HomeMy WebLinkAbout991307.tiff HEARING CERTIFICATION DOCKET NO. 99-34 RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1216 FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY (STORAGE AND REPAIR OF DOWNHOLE OIL FIELD TOOLS) IN THE A (AGRICULTURAL) ZONE DISTRICT - LANCE MESSINGER A public hearing was conducted on June 2, 1999, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Julie Chester Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated May 19, 1999, and duly published May 22, 1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of Lance Messinger for an Oil and Gas Support and Service Facility (storage and repair of downhole oil field tools) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Julie Chester, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Chester stated the applicant is proposing an 11,900 square-foot building for the storage of downhole equipment, as well as screened outdoor storage, all located south of the Town of Platteville. She further stated one letter of opposition was received, which has been addressed through the Conditions of Approval and Development Standards, and reviewed the reasons for conditional approval by the Planning Commission. Ms.Chester stated the Weld County Department of Public Health and Environment recommends deleting the last sentence of Development Standard #11 based on the letter from Victor Weidmann, Weidmann Engineering, dated April 28, 1999. She also recommends amending Conditions of Approval #2.B.2 and #2.D to replace the word "retention" with "detention". In response to Commissioner Vaad, Ms. Chester explained the review process for issuing a building permit, and stated in this situation, during the inspection process, the inspector determined that the structure did not qualify as an agriculturally exempt building and that a Use by Special Review Permit was necessary. In response to Commissioner Baxter, Lance Messinger, applicant, explained Development Standard #6 refers to the water used to wash his tools and trucks. Mr. Messinger explained the tools are washed in a bath which is pumped into a retention tank and later hauled to a certified disposal facility by a water truck. He added the tools do not have much mud or oil on them; however, they do wash off rust which accumulates due to the extreme temperature changes. 991307 • , PL1308 HEARING CERTIFICATION - LANCE MESSINGER (USR #1216) PAGE 2 Responding to Chair Hall, Mr. Messinger stated he has reviewed and agrees with the Conditions of Approval and Development Standards. No public testimony was offered concerning this matter. In response to Commissioner Geile, Ms. McConnellogue stated Development Standard #11 will be sufficient with the deletion of the last sentence. Commissioner Vaad moved to approve the request of Lance Messinger for a Site Specific Development Plan and Special Review Permit #1216 for an Oil and Gas Support and Service Facility (storage and repair of downhole oil field tools) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record and to delete the last sentence of Development Standard#11, and amend Conditions of Approval#2.B.2 and#2.D to replace the word "retention" with "detention". The motion was seconded by Commissioner Baxter, and it carried unanimously. This Certification was approved on the 7th day of June, 1999.
