Dear Mr. Confer:
Department of Planning Services staff Reviewed your request for release of collateral for USR-918
and CD, the Second Amended Performance Guarantee Agreement. Section "6.0 Guarantee:" of this
agreement states in part:
This total guarantee in the amount of $33,690 shall be on deposit not less than 10 days
before the facility is to start any test burn operation and SHALL REMAIN IN PLACE AND
CONTINUE FOR THE LIFE OF THE FACILITY AND UNTIL FINAL CLOSURE HAS
OCCURRED.
Due to the facts that final closure has not occurred and that you desire to maintain the Use by Special
Review and Certificate of Designation permits, collateral can not be released under the terms of the
current agreement. At the time that the final closure has occurred and the Use by Special Review and
Certificate of Designation permits have been vacated, the collateral can be released.
