ROLL CALL: The meeting was called to order by President Pam Malcom. Vice President Judy Curtis, Councilman Ralph Campbell, Councilman Dan Oster, and Councilman Al Roberts were present, constituting a quorum of the members. Also present: County Assessor Warren Lasell, Commissioner George Baxter, Ed Schelhaas, Bonnie Heinle, Mary Scheel and the Council secretary, Bev Thomas APPROVAL OF MINUTES: Councilman Al Roberts made a motion to approve the April 15, 1997 meeting minutes. Councilman Ralph Campbell seconded the motion and it was approved unanimously. GUEST SPEAKER: County Assessor Warren Lasell explained the major functions of the Assessor's Office. The Assessor said that the office is responsible for discovering properties. The Assessor then estimates actual value of property. Mr. Lasell explained how assessed value is determined for different types of property. His office then notifies the state and the 110 taxing districts of the property values. Mr. Lasell, also, discussed Colorado's Gallagher Amendment and its implications for property values and property tax revenue. The speaker answered questions from the Council and County citizens. ADDITIONS TO THE AGENDA: There were no additions to the agenda. APPOINTMENTS: Councilman Ralph Campbell said that as no Council person was able to participate on KFKA's May 20 Coffee Break, Scott Johnson was going to have Janet Meisinger on Coffee Break on May 27, 1997. Pam reminded Council members of the Weld County Jail Cornerstone ceremony on May 14, 1997 at 4:30 p.m.. CORRESPONDENCE: The Council reviewed the correspondence. It was noted that items received on May 20 in the Council office had been logged into the Council's correspondence. The Council will need to adopt its proposed 1998 budget at the June meeting. A work session to work on the Council's budget was scheduled for June 11. COORDINATOR REPORTS: Councilman Dan Oster explained that an anonymous telephone call to the Council office reported two contractors were apparently having 971670 Weld County Council Minutes May 20, 1997 -Page 2 road sign work done by Weld County Road and Bridge personnel. Councilman Dan Oster contacted Mr. Dave Becker about the matter. Councilman Oster was told that signs were placed by Weld County personnel in two areas where private contractors were working. Road and Bridge personnel posted signs to make the County roads safer. Cache La Poudre River Study Plan Payment Councilman Al Roberts asked Commissioner George Baxter about the decision - making process regarding a $1,700. payment to the City of Greeley. Councilman Roberts' concern was that the payment was made based on an informal agreement. Commissioner Baxter stated that on occasion the Board of County Commissioners makes such decisions in work sessions. Almost always minutes are recorded of Commissioners' work sessions. This payment was made because it saved the County money to be involved in a joint study with the City of Greeley. UNFINISHED BUSINESS: Restaurant Invitations Councilman Ralph Campbell presented samples of a tabletop invitation for use at Council dinners before out -of -Greeley Council meetings. The intent is to welcome interaction with County citizens during the dinner hour. New Program at The Villa President Pam Malcom reported talking to Michael Brand at The Villa regarding a citizen's concern that 60 new beds will be added to The Villa's programs in Greeley. President Malcom reported that there are no plans for a 60 -bed expansion for Community Corrections clients. According to the Community Corrections office a request was made to the Colorado Department of Public Safety, Division of Criminal Justice for supplemental funds to allow for a 24 -bed expansion in The Villa's Community Corrections Center. If the new beds were approved there would be no new building. The Villa presently has the room available to add additional beds. A new contract would not have to be negotiated with Community Corrections. The Villa is planning to build onto its facility by adding a new lunch room for its assisted living residents. Zoning permits and approval from the City of Greeley would be required if The Villa does any construction at its Greeley facility. Weld County Council Minutes May 20, 1997 -Page 3 There are no plans by The Villa's assisted living, Community Corrections Program or Residential Treatment Center to house its clients away from its Greeley facility as in group homes in the community. Amending the January 7, 1997 Council Minutes Councilman Ralph Campbell moved to amend the January 7, 1997 Council meeting minutes to reflect that the quorum consisted of President Pam Malcom, Councilwoman Judy Curtis, Councilman Ralph Campbell, Councilman Dan Oster, and Councilman Al Roberts. Furthermore, may the amendment note that all Council members present were in agreement for both the approval of the December 4, 1996 meeting minutes and the approval of the fourth quarter, 1996 Report to the People. There were no additions, corrections, or objections to either the December minutes or the 1996 fourth quarter Report to the People. Councilman Dan Oster seconded the motion and it carried unanimously. First Quarter 1997 Report to the People Councilman Al Roberts moved to approve the 1997 first quarter Report to the People. Vice President Judy Curtis seconded the motion and it carried unanimously. Review of Weld County Finance Corporation Councilman Ralph Campbell moved to table two pieces of correspondence because they were just received May 20 by the Weld County Council. The items to be tabled were a May 20, 1997 -fax from Janet Lee Meisinger (Constitutional Notice - Declaration on True Facts) and a letter from We the People in Weld (Inquiries for Elected Officials in Weld County and Grand Jury Investigation). Councilman Dan Oster seconded the motion. Council members talked about the need to study the correspondence before acting on it. President Pam Malcom stated that it was not within the Weld County Council's jurisdiction in the Home Rule Charter to call a Grand Jury and that the Council is not a Grand Jury. The motion carried with Councilwoman Judy Curtis voting no. The Council agreed to answer two specific questions regarding the Weld County Finance Corporation. The questions the Council will answer are regarding the reported conflict of interest of employees and elected officials of Weld County and the legality of the Weld County Finance Corporation. Council members agreed that addressing these two questions were clearly within the Council's authority outlined in Weld's Home Rule Charter. The Council decided to compose a resolution to address the reported conflict - of -interest of County employees and elected officials as per Weld County Home Rule Weld County Council Minutes May 20, 1997 -Page 4 Charter Article XVI, Section 16-9. A statement or a resolution will also be prepared by the Council regarding the legality of the Weld County Finance Corporation. President Pam Malcom read Article II, Section 2-1 of Weld County's Home Rule Charter. She also read Article XIV, Section 14-2 (5) and Section 14-6. NEW BUSINESS: Adjournment Time of Weld County Council Meetings & Amendment of Council's Rules and Regulations Councilman Ralph Campbell noted that the proposed draft of the Council's Rules and Regulations setting beginning and ending times for Weld Council meetings was not accurate. It was restated that out -of -Greeley meetings would begin at 7:30 p.m. and in - Greeley Council meetings would begin at 6:30 p.m.. President Pam Malcom tabled discussion of the Council's Rules and Regulations Section II, paragraph E. Councilman Ralph Campbell made a motion, seconded by Councilman Dan Oster, to replace the small -print public comment paragraph on the Council's agenda with the following: While we encourage individuals or groups of individuals to address the Weld County Council, public comment may be limited. Please be aware that the Council may not be able to address your topic today. If the Council is unable to do so, the matter may be referred to staff, or a work session, or the next regular -scheduled meeting. The motion carried unanimously. President Pam Malcom took from the table discussion of the Council's Rules and Regulations Section II, paragraph E. Vice President Judy Curtis made a motion to leave Section II, paragraph E of the Council's Rules and Regulations as stated in the December 7, 1994 -version. Councilman Ralph Campbell seconded the motion and it carried unanimously. Councilman Ralph Campbell made a motion to amend Section II paragraph G of the Council's Rules and Regulations to read as follows: "Executive Session. The Council may, by the affirmative vote of two-thirds of the members present and upon the announcement to the public of the topic for discussion, go into an executive session for the consideration of those matters listed in C.R.S. paragraph 24-6-402 (4)." Vice President Judy Curtis seconded the motion and it carried unanimously. Weld County Council Minutes May 20, 1997 -Page 5 Payment of the Bills Councilman Ralph Campbell made a motion to pay the following bills as listed: Mileage for Councilman Ralph Campbell $ 11.88 Mileage for Councilman Al Roberts $ 55.08 Mileage for Councilman Dan Oster $ 7.56 Postage & Timer - Bev Thomas $ 16.31 South Weld Sun Legal Notice $ 4.26 Councilman Dan Oster seconded the motion and it carried unanimously. Review of Council's 1997 Budget to Date The Council asked Council secretary Bev Thomas to get a corrected copy of the Council's 1997 budget -to -date for the June 1997 meeting. July 4, 1997 Stampede Parade President Pam Malcom said that she would talk with Parade Chairman Jerry Pickett about the Council's participation in the 1997 Stampede Parade. The Council decided to participate in the parade if possible. The Council heard concerns about County government from citizens of south west Weld County. The Council decided that their July 15 regular monthly Council meeting would be held at the Weld County Centennial Center rather than at the Gilcrest Town Hall as previously planned. Hello
