The meeting was called to order by the Chairman, Richard Kimmel. Also present: Pat Persichino, Director; Monica Daniels -Mika, Long Range Planner; Shani Eastin, Current Planner; Todd Hodges, Current Planner; Keith Schuett, Current Planner II, Department of Planning Services; Trevor Jiricek, Supervisor, Weld County Health Department; Lee Morrison, Assistant County Attorney; Sharyn Frazer, Secretary. CASE NUMBER: Z-494 (Continued from July 6, 1995, regular scheduled meeting). APPLICANT: John and James Martin REQUEST: A Change of Zone from A (Agricultural) to E (Estate). LEGAL DESCRIPTION: The SE4 NW4 and SW4 of Section 12, T1 N, R66W of the 6th P.M., Weld County, Colorado. LOCATION: North of and adjacent to Weld County Road 10; approximately 1/2 mile west of Weld County Road 37. Gloria Dunn, requested the case be continued until Thursday, September 7, 1995, to allow referral agencies time to respond to additional information submitted to the Department of Planning Services. CASE NUMBER: USR-1088 APPLICANT: Northern Colorado Water Conservancy District REQUEST: A Site Specific Development Plan and Special Review permit for a Major Facility of a Public Utility for a water pipeline in the A (Agricultural) zone district. LEGAL DESCRIPTION: Located in various portions of T2 and 3N, R66, 67, and 68W of the 6th P.M., Weld County, Colorado. LOCATION: Various locations, see application. Todd Hodges, explained this request is for a major facility of a public utility for awater pipeline. president of the District, gave an overview of the communities who would benefit with better water quality due to this project. He introduced various members of his organization. They explained pipeline diameters, capacities, and easement requirements. Marie Koolstra was concerned about where the water would come from and if any existing agricultural areas would suffer. It was explained that the Big Thompson and Windy Gap Reservoirs would supply the pipeline and there would be no guarantee that agricultural land might not be affected, there were no projections to date. Windy Gap Reservoir has not been used to capacity to date, the excess flows into the Colorado River. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Curt Moore moved Case Number USR-1088, be approved based on the Department of Planning Services recommendation. Ron Sommer seconded the motion. Motion carried unanimously. y51755 vps 00106 CASE NUMBER: USR-1087 APPLICANT: Boyd and Allison Meyer REQUEST: Retail sale of buffalo meat and other buffalo oriented products in the A (Agricultural) zone district. LEGAL DESCRIPTION: Part of the NE4 NW4 of Section 24, T6N, R67W of the 6th P.M., Weld County, Colorado. LOCATION: South of and adjacent to State Highway 392; approximately 1/2 mile west of Weld County Road 25. Shani Eastin gave the location for the request (near Willow Springs Subdivision) off of Highway 392. She gave an overview that includes the consumption of buffalo meat and related items, including the sale of t -shirts, caps, etc. She explained the referrals received from the City of Greeley and the Town of Windsor and the process with which they review applications. The Department of Planning Services is recommending approval of this application. Vern Nelson, Nelson Engineers explained that the size of the site would have to be increased to one acre per Weld County Health Department requirements. They have no conflicts with any referral agencies requirements. Boyd Meyer, applicant, stated he had received positive responses from surrounding property owners. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Ron Sommer moved Case Number USR-1087, Boyd and Allison Meyer, be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval. CASE NUMBER: USR-1089 APPLICANT: Prima Oil and Gas REQUEST: A Site Specific Development Plan and a Special Review permit for oil and gas production facilities in the R-1 (Low Density Residential) and 1-2 (Industrial) zone districts. LEGAL DESCRIPTION: The W2 NW4 of Section 4, T5N, R65W of the 6th P.M., Weld County, Colorado. LOCATION: East of and adjacent to 1st Avenue; north of and south of and adjacent to Bliss Road. Shani Eastin, explained there will be two well heads and a tank battery at this location. The proposal is consistent with the Weld County Comprehensive Plan. There is residential development in the area but none on the proposed site. The site is in the urban growth boundary of the City of Greeley and they recommend approval but they want the County to enforce their oil and gas requirements. She explained that Colorado Oil and Gas Commission requirements cover their concerns and the County follows State requirements. Bill Crews, representative, Prima Oil and Gas, stated he is in agreement with the Department of Planning Services' Development Standards with some clarification of high density residential. He explained that there will be two gates across accesses, he is willing to removed outside valves that vent into the atmosphere, direct possible spillage into the berm, and he agreed if residential development occurs in the future the site would have to be fenced. Discussion followed regarding Development Standard #6 and Conditions of Approval #3. New verbiage was added. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. Mel Hosiko, stated he was not in support or opposition of this proposal, but he was concerned about water wells in the area. Lee Morrison, and Bill Crews explained requirements regarding lining pits. Ron Sommer moved Case Number USR-1089, be forwarded to the Board of County Commissioners with changes to Development Standard #6, and Condition of Approval #3a, b, and c, with the Planning Commission's recommendation for approval. Shirley Camenisch seconded the motion. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. CASE NUMBER: USR-1059 APPLICANT: A-1 Organics REQUEST: A Site Specific Development Plan and a Special Review permit, and a certificate of designation for a composting facility in the A (Agricultural) zone district. LEGAL DESCRIPTION: Part of the W2 SW4 of Section 20, T3N, R67W of the 6th P.M., Weld County, Colorado. LOCATION: Approximately 1t2 mile north of State Highway 66 and one mile east of Weld County Road 17. Keith Schuett, explained he would present both the Special Review permit and the Certificate of Designation at the same time. The Planning Commission members would have to vote on the issues separately. He explained this is a 40 acre site and he had received opposition from surrounding property owners within three miles of the Town of Mead. He also explained the applicant is working with the Department of Transportation regarding their concerns. Bob Yost, President, A-1 Organics gave a 15 minute slide presentation explaining how the facility is operated. He gave an overview that included insect control, odor control, material storage, sludge storage, and the contract they have with the Aurora Dairy. He explained they were informed a permit was required after operation had already started. He explained the subdivision was proposed after the composting facility was already in business and he wants to be a good neighbor but when property owners move to the country they have to deal with operations in the country. He feels the site is much better with this composting operation than when manure was being stockpiled. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. William Solomon, Jake Salazar, David Somerall, Pete Salazar, David Sumrau, Jake Salazar surrounding property owners, stated they were in favor of this project. The site is better now than when raw manure was left. Mark Betchey, Governor's Office of Energy Conservation, said they were not taking a formal position regarding this proposal but they are very much in favor of composting/recycling facilities. Kathryn Will, Karen Wilson, Gary West, William Solomon, Russ Anson, had concerns about odor, flies, stagnant water, mosquito breeding areas around run-off, truck traffic, size of the vehicles. They felt this operation was too intent to be compatible with existing land uses.
