RESOLUTION RE: APPROVE MINOR RESUBDIVISION FOR THE VACATION OF ROAD RIGHT-OF- WAY ON COMPO WAY -WELD COUNTY DEPARTMENT OF PLANNING SERVICES 50g WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 24th day of March, 1999, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Weld County Department of Planning Services, 1400 North 17th Avenue, Greeley, Colorado 80631, for a Minor Resubdivision for the vacation of road right-of- way on Compo Way on the following described real estate, to-wit: That portion of Compo Way south of Compo Road to the southern boundary of Dos Rios Estates, a subdivision located in Section 34, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado, as shown on the Dos Rios Estates plat recorded with the Weld County Clerk and Recorder on February 24, 1964 at Book 508, Reception 1429743 WHEREAS, Scott Ballstadt, Planner, represented said applicant, and WHEREAS, Section 8.2 of the Weld County Subdivision Ordinance provides standards for review of said Minor Resubdivision for the vacation of road right-of-way on Compo Way, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 8.2.5.1 of the Weld County Subdivision Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 8.2 of the Weld County Subdivision Ordinance including specifically: a. Section 8.2.1 -- There is right-of-way shown on the approved plat for Dos Rios Estates which has not been used for its intended purpose since the recording of the approved plat. The approved plat for Dos Rios Estates was recorded on February 24, 1964. b. Section 8.2.4 —The Weld County Utilities Coordinating Advisory Committee has reviewed the proposed vacation and recommends that a ten (10) foot utility easement be reserved along the southern and western lines of Compo Way which would allow the existing utility easements along the southern line of Lot 8 and the western line of Lot 11 to continue and connect. The Committee also recommends that the Department of Planning Services contact the owners of the 3.7 acre parcel west of and adjacent to the proposed vacation of Compo Way and express the Committee's interest in also extending the ten (10) foot utility easement along the southern line of such parcel. The Department of Planning Services has sent a letter to the owners, Mr. and Mrs. Guthrie, requesting such utility easement extension. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Weld County Department of Planning Services for a Minor Resubdivision for the vacation of road right-of-way on Compo Way on the hereinabove described parcel of land be, and hereby is, granted. Scott Ballstadt, Department of Planning, explained that Compo Way was originally intended to connect Compo Road with WCR 396, and since it was impractical to build the road where it was platted, there was never any construction. Residents of the western portion of Dos Rios have been using a ditch riders road for many years, and in 1997, a storm washed out Cornpo Road There is currently a 10-foot utility easement along the back side of the lots, but does not extend into the right-of-way. Don Carroll asked if anyone was aware of anything in the easement currently. Cody Wooldridge said their water line stops before the road, but did ask that an easement be extended for future use. Scott said he was not sure if they could ask for an easement on the adjacent property since it was not a part of Dos Rios, but did not believe the owner would have a problem. Don said his only concern is if Joyce Alleley, property owner, developed the property, and Cody said they had been contacted already on development. Cody also noted that when the original plat was done, there was only a 10-foot easement instead of the 15-foot easement, and did not know if they could make any change with the required 15-foot easement. Cody Wooldridge moved to continue the existing easement on the south end across Compo Way and also a 10-foot easement down the west edge of Compo Way, and highly recommend that it is noted on the plat map that before anything can be done with Parcel A, a 10-foot easement needs to be continued across the southern west half. Compo Way was originally intended to connect Compo Road with WCR 396. It was impractical to build a road over the terrain where Compo Way was platted. Therefore, nothing had been constructed since 1964. Residents of the western portion of Dos Rios Estates had been using a ditch riders road for many years to travel west out of Dos Rios Estates to access WCR 396. In 1997 a major thunder storm washed out Compo Road leaving the residents of western Dos Rios Estates with the ditch rider's road as their only access, which was unacceptable to them. In the fall of 1997 the Commissioners agreed to construct the extension of Compo Road to the west and connect it to WCR 396 if the land owner (Joyce Allely, who's husband was the original subdivider) would dedicate the right-of-way to the County at no cost. An agreement was reached, the right-of-way was dedicated, and in the spring of 1998 the road was built. There is no longer any need for the Compo Way right-of-way. This application proposes to vacate that portion of Compo Way south of Compo Road to the southern boundary of Dos Rios Estates, a subdivision located in Section 34, Township 5 North, Range 66 West of the 6th P.M., Weld County Colorado, as shown on the Dos Rios Estates plat recorded with the Weld County Clerk and Recorder on February 24, 1964 at Book 508, Reception 1429743. Reason for Vacation: Campo Way was originally intended to connect Campo Road with WCR 396. It was impractical to build a road over the terrain where Campo Way was platted. Therefore, nothing had been constructed since 1964. Residents of the western portion of Dos Rios Estates had been using a ditch riders road for many years to travel west out of Dos Rios Estates to access WCR 396. In 1997 a major thunder storm washed out Campo Road leaving the residents of western Dos Rios Estates with the ditch rider' s road as their only access, which was unacceptable to them. In the fall of 1997 the Commissioners agreed to construct the extension of Campo Road to the west and connect it to WCR 396 if the land owner (Joyce Allely, who's husband was the original subdivider) would dedicate the right-of-way to the County at no cost. An agreement was reached, the right-of-way was dedicated, and in the spring of 1998 the road was built. There is no longer any need for the Campo Way right-of-way. The petitioner: In paragraph 8 .2 .2 the land owner of the parcels on both sides has written a letter to Monica requesting the vacation. I don't have a copy of the letter. It should be in your file (I hope) . Utilities : There is a Statute that provides for utilities located in rights-of-way that are vacated. It would probably be a good idea to mention it.
