RE: APPROVE CONTRACT AMENDMENT #1 TO FAMILY PLANNING CONTRACT AND
AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Contract Amendment #1 to the Family
Planning Contract between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Health Department, and the Colorado
Department of Public Health and Environment, commencing October 1, 1997, and ending
June 30, 1998, with further terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Contract Amendment #1 to the Family Planning Contract between
the County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Health Department, and the Colorado Department of Public
Health and Environment, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by the
following vote on the 1st day of October, A.D., 1997.

CONTRACT AMENDMENT #1
THIS AMENDMENT, made this 1st day of October, 1997, by and between the State of
Colorado for the use and benefit of the Department of Public Health and Environment, 4300
Cherry Creek Drive South, Denver, Colorado 80222-1530, hereinafter referred to as the
State, and Weld County Health Department, 1517 16th Avenue Court, Greeley, Colorado,
80631, hereinafter referred to as the contractor.
WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated, and
otherwise made available and a sufficient unencumbered balance thereof remains available
for payment in Fund Number 100 , Appropriation Code 624, Contract Encumbrance
Number FPP960020; and
WHEREAS, required approval, clearance, and coordination has been accomplished from
and with appropriate agencies; and
WHEREAS, the parties entered into a contract dated July 1, 1995, contract number
FPP960020, routing number 960020, amended by Contract Renewal Letter, dated June 3,
1996, routing number 9705173 and Contract Renewal Letter, dated May 28, 1997, routing
number 9807119, hereinafter referred to in total as the Original Contract, whereby
contractor was to provide certain services to the State; and
WHEREAS, the State desires to amend and increase the original contract by $15,100 in
order for contractor to serve 100 new uninsured women or couples who are not Medicaid
eligible with incomes at or below 100% of poverty.
NOW THEREFORE, it is hereby agreed that:
1. Consideration for this Amendment to the Original Contract, contract encumbrance
number FPP960020, contract routing number 960020, dated July 1, 1995, consists of
payments which shall be made pursuant to this amendment and the original contract and the
parties' promises and agreements herein set forth.
2. It is expressly agreed by the parties that this Amendment is supplemental to the
Original Contract, contract number FPP960020, routing number 960020, amended by
Contract Renewal Letter, dated June 3, 1996, routing number 9705173 and Contract
Renewal Letter, dated May 28, 1997, routing number 9807119, which is, by this reference,
incorporated herein and made a part hereof and is attached hereto as Exhibit ONE. All

terms, conditions, and provisions of the Original Contract, unless specifically modified
herein, are to apply to this Amendment as though they were expressly rewritten,
incorporated, and included herein.
3. It agreed the Original Contract is and shall be modified, altered, and changed in the
following respects only:
a. The following provision is added to the Original Contract as paragraph If:
Contractor will offer delayed exams, reduce barriers to service, and engage
in outreach efforts. Contractor will serve 100 new uninsured women or
couples who are not Medicaid eligible and whose incomes are at or below
100% of poverty. (New clients are those never seen before and those not
seen for two or more years.) Contractor must establish a mechanism to
record unduplicated numbers of patients served by age, income code, gender,
and contraceptive method. Contractors providing delayed exams must track
how many patients return for a comprehensive exam.
b. Paragraph 6 of the Contract Renewal Letter, routing number 98071196, is
hereby modified to increase the total contract amount for the period July 1,
1997 through June 30, 1998, by Fifteen thousand one hundred dollars
($15,100) to a new total contract amount of Ninety-three thousand five
hundred sixty-eight dollars ($93,568).
c. Paragraph 6 a of the Original contract is modified by the addition of
paragraph 3): Contractor will bill for 1/9th of the $15,100 monthly
($1677.78/month) unless alternative arrangements have been made with the
State.
d. A progress report containing summarization of activities, information
regarding patients served and an accounting of expenditures must be
provided by February 28, 1998. If these reports suggest contractor will not
meet the goal of serving 153 new patients by June 30, funds may be
redistributed in April 1997. A final report containing the same information
must be provided by August 15, 1998.
e. The terms of the Original Contract are hereby modified accordingly.
4. The effective date of this Amendment is October 1, 1997.
5. Except for the "General Provisions" and "Special Provisions", in the event of any
conflict, inconsistency, variance, or contradiction between the provisions of this
Amendment or any of its attachments or exhibits, and any of the provisions of the Original
Contract, the provisions of this Amendment shall in all respects supersede, govern, and

control. The "Special Provisions" shall always be controlling over other provisions in the
contract or amendments. The factual representations in the Special Provisions concerning
the absence of bribery or corrupt influences and personal interest of State employees are
presently reaffirmed.
6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE
CURRENT FISCAL YEAR ARE CONTINGENT UPON FUNDS FOR THAT PURPOSE
BEING APPROPRIATED, BUDGETED, AND OTHERWISE MADE AVAILABLE.
7. THIS AMENDMENT SHALL NOT BE DEEMED VALID UNTIL IT SHALL
HAVE BEEN APPROVED BY THE CONTROLLER OF THE STATE OF COLORADO
OR SUCH ASSISTANT AS HE MAY DESIGNATE.
IN WITNESS WHEREOF, the parties hereto have executed this Amendment on the day
first above written.

Amendment #1 to Family Planning Contract
Enclosed for Board review and approval is Amendment #1 to the Family Planning Contract
between the Colorado Department of Public Health and Environment and Weld County Health
Department (WCHD).
With the provisions of this amendment, WCHD will offer delayed exams, reduce barriers to
service and engage in outreach services. The Health Department will serve 100 new uninsured
women or couples who are not Medicaid eligible and whose incomes are at or below 100% of
poverty.
For these services, the Health Department will be paid an amount not to exceed $15,100 for the
time period October 1, 1997 through June 30, 1998.
