OCT 1 01997 This Department has finished reviewing the sand and gravel mining case you have forwarded to this Department for comment. The proposed gravel mine is located north of Baseline Road and east of WCR 23 1/2. In that same general area, south of Baseline Road and east of Tucson St., Adams County permitted a mine, operated at this time by Hall -Irwin Company, named Tucson Pit, Adams County Case Number 11- 92-C. In deference to citizen sensitivities regarding ground water levels and damages to ground water wells from gravel mines, Adams County's Board of County Commissioners made the permit for the Tucson Pit conditional upon the pit owner providing a signed well protection agreement with well users surrounding the mine. That legally binding well protection agreement included several residents and agri-businesses in Weld County. Hall -Irwin Company has worked with the signatories of the well agreement and, for the most part, has instituted mitigation procedures for well damages. This Department asks Weld County to insure ground water levels, well protection, and water delivery for surrounding well users are protected with procedures to mitigate damages. We suggest that the procedures be in place prior to the start of mining. The application report for this mine does not include a traffic study. Adams County's Public Works Department has indicated that if the haul route chosen for this mine is 168th Ave. (Baseline Road) from WCR 23 1/2 to Highway 85, that it be specified in the permit that no other roads in Adams County be used as haul routes. Specifically, Tucson St., between 168th St. and Highway 7 is not to be used as a haul route. Public Works Department requests a pavement analysis be done to 168th Ave. and that Hall -Irwin demonstrate that their truck traffic will not damage 168th Ave. They suggest that conditions to the Weld County mining permit place Hall -Irwin Construction Company directly responsible for the maintenance of 168th Ave., throughout the life of the mine. Also, 168th Ave. should be overlaid from WCR 23 1/2 to Highway 85 prior to a mining permit being issued by Weld County. BOARD OF COUNTY COMMISSIONERS ELAINE T. COLORADO MEMORANDUM TO: Shani Eastin, Current Planner DATE: October 2, 1997 FROM: Don Carroll, Project Administrator W� SUBJECT: USR-1172; Hall -Irwin Construction Company (Sand and Gravel Mining Operation) The Weld County Public Works Department has reviewed this proposal; the following requirements are recommended to be a part of any approval: COMMENTS: The applicant is indicating that the access from WCR 2 (168th Ave.) will be paved with a 24 -inch CMP culvert to carry storm water. WCR 2 (168th Ave.), at this location, falls under the jurisdiction of Adams County for maintenance. Please contact Adams County for concerns on a designated haul route or possible road improvement agreements. REQUIREMENTS: WCR 2 (168th Ave.) is designated on the Transportation Plan Map as an arterial status road that would require a future right-of-way of 100 feet. The applicant needs to dedicate an additional 20 feet of right-of-way for future expansion through their facility. The existing right-of-way at this location is 60 feet. Acceleration and deceleration lanes will be required at the access point to accommodate asphalt/concrete plants, shops, etc. This needs to be identified and placed on the plat. Setbacks for mining/reclamation should be dimensioned from future rights -of -way. The standard typical setback would be 25 feet from the property line for mining operations. There will be no heavy hauling permitted on WCR 23'/2 adjacent to the proposed gravel operation. Environmental Protection Services has reviewed this proposal; the following conditions are recommended to be part of any approval: 1) All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2) No permanent disposal of wastes shall be permitted a this site. 3) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4) Fugitive dust shall be controlled on this site. 5) The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A), as measured according to 25-12-102, Colorado Revised Statutes. 6) A NPDES Permit shall be obtained from the Water Quality Control Division of the Colorado Department of Health for any proposed discharge into State Waterways. 7) The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 8) An Air Pollution Emission Notice and emission permit shall be obtained from the Air Pollution Control Division of the Colorado Department of Public Health for emissions from the mining operations. The site shall operate in accordance with all applicable rules and regulations of the Air Pollution Control Division. 9) The operator shall submit a dust abatement plan for approval to both the W.C. Planning Department and the W.C. Health Department. 10) No permanent structures are proposed for this site. Portable toilets may be utilized on sites which are temporary locations of the working face and portable processing equipment, etc. for up to six months at each location. 11) Drinking water shall be supplied at the aggregate processing plants by delivered bottled water. 12) The facility must comply with the rules and regulations of the Colorado Division of Minerals and Geology.
