A public hearing was conducted on June 4, 1997, at 10:00 a.m., with the following present: Commissioner George E. Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges The following business was transacted: I hereby certify that pursuant to a notice dated April 28, 1997, and duly published May 1, 1997, in the South Weld Sun, a public hearing was conducted to consider the request of Zeek Properties, Ltd., c/o Landmark Engineering, Ltd., for a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S #422, for redesign of Rademacher Business Park PUD (26 lots). Lee Morrison, Assistant County Attorney, made this a matter of record. Todd Hodges, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He explained the history of the property entails a Change of Zone to Commercial/Industrial and a Final Plan in 1984, and this request will redesign the business park and add two lots. Mr. Hodges further explained a ditch is being constructed, roads are being redesigned, and a cul-de-sac and two lots are being added. He stated open space will be gained and noted this property is adjacent to the MUD Area. He said the dedication of Weld County Road 9.5 has been attained for the future four - lane, in which the applicant has been very cooperative. Mr. Hodges explained Lot 10 was sold and is being used for a residence; however, that will change when the property is developed, to which the property owner has consented. He confirmed most Conditions of Approval have already been met and the applicant is diligently working with the State. Mr. Hodges stated the Board will not review the improvements agreement at this time. Don Leffler, Landmark Engineering, Ltd., represented the applicant and reiterated he has been working with staff, the State of Colorado Geological Society, and CDOT (Colorado Department of Transportation) to meet all Conditions of Approval. He stated the improvements to the business park will greatly enhance the area, and the drainage ditch has already helped. Responding to questions from the Board, Mr. Leffler confirmed 971063 - e : PL PL0381 HEARING CERTIFICATION - ZEEK PROPERTIES, LTD., C/O LANDMARK ENGINEERING, LTD. (S #422) PAGE 2 he has had no problems with the Mountain View Fire Protection District, to which he has supplied all necessary information. Mr. Hodges stated the District indicated no conflict; however, this is the first time he has seen such a referral from said District. He noted issues may occur during the Site Plan Review process; therefore, Commissioner Kirkmeyer's suggestion to add the words "attempt to" before the word "comply" in Condition of Approval #2.G. may be appropriate. Responding to further questions of the Board, Mr. Leffler addressed the access off Weld County Road 9.5 to Lot 10 and explained as long as the grandfathered use is maintained, the access will be maintained. He explained, however, that once the use is changed, the access will be removed. Mr. Leffler agreed to all Conditions of Approval, and no public testimony was offered concerning this matter. Mr. Hodges clarified for Commissioner Kirkmeyer that Condition of Approval #2.S. addresses the access to Lot 10 as a note on the plat. Commissioner Kirkmeyer then moved to approve the request of Zeek Properties, Ltd., c/o Landmark Engineering, Ltd., for a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S #422, for redesign of Rademacher Business Park PUD (26 lots), based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record, including the addition of the words "attempt to" after "shall" and before "comply" in Condition of Approval #2.G. The motion was seconded by Commissioner Hall, and it carried unanimously.
