HomeMy WebLinkAbout990509.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MARCH 15, 1999 TAPE #99-08 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, March 15, 1999, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County Commissioners meeting of March 10, 1999, as printed. Commissioner Vaad seconded the motion, and it carried unanimously. ADDITIONS TO AGENDA: There were no additions to the agenda. CONSENT AGENDA: Commissioner Baxter moved to approve the consent agenda as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. PUBLIC INPUT: There was no public input. WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $766,587.63 Commissioner Kirkmeyer moved to approve the warrants as presented by Mr. Warden. (� BC0016 BUSINESS: NEW: CONSIDER 1999 APPLICATION TO CONDUCT PUBLIC DANCE OR DANCES - RAFFERTYS, INC., DBA RAFFERTYS: Bruce Barker, County Attorney, stated this is a yearly application which will expire December 31, 1999. Commissioner Vaad moved to approve said application. Seconded by Commissioner Geile, the motion carried unanimously. CONSIDER ACCEPTANCE OF DEED OF DEDICATION AND AUTHORIZE CHAIR TO SIGN - ELTON AND PATRICIA MOSKALSKI: Mr. Barker stated Elton and Patricia Moskalski are dedicating 60 feet of right-of-way on a portion of Weld County Road 90 as described in Exhibit A, from Intermill Land Surveying. Commissioner Vaad moved to accept said deed and authorize the Chair to sign. Seconded by Commissioner Geile, the motion carried unanimously. CONSIDER ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT AND AUTHORIZE CHAIR TO SIGN - CAMAS COLORADO, INC.: Frank Hempen, Jr., Director of Public Works, stated this agreement pertains to the Riverview Resource site in accordance with a Condition of Approval in Use by Special Review Permit #897. He explained the agreement provides for the maintenance and any necessary improvements to the haul route along Weld County Roads 27 and 64. Mr. Hempen stated Camas Colorado, Inc., will also be required to construct acceleration and deceleration lanes along Weld County Road 27, also known as 83rd Avenue. Commissioner Baxter moved to approve said agreement and authorize Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. CONSIDER DECLARE CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE TRADE-IN OF SAME, AND AUTHORIZE PURCHASE OF USED EQUIPMENT: Dave Becker, Department of Public Works, stated the Public Works Department has a 1985 Caterpillar Generator which is need of a complete overhaul,which will cost approximately$24,499.00. Mr. Becker stated Wagner Equipment Company has a used generator for sale which is eleven years newer than the current equipment and costs $33,400.00, with $4,133.00 as a trade-in for the old generator. In response to Commissioner Geile, Mr. Becker stated the generator is used to run crushing equipment, water pumps, and other large machinery. Responding to Commissioner Vaad, Mr. Becker explained this type of machinery does not use computer technology and should not create a problem with Y2K compliancy. Mr. Warden stated that Weld County agreements are requiring that any equipment or service purchased be Y2K compliant. Commissioner Kirkmeyer moved to declare said equipment as surplus, approve trade-in of same, and authorize the purchase of used equipment. Seconded by Commissioner Vaad,the motion carried unanimously. CONSIDER APPLICATION FOR FEDERAL ASSISTANCE FOR WELD COUNTY REGIONAL COMMUNICATIONS AND AUTHORIZE CHAIR TO SIGN: Mr. Warden stated this application is similar to the one submitted last year. He explained the funding will provide for mobile computer terminal access, dispatch services, computer aided dispatch records, and information photo images. The municipal law enforcement agencies which will benefit from Minutes, March 15, 1999 990509 Page 2 BC0016 this project will be Ault, Dacono, Eaton, Firestone, Frederick, Gilcrest, Greeley, Johnstown, Kersey, Lochbuie, Milliken, Platteville,and Windsor. Commissioner Baxter moved to approve said application. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. FINAL READING OF ORDINANCE #84-U, IN THE MATTER OF AMENDING FEES FOR SERVICES PROVIDED BY WELD COUNTY: Commissioner Kirkmeyer moved to read Ordinance #84-U by title only. Seconded by Commissioner Baxter, the motion carried unanimously. Mr. Barker read said title for the record. Mr. Warden stated the Assessor's Office requested this ordinance be amended to increase the fee charged for Assessor and Treasurer maps from $5.00 to $10.00, as well as clarify the fee for obtaining computer records. There was no public comments concerning this matter. Commissioner Kirkmeyer moved to approve Ordinance#84-U on final reading. Commissioner George Baxter seconded the motion, which carried unanimously. PLANNING: FINAL READING OF ORDINANCE#147-P,AMENDING THE WELD COUNTY COMPREHENSIVE PLAN:Commissioner Kirkmeyer moved to read Ordinance #147-P by title only. Seconded by Commissioner Baxter, the motion carried unanimously. Mr. Barker read said title for the record. Anne Best-Johnson, Department of Planning Services, stated she has received no comments concerning this matter and recommended approval. In response to Commissioner Geile, Jean Robins, City of Longmont representative, stated the Parks Director does not anticipate an entrance fee for the park; however, there may be a difference in fees charged to residents versus non-residents for organized recreational activities. There was no public testimony concerning this matter. Commissioner Baxter moved to approve Ordinance #147-P on final reading. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. FINAL READING OF ORDINANCE#191-D,AMENDING THE WELD COUNTY MIXED USE DEVELOPMENT PLAN: Commissioner Baxter moved to read Ordinance #191-D by title only. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. Mr. Barker read said title for the record. There was no public testimony concerning this matter. Commissioner Kirkmeyer moved to approve Ordinance #191-D on final reading. Seconded by Commissioner Baxter, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. Ordinances #84-U, #147-P, and #191-0 were approved on final reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
