Dear Mr. Schildmeier: Enclosed with this letter are two Petitions for Abatement or Refund of Taxes for two separate parcels of real property owned by Newco, Inc. The parcel number and schedule number of each parcel are expressed on the individual Petitions. As we discussed on the phone, Mr. Bruce Willard of Austin &Austin Appraisal Services prepared an appraisal report establishing the actual value for the subject properties. Copies of the appraisal report are also enclosed with this letter. Because the appraisal report establishes a value as of June 23, 1998, I asked Mr. Willard to clarify the time and/or market adjustments found in his appraisal report so that the value conclusion he made as of June 23, 1998 could be adjusted for tax year 1997 as well. Based on the conclusions in Mr. Willard's appraisal report, it appears there should be a refund for tax year 1997 associated with both parcels of property. Additionally, it appears the 1998 taxes will also be excessive and, therefore, an abatement of those and future taxes should be made.
