensive Plan, and WHEREAS, said revisions include revisions to A. Goal 3 and A. Policy 3 of the Weld County Comprehensive Plan, and WHEREAS, the Board of County Commissioners of Weld County hereby finds and determines that there is a need for revision to certain portions of the Comprehensive Plan for the County of Weld, to ensure that the Comprehensive Plan is consistent with language approved in the Zoning, Subdivision, and Planned Unit Development Ordinances, that this amendment is consistent with existing a future goals, policies, and needs of the County, and this Ordinance is for the benefit of the health, safety, and welfare of the people of Weld County. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that the Weld County Comprehensive Plan be, and hereby is, amended to read as follows: A.Goal 3 -- Discourage urban -scale residential, commercial, and industrial development which is not located adjacent to existing incorporated municipalities. A. Policy 3 -- Conversion of agricultural land to urban -scale residential, commercial, and industrial development will be discouraged when the subject site is located outside of a municipality's comprehensive plan area, urban growth boundary area, or 1-25 Mixed Use Development area and urban development nodes. This policy is intended to promote conversion of agricultural land in an orderly manner which is in harmony with the phased growth plans of a municipality and the county. It is further intended to minimize the incompatibilities that occur between uses in the agricultural district and districts that allow urban -type uses. In addition, this policy is expected to contribute to minimizing the costs to Weld County taxpayers of providing additional public services in rural areas for uses that require services on an urban level. 972493 ORD147-M RE: ORDINANCE NO. 147-M PAGE 2 BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. (' The above and foregoing Ordinance Number 147-M was, on motion duly made and seconded, adopted by the following vote on the 26th day of January, A. D., 1998.
