WYLY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 30th day of December, 1996, considered the request of Bill J. Wyly, P.O. Box 151038, Lakewood, Colorado 80228, for a mobile home to be used as a principal dwelling, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lot 2, Block 13, Aristocrat Ranchettes Subdivision, Inc., located in Section 27, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved septic system and a legal water supply. 3. The mobile home shall not be occupied until such time that the applicant has complied with the above mentioned conditions. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Bill J. A list of signatures was submitted, but it lacked the required number of signatures. Pursuant to the standards set forth in Weld County Zoning Ordinance Section 43.2.6, the Department of Planning Services recommends approval of ZPMH 2042 for the following reasons: 1. It is compatible with the Weld County Comprehensive Plan. 2. It is compatible with the surrounding area. 3. It is in harmony with the character of the neighborhood. 4. It will not adversely affect the immediate area. 5. It will be adequately served by water and sewage disposal facilities. 6. It will not adversely affect the general health, safety and welfare of the inhabitants of the area and the County. The Planning Commission had the following concerns: The application shows water will be provided by a well. It is the Planning Commissions understanding that Aristocrat will soon be supplying mountain water for the residents. The Planning Commission would like to recommend that new water users be asked to buy into the new water supply. If it is not possible for the users to tie into the new system the commission would like to stress that proper maintenance of the cistern be enforced to avoid problems for the home in the future. The Planning Commission is also concerned with maintenance of septic systems in the Aristocrat Subdivision and again would like to stress that proper maintenance be enforced. Septic systems that are improperly cared for could result in seepage from the septic tank which could result in ground water contamination. The Planning Commission had the following concerns The application shows water will be provided by a well. It is the Planning Commissions understanding that Aristocrat will soon be supplying mountain water for the residents. The Planning Commission would like to recommend that new water users be asked to buy into the new water supply. If it is not possible for the users to tie into the new system the commission would like to stress that proper maintenance of the cistern be enforced to avoid problems for the home in the future. The Planning Commission is also concerned with maintenance of septic systems in the Aristocrat Subdivision and again would like to :stress that proper maintenance be enforced. Septic systems that are improperly cared for could result in seepage from the septic tank which could result in ground water contamination.
