RE: APPROVE MINOR RESUBDIVISION FOR THE VACATION OF RIGHT-OF-WAY IN
THE UNINCORPORATED TOWN OF BARNESVILLE - LINDSEY AND RUTH WILSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 1st day of
September, 1999, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of
hearing the application of Lindsey and Ruth Wilson, 33830 Weld County Road 61.5, Gill,
Colorado 80624, for a Minor Resubdivision for the Vacation of right-of-way in the
unincorporated Town of Barnesville on the following described real estate, to-wit.
Part of the unincorporated Town of Barnesville,
located in part of the NE'/ of Section 18,
specifically, all of Ahlstrand Avenue, adjacent to
Blocks 58 and 59; all of Weldon Avenue, adjacent
to Blocks 57, 58, and 59; and the alleys between
and around the lots within Block 59, leaving a
minimum width of sixty feet (60') for Weld County
Road 61.5 as it exists adjacent to Block 59, all
being north of State Highway 392, all of which are
located in Township 6 North, Range 63 West of the
6th P.M., Weld County, Colorado, .
WHEREAS, Section 8.2.6 of the Weld County Subdivision Ordinance provides
standards for review of said Minor Resubdivision, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be approved for the
following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 8.2.5 of the Weld County Subdivision Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Section 8.2 of the Weld County Subdivision Ordinance
including specifically:
a. Section 8.2.1 - There is right-of-way shown on an approved plat or map
that has not been used for its intended purpose for the last 21 years or
since the recording of the approved plat. The amended plat for the Town
of Barnesville was recorded on August 23, 1911. The roads and alleys
proposed to be vacated have only been used by the property owners to
access their acreage. Pt,

b. Section 8.2.2 - Seventy (70) percent of the landowners adjacent to the
proposed right-of-way vacation waived any objection to the vacation by
signing a petition. The enclosed petition contains the signature of 100
percent of the landowners adjacent to the proposed vacations
c. Section 8.2.3 - The vacation is compatible with the surrounding area and
uses, is consistent with efficient and orderly development, is consistent
with the Weld County Comprehensive Plan, and does not deprive any
parcel of adequate access to a public road or street right-of-way.
d. Section 8.2.4 - The vacation of any right-of-way may require the
reservation of an easement for public utility or drainage purposes in order
to meet the easement requirements of Section 10.6 of the Weld County
Planned Unit Development Ordinance. For Lots 57, 58 and 59 north of
State Highway 392, the Weld County Utility Board has requested 10-foot
utility easements be located on abutting lots and 15-foot easements
adjacent to roadways.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Lindsey and Ruth Wilson for a Minor
Resubdivision for the Vacation of the right-of-way in the unincorporated Town of Barnesville as
hereinabove described be, and hereby is, granted subject to the following conditions:
1. The applicant shall submit a map for review by the Weld County Department of
Planning Services in accordance with Section 8.2.5.6.2 of the Weld County
Subdivision Ordinance. The map shall delineate the following:
a. The new configuration of Blocks 57, 58 and 59.
b. Block 59 north of State Highway 392 shall be combined into one block
with no lots.
c. Blocks 57, 58 and 59 shall indicate 10-foot utility easements to be located
on abutting lots and 15-foot adjacent to roadways.
2. The applicant shall submit in writing as a part of this application a request that
the lots within Block 59, north of State Highway 392, be vacated (combined into
a single lot).
3. The applicant shall contact the Weld County Public Works Department and
complete a Weld County Access Information Sheet.
4. The applicant shall submit evidence to the Weld County Department of Planning
Services that the west access to Lot 58 has been removed to the satisfaction of
the Weld County Public Works Department.

5. Lots 58, 56, and 54 shall utilize the existing platted road to the east of the lots.
This road shall be upgraded to a graded and drained road to provide all-weather
access. There will be no County maintenance on this platted road which is
considered a private lane. Lots 59, 57, 55 and 53 shall access from Weld County
Road 61.5.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 1st day of September, A.D., 1999.

THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS
REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section
8.2.5.1 of the Weld County Subdivision Ordinance.
2. The reques: is in conformance with Section 8.2 of the Weld County Subdivision Ordinance,
as follows:
a. Section 8.2.1 - There is right-of-way shown on an approved plat or map that has not
been used for its intended purpose for the last 21 years or since the recording of the
approved plat. The amended plat for the town of Bamesville was recorded on August
23, 1911. The roads and alleys proposed to be vacated have only been used by the
property owners to access their acreage.
b. Section 8.2.2 - Seventy (70) percent of the landowners adjacent to the proposed
righi-of-way vacation waive any objection to the vacation by signing a petition. The
enclosed petition contains the signature of 100% of the landowners adjacent to the
proposed vacations
c. Section 8.2.3 - The vacation is compatible with the surrounding area and uses, is
consistent with efficient and orderly development, is consistent with the Weld County
Comprehensive Plan, and does not deprive any parcel of adequate access to a
public road or street right-of-way.
d. Section 8.2.4 - The vacation of any right-of-way may require the reservation of an
easement for public utility or drainage purposes in order to meet the easement
requirements of Section 10.6. For Lots 57, 58 and 59 north of State Highway 392,
the Weld County Utility Board has requested 10 foot utility easements to be located
on abutting lots and 15 foot adjacent to roadways.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
The Department of Planning Services's staff recommendation for approval is conditional upon the
following:
1. The applicant shall submit a map for review by the Weld County Planning Department in
accordance with Section 8.2.5.6.2 of the Weld County Subdivision Ordinance. The map
shall delineate the following:
a) The new configuration of Blocks 57, 58 and 59.
b) Block 59 north of State Highway 392 shall be combined into one block with no Lots.
c) Blocks 57, 58 and 59 shall indicate 10 foot utility easements to be located on
abutting lots and 15 foot adjacent to roadways.

2. All of Block 59 north of State Highway 392 shall be combined onto one deed and a
restriction placed on the deed that no lot or combination of lots may be transferred
separately. A copy of the recorded deed shall be submitted to the Weld County Planning
Department.
3. The applicant shall contact the Weld County Public Works Department and
complete Weld County Access Information Sheet.
4. The applicant shall submit evidence to the Weld County Planning Department that
the west access to Lot 58 has been removed to the satisfaction of Weld County
Public Works.
5. Lots 58, 56, and 54 shall utilize the existing platted road to the east of the lots. This
road shall be upgraded to a graded and drained road to provide all weather access.
There will be no county maintenance on this platted road which is considered a
private lane. Lots 59, 57, 55 and 53 shall access from Weld County Road 61.4.

Dear Ms. Wilson:
Your application and related materials for the request described above are complete and in order at the
present time. I have scheduled a meeting with the Weld County Utilities Advisory Committee for
Thursday, August 12, 1999, at 10:00 a.m. This meeting will take place in the Weld County Planning
Department, Room 21(1, 1555 N. 17th Avenue, Greeley, Colorado.
It is recommended that you and/or a representative be in attendance at the meetings described above in
order to answer any questions that might arise with respect to your application.
A representative from the Department of Planning Services will be out to the property to post a sign
adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing time, date,
and location. In the event the property under consideration is not adjacent to a publicly maintained road
right-of-way, one sign will be posted in the most prominent place on the property and post a second sign
at the point at which the driveway (access drive) intersects a publicly maintained road right-of-way.

We are requesting to vacate all that part of Ahlstrand Avenue and all that part of Weldon Avenue
together with all dedicated alleys lying east of Weld Co. Rd. 61-1/2 and North of Hwy. 392 in
Block 59 as was platted in the unincorporated Town of Barnesville, Colorado -- County of Weld.
These avenues and alleys serve no useful purpose at this time.
There are no utility easements to our knowledge on this property.
We have owned this property since July of 1963, and the streets and alleys have not been used by
anyone but ourselves in conjunction with the use of our adjacent property. We own all the land
surrounding the proposed vacated streets, avenues and alleys.

The Weld County Public Works Department has reviewed this proposal. This project falls
primarily under the purview of the Weld County Minor Resubdivision Application for Vacation of
Roads, Streets, and Alleys. Our comments and requirements are as follows:
According to the Weld County Assessors records and the Town of Barnesville Block Book,
Blocks 1 through 21 and Lots 53 through 58 are all owned by the Wilson family.
The applicant is asking to vacate Ahlstrand and Weldon Avenues together with all dedicated
alleys lying east of WCR 61.5 and north of WCR 392 in Block 59 as was platted in the
unincorporated Town of Barnesville.
There is an existing residence on Lot 58 with access onto WCR 392. The Town of Barnesville
plat identifies an access onto WCR 392 which will serve Lots 58, 56, and 54. These are all
legally platted lots. Lot 58 is currently using both access points. Weld County Public Works
Department recommends closure of the western access and utilize the existing platted road for
one main access point for the three (3) lots. The access road serving Lots 58, 56, and 54 shall
be upgraded to a graded and drained road to provide all-weather access. This platted road is
considered a private lane with no county maintenance.
The remaining plat:ed lots (59, 57, 55, and 53) shall access from WCR 61.5. Please contact
Weld County Public Works Department to complete a Weld County Access Information Sheet.
This vacation will create no land-locked parcels.
