RESOLUTION
RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF WELD
COUNTY RIGHT-OF-WAY FOR WELD COUNTY ROAD 24.5
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Road Petition from Eagle C aw
Fishing Ecucation Center, cm Jan Hardy, President, 3525 Highway 119, Longmont, Colorado
80504, a copy of which is attached hereto and included by reference, requesting vacation of a
portion of Weld County Road 24.5 for approximately 870 feet west of the 1-25 right-of-way
being more: fully described as follows
The 60-foot wide public road right-of-way located in
the EY2 of Section 3, Township 2 North, Range 68
West of the 6th P M., Weld County, Colorado
WHEREAS, the County Attorney's Office and Public Works Department have
recommerded approval of said request since that portion of Weld County Road 24.5 is not
needed for the safety and welfare of the traveling public, and
WHEREAS, the adjoining landowners were mailed ten days notice by the Clerk to the
Board of a public hearing set for September 20. 1999, to consider the vacation of that portion of
Weld County Road 24.5 which is described above, and
WHEREAS, any persons owning dedicated and recorded easements and rights-of-way
for the use of the right-of-way to be vacated may continue such use after formal vacation by
Weld County and
WHEREAS, the Board of County Commissioners heard testimony and reviewed all other
evidence presented therein by staff and the public, and
WHEREAS, the evidence showed that the vacation of that portion of Weld County
Road 24.5 which is described above will not leave any land adjoining the roadway without an
established public road or private access easement connecting the land with another
established public road and
WHEREAS. the Board of County Commissioners deems it advisable to vacate said
portion of Weld County Road 24 5, with said vacation to become effective upon recording as
required below.
NOW, THEREFORE. BE IT RESOLVED by the Board of County Commissioners cf
Weld County, Colorado, that the Road Petition from Eagle Claw Fishing Education Center /c:
Jan Hardy President, be and hereby is, accepted.

As we discussed by phone, enclosed is the completed and signed Road Petition
to abandon the parcel of road which dead-ends into I-25 and is located between
the Colorado State Parks Barbour Ponds area and the Rademacher Family I rust
property which they have donated to the Eagle Claw Fishing Education Center
(see c.'py of our letter dated January 4).
Please let me know if you need arty additional information and when we might
be able to accomplish this task. Thank you for your help!

Dear Weld County Commissioners:
As you are aware, the Eagle Claw Fishing Education Center has been gifted a
generous donation of 7 acres of land in southern Weld County, across from
Barbour Ponds on I-25. In designing our program for our space, it has come to
our attention that we are in desperate need of the property which is an
abandoned dead-end road located between our property and Barbour Ponds
This road dead-ends into the side of I-25 and is currently blocked off with a „ate

RESOLUTION
RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF WELD ; f
COUNTY RIGHT-OF-WAY FOR WELD COUNTY ROAD 24.5 //
\ WHEREAS, the Board of County Commissioners of Weld County, Color$` purs❑ant to
Col do statute and the Weld County Home Rule Charter, is vested with the' thonty of
admini ring the affairs of Weld County. Colorado. and
WHE1 E S, the Board has been presented with a Road Petitiofi from Eagle Claw
Fishing Education-enter. c/c Jan Hardy. President. 3525 Highway, 119. Longmont, Colorado
80504 a copy of which is attached hereto and included by reference, requesting vacation of a
portion of Weld Cotitnti•Road 24.5 for approximately 870 feet west of the I-25 right-of-way
being more fully desribed as follows

WHEREAS, the County Attorneys Office and Public Works Department have
recommended approval of said request since/that portion of Weld County Road 24.5 is not
needed for the safety and welfare of the tr 'eling public, and
WHEREAS, the adjo ning land ners were mailed ten days notice by the ClerK to the
Board of a public hearing set for Sep mber 20, 1999, to consider the vacation of that portion of
Weld County Road 24.5 which is d, / crihed above, and
WHEREAS, any perso `owning dedicated and recorded easements and rights-ofwa,
for the use of the right-of-way, be vacated may continue such use after formal vacation by
Weld County. and ,

of County Commissioners heard testimony and reviewed al other
evidence presented th ein by staft and the public, and
WHEREAS • e evidence showed that the vacation of that portion of Weld County
Road 24.5 which - described above will not leave any land adjoining the roadway without an
established pub[ road or private access easement connecting the land with another
established pu is road. and
Wht EAS. the Board of County Commissioners deems it adv ble to vacate said]
portion of t eld County Road 24 5, with said vacation to become effects upon recording as

OW, THEREFORE. BE IT RESOLVED by the Board of County Commissioners of
Weld ounty. Colorado, that the Road Petition from Eagle Claw Fishing Education Center -'c
Jan Hardy President, be, and hereby is accepted
BE IT FURTHER RESOLVED by the Board that the portion of Weld County right-of-way
which is described above be and hereby is. vacated
