RE: APPROVE MEMORANDUM OF AGREEMENT AND ADDENDUM GRANTING
RIGHT-OF-WAY AND TEMPORARY EASEMENT TO COLORADO DEPARTMENT
OF TRANSPORTATION, AUTHORIZE CHAIR TO SIGN, AND RESCIND
RESOLUTION #970265 -- STATE HIGHWAY 119 AND 1-25 PROJECT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, in February 1997, the Board received a request from the Colorado
Department of Transportation (CDOT) to approve Memorandum of Agreement (MOU) for
Project Number #IR-IM(CX)025-3(110), with Addendum, granting a right-of-way and temporary
easement to CDOT for use in its State Highway 119 and 1-25 Project, and
WHEREAS, although the Board approved the MOU with Addendum on February 10,
1997, the Board's Resolution #970265, which was intended to document said approval,
incorrectly referred to a different MOU regarding the granting of another temporary easement
for the same project, which grant was previously approved by the Board on November 4, 1996,
through Resolution #961973, and
WHEREAS, it is now necessary for the Board to clarify that Colorado Department of
Transportation MOU for Project Number #IR-IM(CX)025-3(110), with Addendum thereto, was
approved through action of the Board on February 10, 1997, and through this Resolution is
formally approved, that the Chair is authorized to sign the same and any necessary
documentation to close the transaction, and that Resolution #970265 be rescinded.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Colorado Department of Transportation MOU for Project
Number #IR-IM(CX)025-3(110), with Addendum thereto, which was approved through action
of the Board on February 10, 1997, be, and hereby is, formally approved, that the Chair is
authorized to sign the same and any necessary documentation to close the transaction, and
that Resolution #970265 be, and hereby is, rescinded.
