After our review of the application and a site visit by Natural Resources Conservation Service personnel, we have the following comments: SOIL LIMITATIONS **************** The only soil which may limit proposed activities is the Vona loamy sand, 5% to 9% slopes, which has moderate limitations because of steep slopes. COVER CROP ********** According to the applicant, soil erosion is currently controlled by planting a cover crop. However, the planned structures will make annual cropping more difficult. For this reason, we are including a native grass seed mix and instructions for planting that will provide erosion control without annual soil disturbance. Sincerely, nAz y� Ed Backstrom Southeast Weld Soil Conservation District 972507 RECOMMENDED PRACTICES FOR GRASS SEEDINGS COVER CROP: If possible, plant a cover crop of long season grain sorghum, or forage sorghum from mid -May to mid - June before planting grass during winter. This cover will hold the soil and grass seed in place while the grass becomes established. Mow the cover crop before physiological maturity is reached to a height of 12" to 18" to prevent sorghum seed from sprouting next summer. Seeding rates should be eight pounds per acre on sandy soils and 15 pounds per acre on clay soils. Planting should be done from northeast to southwest if possible, or west to east if not. PLANTING: Sometime between November 1 and April 30 when the ground is unfrozen, plant the grass 1/4 to 3/4 inches deep in 7" to 12" rows. Planting should be done from northeast to southwest if possible, or west to east if not. Use a grass drill equipped with an agitator box, depth bands, and double disc furrow openers with the drop tube placement directly between the disks. MULCHING: New seedings not planted into a cover crop should be protected by a mulch of 4000 lbs. per acre weed -free native grass hay crimped into the soil surface. Crimping the hay into the soil surface will help prevent it and the grass seed from blowing away. It will also slow evaporation which will leave more water for seed germination, and retard weed germination and growth. WATER EROSION: Mulching may not be enough to prevent erosion on steep slopes or in areas of periodic water flow. In these areas, install silt fences perpendicular to the direction of water flow. This will help to prevent water from building up enough force as it flows to wash out the mulch or grass seed. FERTILIZER: Because many weed species emerge before the grass will, any fertilizer applied will be utilized by the weeds, making them even more competitive. No fertilizer is recommended for native grass seedings in this area. WEED CONTROL: Until the grass seedlings have reached a five leaf growth stage mowing is the preferred method of weed control. Mowing off the tops of the grass plants should be avoided. Timeliness of any weed control option is " essential. Contact Colorado Cooperative Extension Service for herbicide recommendations, or NRCS for the best time for mowing operations. Weeds will need to be controlled with mowing or herbicides until the grasses are established, usually the first four years after planting. Once established, the grass can withstand heavy traffic or grazing. Environmental Protection Servic CASE NUMBER: USR-1158 NAME: Younger, James Environmental Protection Services has reviewed this proposal; the following conditions are recommended to be part of any approval: 1. Prior to start-up, the facility shall submit a comprehensive manure and waste water handling plan to the Weld County Health Department for review and approval. This plan shall describe how all manure and waste water generated at the site will be treated, disposed, or recycled in accordance with the Confined Animal Feeding Operations Control Regulations. (5 CCR 1002-19). 2. The applicant shall remove, handle, and stockpile manure in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The surfaces beneath the manure storage and composting areas shall be constructed to minimize seepage or percolation of manure contaminated water. In no event shall the facility impact or degrade waters of the State. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. This is not meant to include the on -site burial of dead ducks or eggs. 5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance cconditions 6. In accordance with C.R.S. 25-1-612 the applicant shall not place any dead ducks in any manure piles or within one (1) mile of any residence. Dead ducks shall not be placed in manure piles to be relocated within one (1) mile of a residence in the future. Dead ducks may be buried on -site provided they are immediately covered with dirt. 7. Fugitive dust shall be controlled on this site. 8. The maximum permissible noise level shall not exceed the light industrial limit of 70 972:'? A NPDES Permit shall be obtained from the Water Quality Control Division of the Colorado Department of Health for any proposed discharge into State Waterways. 10.The facility shall maintain compliance with the Confined Animal Feeding Operations Control Regulations and Section 47 of the Weld County Zoning Ordinance. 11.All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 12.The facility shall be operated in a manner to control flies. A fly abatement plan shall be submitted to the Weld County Health Department for review and approval. The fly control plan shall be implemented at the request of the Weld County Health Department in the event that flies (which can be determined to be associated with the facility) are in such a number to be considered a nuisance condition. The plan shall also be implemented in the event the Weld County Health Department receives a significant number of fly (associated with facility) complaints and in the judgement of the Health Officer, there exists a fly condition requiring abatement. 13.The facility shall be operated in a manner which controls odor. Odors detected off - site shall not equal or exceed the level of fifteen -to -one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. An odor abatement plan shall be submitted to the Weld County Health Department for review and approval. The odor abatement plan shall be implemented at the request of the Weld County Health Department in the event odor levels detected off -site of the facility meet or exceed the level of fifteen -to -one dilution threshold or in the judgement to the Weld County Health Officer there exists an odor condition requiring abatement. 14. In the event any waste water generated from the poultry operation will be disposed in any existing septic system, that system shall be reviewed by a Registered Professional Engineer. The review shall consist of visible observation of the system and an evaluation of the system's ability to handle any additional proposed hydraulic loads. If the system is not adequate it shall be enlarged in accordance with the Weld County I.S.D.S. Access: The applicant has proposed a new business access to the rear of the lot to accommodate the greenhouse/poultry facility. I could support this additional access separating the residential from the business accesses if the applicant would close the southern circle drive access. The circle drive appears to be used seldom. If the applicant chooses not to close the circle drive, the existing access will be utilized to access the rear of the property, with no additional accesses granted. 2. Identify on the Mylar: The applicant needs to identify on the mylar additional parking for delivery trucks, employees, and patriots. 3. Access Road: The access road should be at least 18 feet wide to accommodate two-way traffic. This should be a graded, drained, and an all-weather type access road. 4. Storm Water Drainage: The Weld County Health Department should comment on this site because of the animal units and composting facility proposed.
