HomeMy WebLinkAbout970664.tiffRESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST BRIAN SOUKUP FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Brian Soukup, VI #9600045, is allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of April, 1997, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Brian Soukup, property owner, was represented by his attorney, Jacqueline Johnson, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until June 15, 1997, to allow adequate time for the current tenants to vacate the residences and for the property owner to remove the mobile home and miscellaneous debris and convert the tack/feed store and scale house back to allowable uses, and for an inspection of the property by the Department of Planning Services staff, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County Attorney for legal action against Brian Soukup to remedy the violation of the Weld County Zoning Ordinance, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until June 15, 1997, to allow adequate time for the current tenants to vacate the residences and for the property owner to remove the mobile home and miscellaneous debris and convert the tack/feed store and scale house back to allowable uses, and for an inspection of the property by the Department of Planning Services staff. 970664 PL0824 Le.: PL; CHI' 5otcx!co VI #9600045 - BRIAN SOUKUP PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 8th day of April, A.D., 1997. THE TWO HOUSES (STICK BUILT) ARE OLD AND WOULD BE ALLOWED BECAUSE THEY EXISTED PRIOR TO ZONING. THE PROPERTY ALSO NEEDS TO BE CLEANED UP A LITTLE. THERE ARE TIRES AND MISCELLANEOUS DEBRIS ON THE PROPERTY. THERE ARE EIGHT ADULT DOGS ON THE PROPERTY WHICH WOULD BE IN COMPLIANCE AT THIS TIME BECAUSE THERE ARE MORE THAN 10 ACRES. THE OTHER ANIMAL UNITS (HORSES AND COWS) ARE IN COMPLIANCE AT THIS TIME. A VIDEO WAS TAKEN AT THE TIME OF INSPECTION. VI #9600076 - Paul and Elizabeth Barger: Ms. Chester reviewed the case file for the record and indicated subject property is in violation of 31.2 and 31.3.9 of the Weld County Zoning Ordinance. She stated the property owners have been very cooperative and only two vehicles remain in violation. Paul Barger, property owner, was present and indicated his plan is to build a shed to store the remaining vehicles, and asked for thirty to sixty days to build a temporary fence for screening until he can get the shed built. No public comment was offered. Commissioner Harbert moved to delay referral of VI #9600076 against Paul and Elizabeth Barger to the County Attorney for legal action until December 1, 1996, to allow the property owners sufficient time to appropriately screen the two derelict vehicles.
