HomeMy WebLinkAbout990754.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO APRIL 7, 1999 TAPE #99-10 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, April 7, 1999, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Comptroller, Claud Hanes MINUTES: Commissioner Vaad moved to approve the minutes of the Board of County Commissioners meeting of April 5, 1999, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. READ ORDINANCE BY TAPE: Commissioner Baxter moved to read Ordinance#119-0 by tape. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. ADDITIONS TO AGENDA: There were no additions to the agenda. CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the consent agenda as printed. Commissioner Baxter seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports. PUBLIC INPUT: There was no public input. n 990754 x n BC0016 WARRANTS: Claud Hanes, Comptroller, presented the following warrants for approval by the Eoard: All Funds $798,338.35 Commissioner Baxter moved to approve the warrants as presented by Mr. Hanes. Commissioner Kirkmeyer seconded the motion, which carried unanimously. BIDS: PRESENT BIDS: Pat Persichino, Director of General Services, stated there are no new bids to present at this time. APPROVE ELECTRONIC HOME MONITORING BID - SHERIFF'S OFFICE: Mr. Persichino stated the Sheriff's Office recommends approval of the low bid from Intervention Administration with a fee of$10 to $15 per day per offender. Commissioner Kirkmeyer moved to approve said low bid. Seconded by Commissioner Baxter, the motion carried unanimously. APPROVE CHIP SEAL PROJECT FOR 1999 BID - PUBLIC WORKS DEPARTMENT: Mr. Persichino stated the Public Works Department recommends the low bid from Kirkland Construction, LLC, in the amount of $482,364, which is below the engineer's estimate. Commissioner Kirkmeyer moved to approve said low bid. Seconded by Commissioner Baxter, the motion carried unanimously. APPROVE ARCHITECTURAL SERVIICES FOR THE NEW TRAINING CENTER BID - FINANCE DEPARTMENT: Mr. Persichino recommended approval of the low bid from Bley Associates, Architects. Commissioner Baxter moved to approve said bid. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. BUSINESS: NEW: CONSIDER CHILD HEALTH PLAN PLUS SATELLITE ELIGIBILITY DETERMINATION SITE AND COMMUNITY HEALTH PLAN ENROLLMENT PROJECT SERVICES AGREEMENT AND AUTHORIZE CHAIR TO SIGN - CHILD HEALTH ADVOCATES: John Pickle, Director of Health Department, stated recent legislation provides for outpatient and inpatient medical services to children under age nineteen in medically indigent families. Mr. Pickle stated under this agreement, the Weld County Health Department will become a Satellite Eligibility Determination Site to assist clients in completing applications for the Child Health Plan Plus. Commissioner Vaad moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. CONSIDER CHANGE ORDER LETTER FOR WELD COUNTY COMMUNITY CORRECTIONS BOARD AND AUTHORIZE CHAIR TO SIGN: Bruce Barker, County Attorney, stated this change order decreases funds for programs that are underspent and re-allocating the money to programs which are needing additional funds. Commissioner Baxter moved to approve said change order Minutes, April 7, 1999 990754 Page 2 BC0016 letter and authorize the Chair to sign. Seconded by Commissioner Vaad, the motion carried unanimously. CONSIDER AUTHORIZATION FOR WELD COUNTY TREASURER TO CANCEL CERTAIN COUNTY TAX LIEN SALE CERTIFICATES: Mr. Barker explained the Treasurer's Office is requesting Tax Lien Sale Certificates 963/91 and 417/92 be canceled because a second tax lien sale certificate of purchase was sold on each of them. He stated the first owners were given notice of their option to endorse all subsequent taxes on to their certificate and make an application for a Treasurer's Deed; however, they chose not to take any action. In response to Commissioner Vaad, Mr. Barker stated there is no consequence to the first holder; they simply cannot apply for a deed. Commissioner Baxter moved to approve cancellation of said Tax Lien Sale Certificates. Commissioner Kirkmeyer seconded the motion, which carried unanimously. CONSIDER SETTING AMOUNT OF COMPENSATION FOR ELECTION JUDGES AND BRANCH REGISTRARS: Mr. Barker stated J.A. "Suki" Tsukamoto, Clerk and Recorder, is requesting the Board increase the election judge pay from $80 to $100 per election. He explained each judge must attend a class, and the additional$20 will compensate the judges for their time in class. Commissioner Kirkmeyer moved to set the amount of compensation Election Judges and Branch Registrars at $100 per election. Seconded by Commissioner Vaad, the motion carried unanimously. PLANNING: FIRST READING OF ORDINANCE #119-O, IN THE MATTER OF THE REPEAL AND RE-ENACTMENT OF THE WELD COUNTY BUILDING CODE ORDINANCE: Dave Sprague, Building Inspections, read the Planning Commission Recommendation for the record. He submitted proposed changes to Section 20.1.11 regarding handicap accessibility which will be more consistent with Colorado State Code and to Section 90.1 regarding the Building Code Board of Appeals. In response to Commissioner Geile, Mr. Sprague stated approximately 24 municipalities or entities now recognize or have adopted the International Codes. He added the Uniform Building, Mechanical and Electrical Codes are generally adopted by the municipalities; however, the International Plumbing and Mechanical Codes may cause a few inconsistencies at first. Commissioner Kirkmeyer commented there is currently inconsistency among the towns in Weld County due to the various versions and amendments which have been adopted. Commissioner Geile expressed concern that the new International Codes will cause a hardship for contractors and utility companies. Commissioner Kirkmeyer reiterated contractors and utility companies already have to deal with the inconsistency between the various entities throughout Weld County and'the State of Colorado. Mr. Sprague stated the switch to the International Plumbing and Mechanical Codes will be relatively easy due to the additional flexibility. David Korth, Johnstown Building Official, gave a brief description of his background and qualifications, and stated the International Plumbing Code is equivalent to the Colorado State Plumbing Code. In response to Commissioner Baxter and Chair Hall, Mr. Korth stated code certifications are not required; however, they do prove that a person is knowledgeable in a particular code. In response to Commissioner Baxter, Mr. Korth agreed that the International Minutes, April 7, 1999 990754 Page 3 BC0016 Codes incorporate most of the Uniform Codes, as well as changes which are more flexible. Responding to Commissioner Geile, Mr. Korth stated the International Codes will not add more! restrictions, they are compatible with the Uniform Codes, and will allow more ways of accomplishing a job less expensively. In response to Commissioner Geile, Mr. Korth stated the International Codes will be accepted nationally, rather than the Uniform Codes which are only recognized in the western United States. Mr. Sprague clarified the Board can make amendments to the International Code if desired. Responding to Commissioner Kirkmeyer and Chair Hall, Mr. Korth reiterated the International Codes offer more choices and flexibility to builders, and are equal to the Colorado State Codes. Greg Wheeler, City of Thornton representative, gave a brief description of his background and qualifications, and stated the City of Thornton is very interested in Weld County's decision because it will be considering adoption of the International Codes this summer. In response to Commissioner Geile, Mr. Wheeler addressed the concerns in a letter from Regional Inspectors Association, Inc., by stating the International Plumbing Code (IPC) does meet the minimum levels of protection required by the Colorado Plumbing Code. He further stated, that although there is no performance history, the authors of the IPC are many of the same people involved in drafting the Uniform Codes and added many entities have been using the International Codes since 1995. Mr. Wheeler stated inspections will be the same, if not more flexible, and the adoption of the International Codes will not produce profit to the Code Development Committee. He stated the members involved are experts who feel this is a better, more inclusive code. In response to Commissioner Baxter, Mr. Wheeler stated the only reason for strong opposition to the International Codes is resistance to change. He explained the format or specific wording may be different; however, the requirements remain the same with more options. He stated a broader variety of nationally tested materials will be accepted which will allow contractors to do work less expensively in cost, not quality. In response to Chair Hall, Mr. Wheeler stated the flexibility will allow more options to solve unforseen construction problems. Responding to Commissioner Geile, Becky Baker, Jefferson County Chief Building Official, stated she strongly supports the proposed ordinance and gave a brief overview of the States and municipalities which have already adopted a portion or all of the International Codes. Steve Thomas, Corporation of Code Consultants, stated he supports this proposal based on the fact that the International Codes will incorporate the three distinct code areas across the U.S. He explained the International Codes are equivalent to Colorado Codes and will provide adequate protection for the health and safety of Weld County residents. In response to Commissioner Baxter, Mr. Thomas stated this Code should not cause problems for builders who are currently following the State Code, which is accepted by the International Codes. Mr. Sprague stated the purpose for drafting the International Codes was to produce uniformity among the regional codes and inspectors. In response to Commissioner Geile, Mr. Sprague stated that although many contractors and builders are comfortable with the Uniform Codes, the International Codes will actually benefit the businesses and contractors. Minutes, April 7, 1999 990754 Page 4 BC0016 Responding to Lee Morrison,Assistant County Attorney, Mr. Sprague stated he receives excellent support and commentaries from the International Conference of Building Inspectors, whereas he rarely receives a support response from the State under the Uniform Code. He further stated good support and commentaries will lead to more consistency as people receive uniform interpretation of the various codes. Responding to Commissioner Geile, Mr. Morrison stated a lack of support causes more diverse interpretation of the various codes and support from a higher level will cause long-term uniformity among inspectors and the type of work that is done. Mr. Korth stated that as a teacher at Front Range Community College, he notices drastic changes between the various versions that are printed every three years, many of which are not indicated in the margins for easy reference. In response to Commissioner Baxter. Mr. Korth stated the International Codes are clearly marked to show any changes made, and added there is a book which compares the differences between the Uniform Codes and the International Codes. There was no public testimony concerning this matter. Mr. Barker submitted two Planning Commission Exhibits for the record, marked Exhibits A and C; however, Exhibit B has been misplaced regarding a comparison of the International Plumbing Code and the Uniform Plumbing Code. Mr. Barker also submitted a memorandum from Senator Norma Anderson, marked Exhibit 1, indicating the options available to local municipalities and government entities regarding the adoption of plumbing codes. He read suggested wording to be added following the fourth Whereas for the record regarding adoption of a code must meet the minimum requirements of the Colorado Plumbing Code, and clarified the proposed changes to Sections 20.1.11 and 90.1 will make the Ordinance more consistent with the Colorado Code. In response to Commissioner Baxter, Mr. Sprague stated the appeals process remains the same and the changes to Section 90.1 simply give authority to the Building Code Board of Appeals to approve new types of plumbing material and methods. Commissioner Kirkmeyer commented that she agrees with Commissioner Geile that additional hardships should not be placed on local contractors, however,the five experts speaking in favor of the International Code stated it will not create additional restrictions,will allow for less expensive construction, is more flexible with the amount of choices offered, will not compromise the health and safety of the public, and is compatible with the Uniform Codes and the Colorado Code. Commissioner Kirkmeyer moved to approve Ordinance#119-O on first reading with the additional wording following the fourth "Whereas", and the proposed changes to Sections 20.1.11 and 90.1. Commissioner Baxter seconded the motion. Commissioner Geile stated he has not been given enough evidence that the International Code will be a benefit to contractors and he sees no reason to change. Commissioner Baxter commented there appears to be a substantial amount of objection to the change and hopes people with concerns will be present at the following readings to give additional input. Upon a call for the vote, the motion passed with Commissioner Geile opposed. Ordinance #119-O was approved with changes on first reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
