reported the production for the period January 1, 1992 through September 30, 1992.
Gerrity Oil & Gas Company as operator of the well on January 1, 1993 also reported
the production from January 1, 1992 through September 30, 1992. The production
from October 1, 1992 through December 31, 1992 was reported with the Lesser 33-2.
The nine months production reported for Lesser PM -J 33-7 was a duplicate of what
was reported by Francis Energy.

Dear Vera:
I have received the following information from Gerrity to support
their Petition for Abatement forms. There are three schedules
which show the pattern of production so you are able to see when
the wells purchased from Francis Energy were added to existing tank
batteries.
If you look at the first schedule, you will see that for the first
nine months of the year the Spomer BCJ #33-13 & 14 were averaging
approximately 2,500 MCF per month. In October, the production
increased and these same tank batteries averaged approximately
5,500 MCF for the last three months because the Spomer #33-13-2 and
Spomer #33-14-3, purchased October 1, 1994 were added to the tank
battery.
On the second schedule the Spomer #1 was added to the Spomer BCJ
#33-11 on October 1. You will see that the production was
averaging 600 MCF per day until October when it jumped to over
3,000 MCF per day with the new well. There were tank battery
problems during November and December so the production was down.
Schedule three shows that the Lesser PMJ #33-7 was added to the
Lesser PMJ #33-2 tank battery. There were problems with the tank
battery in October but in November the production was over 4,000
MCF instead of the 2,400 MCF the tank battery had averaged for the
first nine months. The production was down in December because of
additional tank battery problems.
Vera, this information should be adequate proof that the wells
purchased from Francis Energy were added to existing Gerrity tank
batteries on October 1, 1992.

This is to advise you that the Weld County Board of Commissioners will hear your petitions for
abatement or refund of taxes on the property described as: Lesser PM -J 33-7, Spomer 33-14-2,
Spomer 33-13-1, and Spomer #1, respectively. The meeting is scheduled for Monday, February 6,
1995, at 9:00 a.m., at which time you may be heard. You are required to submit any supporting
documentation regarding this petition to the Office of the Clerk to the Board and to the Weld County
Assessor's Office at least seven calendar days prior to the meeting date in order for it to be
considered at said meeting. The Assessor is recommending that the Board approve your petitions.
The meeting will be held in the First Floor Meeting Room, Weld County Centennial Center, 915
10th Street, Greeley, Colorado, at the above specified time.

Dear Warren:
We have reviewed the petitions for abatement of 1993 taxes
submitted by Gerrity Oil & Gas (copies of the front pages of the
abatement petitions enclosed). Please find enclosed the
following schedules that document our review findings:
SCHEDULE A -- Schedule of tax reporting by both Francis
Energy and Gerrity for all wells involved
for 1993 -- Crude Oil
SCHEDULE B -- Schedule of tax reporting by both Francis
Energy and Gerrity for all wells for 1993
-- Natural Gas
SCHEDULE C -- Schedule of reporting to the Colorado Oil
and Gas Conservation Commission on both
COGCC Form # 7 and -Form # 8 for each well
for 1993 tax -year.
SCHEDULE D -- Summary schedule of reconciliation of all
tax reporting and reporting to the COGCC
Based on our review, the amounts reflected on the abatement
petitions appear to be valid, and the petitions should be
granted. SCHEDULE D indicates the possibility that, in addition
to the amounts on the abatement petitions, there is another
$ 3,670 in taxable value that may have been over -reported by the
two operators/payors. We believe this results from duplicate
COGCC Form 8 reporting, and the fact that Francis did not claim
any exempt royalty deduction, and Gerrity did.
