RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST ROBERT LEE MOSHER FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Robert Lee Mosher, VI #9600069, is allegedly in violation of the Weld
County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of August, 1996, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Robert Lee Mosher, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to delay referral of
said violation to the Weld County Attorney's Office for a period of one (1) year to allow
adequate time for the property owner to bring the subject property into compliance and for an
inspection of the property by the Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individual without further Board action if the subject property is not brought into
compliance within one (1) year.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that if said violation still exists on August 13, 1997, the Weld County
Attorney be, and hereby is, authorized to proceed with legal action against Robert Lee Mosher
to remedy the violation of the Weld County Zoning Ordinance, and any other persons occupying
the properties, any persons claiming an interest in the properties, and any persons acting in
active concert with the identified parties.

July 23, 1996 Property inspected by Julie Chester. The property is not in compliance. Did
not go onto the property as per Mr. Mosher, but observed from WCR 19.
July 23, 1996 Letter sent to the property owners indicating that they were scheduled for a
meeting with the Board of County Commissioners.
The noncommercial junkyard is still located on the property, therefore is a violation of Sections
31.2 and 31.3.9 of the Weld County Zoning Ordinance. To bring the property into compliance
the noncommercial junkyard must be removed from the property or screened from all adjacent
properties and public rights of way.
The Department of Planning Services also recommends that the County Attorney authorize
legal action against any other persons occupying the properties,any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties.

The property referenced above remains in violation of the Weld County Zoning Ordinance. I
have scheduled a meeting with the Board of County Commissioners on August 13, 1996 at
2:00 p.m. to consider the Zoning Violations occurring on the property. This meeting will take
place in the County Commissioners'Hearing Room, first floor, Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the
violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation, the

The uses on the above described property are being considered as a zoning violation of Section 31.2 and
31.3.9 of the Weld County Zoning Ordinance. This is not a use allowed by right in the Agricultural zone
district.
The violation can be corrected by removing the non-commercial junkyard from the property or totally
screening the non-commercial junkyard from all adjacent properties and public rights of way. If
screening is to be used to conceal the non-commercial junkyard, a detailed screening plan must be
submitted to and approved by the Department of Planning Service's staff prior to installation.
Itis the intention of this office to assist and cooperate with you without imposing undue hardships;
however,we have no discretion in this matter if you fail to correct this violation.You have 30(Thirty)
days from May 21, 1996 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.

BE IT RESOLVED, by the Board of County Commissioners of Weld County,
Colorado, that it does hereby approve the dedication of the perpetual rights-
of-way over the public roads, streets, highways and easements in behalf of the
public in Black Hollow Acres, First Filing, being a subdivision located in the
East Half (Et) of Section 33, Township 8 North, Range 67 West of the 6th P. M. ,
Weld County, Colorado, more particularly described as follows:
Beginning at the NE corner of said Section 33 and considering the

Governor Romer has asked me to respond to your letter regardin3
conditions on Weld County Road 88 .
The state, unfortunately, has no legal jurisdiction over count/
roads . Decisions regarding county roads are entirely the
responsibility of the county commissioners . I see that you have
contacted the Weld County Commissioners in the past, but 2 urge
you to do so again .
Specifically, you should contact the Chairman of the Weld County
Commission, Mr . Bill Webster . You also may wish to contact the
Transportation Director for Weld County, Mr . George Cicoff . You
may write to both at 915 10th Street , Greeley, CO 80632 .
I hope they might be able to find some solution.

Dear Mrs . Mosher:
In response to your April 19, 1994 letter regarding construction and
maintenance of WCR 88 west of WCR 19 for one-half mile, we regretfully must
advise that this section of road has never been on the Weld County road system.
Before this road segment could be added to our system, the following conditions
must be met:
1. The road has to have been surveyed.
2. The width of the road cannot be less that twenty (20) feet wide.
3. Approximately two (2) inches of crushed rock has to have been put
down; or if necessary, some pit run gravel would have to have been
put on the road as a base material, not to exceed four (4) inches.
4. The road has to have been built up with good shoulders and borrow
ditches need to have been put in for drainage.
5. If there is a drainage problem where water may run across the road,
culverts will have to have been installed.
6. The landowner is responsible for the cost of the upgrade project.
If you can meet these conditions, Weld County will accept the road and provide
ongoing maintenance. Our office can assist in preparing estimates and
coordinating the project.

Weld County does .not,i-'intain private roads, lanes orb "iveways.
Before a public road can be accepted by the Board of Weld County Commissioners
for maintenance, the road must meet the following minimum conditions:
1. The road shall be surveyed to determine right-of-way lines.
2 . The width of the right-of-way cannot be less than thirty (30) feet wide.
The road shall serve a minimum of three legal lots, two of which must have
taxable improvements. Properties abutting the intersection of the road
under consideration for acceptance and an existing publicly maintained road
do not count toward the required three lots .
3 . The minimum road width shall be 18 ft. or meet the minimum residential
guidelines for anticipated traffic. (See Figure 1)
4. The road must be adequately graded and drained.
5 . A minimum of two inches of crushed rock must be provided on the traveled
surface, or if necessary, additional material may be required to support
anticipated traffic loads.
6. The road cannot be fenced or gated, but if there are cattle in the area, a
