RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST PHILIP AND CAROL PFANNEBECKER FOR VIOLATION
OF THE WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Philip and Carol Pfannebecker, VI #9600309, are allegedly in violation of
the Weld County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of May, 1997, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Philip Pfannebecker, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until July 1, 1997, to allow adequate time for the property owners to
bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Philip and Carol Pfannebecker to remedy the violation
of the Weld County Zoning Ordinance, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until July 1, 1997, to
allow adequate time for the property owners to bring the subject property into compliance.

The uses on the above described property are being considered as a zoning violation of Section 31.2,
31.2.1, 31.2.16 and 43 of the Weld County Zoning Ordinance. This is not a use allowed by right in the
Agricultural zone district.
The violation can be corrected by not using the Recreational vehicle for any temporary or overnight
housing or obtaining the appropriate permits to use it as a second residence on the property.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from March 18, 1997 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.

Re: Philip Pfannebecker
Dear Ms. Chester:
I am writing in regards to Phil Pfannebecker who is a patient of mine. Mr. Pfannebecker
underwent reconstruction of his left knee anterior cruciate ligament on December 16, 1996.
Typically following this procedure, the time involved with returning to a laborious type job is
anywhere from four to six months. This is very much dependant upon return of leg strength
and also confidence in the knee. Certainly activities which are done at ground level that do not
require heavy lifting and/or twisting could be done at.a sooner point but this would be
dependant upon again, return of strength and knee confidence. Currently Phil is doing quite
well with his rehab and is having rapid restoration of his knee motion and has good stability.
I anticipate him to continue to do well.
At this point, I would not recommend him returning to his former type of work for at least four
to five months from the reconstruction date which would place him somewhere in the late period
of March or early April. I have discussed this with him and he is well aware of that. He is also
undergoing some rehabilitation for his low back as well as his right ankle which was also injured
at the time of his accident.

with you at any time.

It has come to the attention of the Department of Planning Services' staff that the uses on your
property (4122 Sunrise Lane) may not be in compliance with the Weld County Zoning
Ordinance. The potential noncompliance with the zoning ordinance is a recreational vehicle
being used as a second residence on the property without the appropriate permits.
