RE: GRANT CHANGE OF ZONE #498 FROM PUD (CRYOGENIC RESEARCH FACILITY) TO
A (AGRICULTURAL) - DONALD AND BETTY MINCH
A public hearing was conducted on May 8, 1996, at 10:00 a.m., with the following present:
Commissioner Barbara J. Kirkmeyer, Chair
Commissioner George E. Baxter, Pro-Tem
Commissioner Dale K. Hall
Commissioner Constance L. Harbert
Commissioner W. H. Webster
Also present:
Acting Clerk to the Board, Shelly Miller
Assistant County Attorney, Lee Morrison
Planning Department representative, Shani Eastin
The following business was transacted:
I hereby certify that pursuant to a notice dated April 15, 1996, and duly published April 18, 1996,
in the North Weld Herald, a public hearing was conducted to consider the request of Donald and
Betty Minch for Change of Zone #498 from PUD (cryogenic research facility) to A (Agricultural).
Lee Morrison, Assistant County Attorney, made this a matter of record. Shani Eastin, Planning
Department representative, presented a brief summary of the proposal and entered the favorable
recommendation of the Planning Commission into the record as written. She noted the PUD was
approved in 1987; however, the final plat was never completed. Ms. Eastin explained the
applicants now wish to sell the subject property for agricultural purposes to a farmer who desires
to build a house. She confirmed the existing and past use of the property is agricultural and the
Town of Mead has no conflict. Responding to questions from the Board, Ms. Eastin clarified the
Colorado Geological Surveys concerns are addressed in Condition of Approval#3. Donald Minch,
applicant, was present and stated he would like to change the zoning back to agricultural like it is
supposed to be. He agreed with all Conditions of Approval, and no public testimony was offered.
Commissioner Hall moved to approve the request of Donald and Betty Minch for Change of
Zone #498 from PUD (cryogenic research facility) to A (Agricultural), based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Webster, and it carried unanimously.
