HomeMy WebLinkAbout992930.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO DECEMBER 13, 1999 TAPE #99-39 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, December 13, 1999, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County Commissioners meeting of December 8, 1999, as printed. Commissioner Geile seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Baxter moved to approve the Certification of Hearings conducted on December 8, 1999,as follows: 1)A Site Specific Development Plan and Final Plan, S#496- John and James Sutter; 2) A Site Specific Development Plan and Special Review Permit #1244 for a Kennel - Patricia Healy; and 3) A Site Specific Development Plan and Final Plan, S #505 - Leslie and Jeanne Gelvin. Commissioner Vaad seconded the motion, which carried unanimously. ADDITIONS TO AGENDA: The following was added to the Agenda: READ ORDINANCE BY TAPE: 1) Read Emergency Ordinance#213 by tape; and 2) Read Emergency Ordinance #214 by tape CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the consent agenda as printed. Commissioner Vaad seconded the motion, and it carried unanimously. PRESENTATIONS: 1999 EMPLOYEE SERVICES AWARDS-10 AND 20 YEAR EMPLOYEES:The Board of Commissioners presented pins to employees for ten and twenty years of service with the County. (Clerk's Note: Switched to Tape #99-40.) z. p�" 2 _ 992930 r- �f"�`` ` BC0016 PUBLIC INPUT:John Folsom,Weld County resident, referred to an article from the Rocky Mountain News and proposed there be a minimal sales tax to benefit the poor areas of Weld County and assist in promoting open space. Mr. Folsom stated other entities have approved a similar sales tax to purchase open space and conservation easements. He stated although some property owners have donated land for agricultural conservation easements,that may not be possible for other land owners. Chair Hall stated this idea will be considered in Milliken on Tuesday, December 14, 1999. WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $1,918,389.50 Commissioner Kirkmeyer moved to approve the warrants as presented by Mr. Warden. Commissioner Baxter seconded the motion, which carried unanimously. READ ORDINANCE BY TAPE: READ EMERGENCY ORDINANCE #213 BY TAPE: Commissioner Vaad moved to read Emergency Ordinance #213 by tape. Commissioner Kirkmeyer seconded the motion, which carried unanimously. READ EMERGENCY ORDINANCE #214 BY TAPE: Commissioner Vaad moved to read Emergency Ordinance #214 by tape. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. NEW BUSINESS: CONSIDER CONTRACT FOR LONG TERM CARE OMBUDSMAN ADVOCATE/FRIENDLY VISITOR PROGRAM AND AUTHORIZE CHAIR TO SIGN:Walt Speckman, Director of Human Services, stated this grant in the amount of $8,5000, will be used for regular visitation by the ombudsman at personal care boarding homes, complaint investigation, and training for aides working in these facilities. Commissioner Geile moved to approve said contract and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. CONSIDER CONTRACT FOR VICTIM WITNESS PROGRAM AND AUTHORIZE CHAIR TO SIGN: Gary Rathke, District Attorney's Office, stated the VALE Grant Application was approved as submitted and this contract will provide$62,292.00 in funding. Commissioner Kirkmeyer moved to approve said contract and authorize the Chair to sign. Seconded by Commissioner Vaad, the motion carried unanimously. CONSIDER VOCA ASSISTANCE GRANT AWARD FOR DOMESTIC VIOLENCE AND SPECIAL POPULATIONS LIAISON PROJECT AND AUTHORIZE CHAIR TO SIGN: Commissioner Baxter moved to approve said grant award and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. CONSIDER TEMPORARY ROAD CLOSURES- WCR 39 BETWEEN WCRS 74 AND 76; AND WCR 51 BETWEEN WCRS 76 AND 80: Commissioner Kirkmeyer moved to approve said closures. Commissioner Vaad seconded the motion, which carried unanimously. CONSIDER AGREEMENT FOR SERVICES AND AUTHORIZE CHAIR TO SIGN-COUNTY TECHNICAL SERVICES, INC.: Mr. Warden stated this agreement will allow for a third party to deal with property, casualty, and workers comp claims for Weld County. He stated the agreement amount is 35 percent less than the original quote. Commissioner Baxter moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Geile, the motion carried unanimously. Minutes, December 13, 1999 992930 Page 2 BC0016 CONSIDER ENERGY IMPACT ASSISTANCE GRANT CONTRACT FOR 800 MHZ RADIO SYSTEM AND AUTHORIZE CHAIR TO SIGN: Mr. Warden stated the three phases for installing this project will cost approximately$2 million and it will be completed on or before April 30, 2003. Commissioner Geile moved to approve said contract and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. FINAL READING OF ORDINANCE #82-U, IN THE MATTER OF SETTING FEES FOR SERVICES PROVIDED BY THE WELD COUNTY HEALTH DEPARTMENT: Commissioner Baxter moved to read Ordinance#82-U by title only. Commissioner Kirkmeyer seconded the motion,which carried unanimously. Bruce Barker, County Attorney, read said title into the record. Mr. Warden stated this is to set annual County fees, many of which are mandated by State fees. No publictestimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve Ordinance #82-U on final reading. Seconded by Commissioner Vaad, the motion carried unanimously. FINAL READING OF ORDINANCE #84-V, IN THE MATTER OF SETTING FEES FOR SERVICES PROVIDED BY WELD COUNTY: Commissioner Kirkmeyer moved to read Ordinance#84-V by title only. Commissioner Baxter seconded the motion. Mr. Barker read said title into the record. Mr. Warden stated the change to Exhibit D has been reviewed and it corresponds with the 2000 Budget. No public testimony was offered concerning this matter. Commissioner Baxter moved to approve Ordinance#84-V on final reading. Seconded by Commissioner Geile, the motion carried unanimously. FINAL READING OF ORDINANCE #136-N, IN THE MATTER OF SETTING THE AMOUNT OF PURCHASES WHICH MUST BE WRITTEN SEALED BIDS WITH A TEN-DAY PERIOD FOR CONSIDERATION: Commissioner Kirkmeyer moved to read Ordinance#136-N by title only. Seconded by Commissioner Geile, the motion carried unanimously. Mr. Barker read said title into the record. Mr. Warden stated the Home Rule Charter requires the Board to determine the minimum amount which requires a written sealed bid with a ten-day consideration period. Mr. Warden recommended leaving the amount at $7,500, which has worked well in the past. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve Ordinance#136-N on final reading. Commissioner Vaad seconded the motion, which carried unanimously. PLANNING: CONSIDER REVISION TO RECORDED EXEMPTION #2494 - TOMM OWENS: Julie Chester, Department of Planning Services, indicated the current location of Lot A, as well as the proposed location. She stated Recorded Exemption #2494 was approved by the Board on August 9, 1999, which requires this request to come back before the Board. Ms. Chester stated the plat has not been recorded; staff had originally proposed Lot A be located in the southwest corner, as now requested; and the proposed lot will be accessed from Weld County Road 66. In response to Commissioner Kirkmeyer, Ms. Chester stated the Conditions of Approval for Recorded Exemption#2494 do not require the applicant to eliminate any of the existing accesses; however, Condition C requires a joint access from Weld County Road 66 north to Lot A. Tomm Owens, applicant, stated currently there are three accesses on Weld County Road 66. He stated staff did recommend that Lot A be located in the southwest corner; however, he felt it would be better to locate it where the old homestead exists. Mr. Owens explained since that time, the property line has been adjusted and the joint easement now encroaches on the neighbor's property. In response to Chair Hall, Mr. Owens stated he has no objection to closing the middle access. Commissioner Kirkmeyer moved to approve said request to change the location of Lot A of Recorded Exemption #2494, with Conditions allowing for only one legal access per lot. Commissioner Baxter seconded the motion, which carried unanimously. Minutes, December 13, 1999 992930 Page 3 BC0016 CONSIDER REQUEST TO PRE-ADVERTISE USE BY SPECIAL REVIEW PERMIT#1251 -WEAKLAND: Pat Weakland, applicant, stated this application is for a garden center which will need to be running by April or May and pre-advertisement will allow additional time to process the application and hopefully open the business for the spring season. Commissioner Kirkmeyer moved to approve the request for pre- advertisement of Use by Special Review Permit#1251 for Pat and Amanda Weakland, and to set the hearing date for January 26, 1999 at 10:00 a.m. Seconded by Commissioner Geile, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. Ordinances#82-U,#84-V,#136-N were approved on final reading, and Ordinance#213 and#214 were approved on an emergency basis during the Final Budget Hearing. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
