There is no existing structures or improvements on site. Access: The applicant has indicated that there will be one main access point to WCR 46. All other roads within the facility should use the internal road system. The existing ADT county for WCR 46 is 187 vehicles per day taken August 1996. WCR 53, the nearest paved road to the east, has an ADT count of 689 vehicles per day. It was taken April 1996. The applicant has indicated a plan to employ six people to operate the dairy in two shifts. There will be two families living on the site with future plans for two mobile homes. Besides their personal vehicles, there will be a tractor trailer accessing the site every other day to pick up milk, and various other farm trucks to deliver feed. In the past, similar dairy applications have indicated significant traffic generation. The applicant has indicated that there will be cow manure storage on site for short periods of time. Local farmers will be hauling manure away. It will be sold to various landscaping companies. Dust Control: Directly east of the proposed facility, there is a oil and gas pick up station. This facility accommodates tractor trailer traffic. The dust control is maintained from the entrance to WCR 53. We suggest that the applicant be responsible for dust control on WCR 46 in front of the facility to minimize the dust to the dairy herd. Storm Water Drainage: The Weld County Health Department should review all calculations for properly sizing the lagoon system for the facility. We have compiled numerous recommended conditions and standards for this application. We have attempted to simplify our referral by separating the proposed conditions of approval and development standards. The following are recommended to be conditions of approval: 1. Prior to recording the plat: A) The facility shall demonstrate compliance with the Confined Animal Feeding Operation Control (CAFO) Regulation. This shall be demonstrated by submitting a comprehensive manure run-off and process waste water handling plan, for a 1,500 head dairy, to the Weld County Health Department for review and approval. This plan shall include, but not be limited to the following: Demonstration that all manure stockpile areas and waste water collection, conveyance, and retention facilities are adequately constructed and sized to handle a twenty-five year, twenty-four hour storm event. This shall be conducted by a Registered Professional Engineer . (2) Demonstration that any waste water retention structure has been constructed with a lining material which does not exceed a seepage rate of 1/32"/day (1x10-6 cm/sec). This shall be conducted by a Registered Professional engineer. Demonstration that the facility has the ability to manage and/or land apply manure and water at agronomic rates in accordance with the CAFO regulations. (4) Demonstration that adequate measures are in place to prevent any discharges except those which are allowed by the CAFO Regulations. B) A dust abatement plan shall be submitted to the Weld County Health Department for review and approval. The facility shall have sufficient equipment available to implement dust control as required by the Weld County Health Department. C) A fly control plan shall be submitted to the Weld County Health Department for review and approval. D) An odor abatement plan shall be submitted to the Weld County Health Department for review and approval. E) The facility shall demonstrate compliance with Section 47 of the Weld County Zoning Ordinance. The following are recommended to be development standards: 1. Fugitive dust shall be controlled on this site. The facility shall be operated in accordance, at all times, with the approved dust abatement plan. 2. All liquid and solid waste shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of solid wastes, as defined in the regulations pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2), shall be permitted at this site. 4. The facility shall maintain compliance with confined Animal Feeding Operations Control Regulations (5 CCR 1002-19) and, Section 47 of the Weld County Zoning Ordinance, as amended. 5. The maximum permissible noise level shall not exceed the industrial limit of 80 db(A), measured according to Section 25-12-102, C.R.S. 6. Any required NPDES Permit shall be maintained in compliance with the Water Quality Control Division of the Colorado Department of Public Health & Environment. 7. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance, as amended. 970685 Daniels, Marcy USR-1140 Page 3 8. The facility shall not discharge to surface or groundwater with exception to what is allowed by the Confined Animal Feeding Operations Control Regulations. 9. Wastes materials, not specifically addressed by other development standards, shall be handled, stored, and disposed in an manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 10. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The surface beneath the manure storage and composting areas shall be of materials which are protective of State waters. These areas shall be constructed to minimize seepage or percolation of manure contaminated water. In no event shall the facility impact or degrade waters of the State in violation of the Confined Animal Feeding Operation Control Regulation (5 CCR 1002-19). 11. The facility shall be operated in a manner which controls odor. Odors detected off site shall no equal or exceed the level of fifteen -to -one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. The odor abatement plan shall be implemented at the request of the Weld County Health Department in the event odor levels detected off site of the facility meet or exceed the level of fifteen -to -one dilution threshold, or in the judgement of the Weld County Health Officer, there exists an odor condition requiring abatement. 12. The facility shall maintain records on -site, available for inspection during business hours, at all times, which demonstrates the following: A. That the waste water collection and storage facilities are adequately constructed, and sized to handle a 25 year 24 hour storm event. B. The manner in which manure will be removed and applied to land. This should also include any agreements between the facility and other parties concerning the removal of manure off -site for land application, treatment or disposal. C. The method in which waste water and/or manure will be applied to land, including the procedure which will be used to insure that agronomic rates are not exceeded. D. The liner for all process waste water retention structures has been constructed of low permeability materials so as not to exceed a seepage rate of 1/32"/day (1x10-6 cm/sec). 970685 Daniels, Marcy USR-1140 Page 4 13. The facility shall be operated in a manner to control flies. The fly control plan shall be implemented at the request of the Weld County Health Department in the event that flies (which can be determined to be associated with the facility) are in such a number to be considered a nuisance condition. The plan shall also be implemented in the event the Weld County Health Department receives a significant number of fly (associated with facility) complaints, and in the judgement of the Weld County Health Officer, there exists a fly condition requiring abatement. 14. Further, I've made an on -site inspection of the property where the dairy is to be located, and I offer the following comments: The size of the proposed dairy (1500 head) requires it to adhere to the Confined Animal Feeding Regulations. There is adequate area for construction of lagoons to hold process waste water and feedlot runoff, however site material will necessitate the lagoons be lined to meet permeability requirements and the applicant should consult with a qualified individual or business during the construction of the lagoons to insure compliance. The Gilmore Irrigation Ditch borders the applicants property to the east, however with properly constructed lagoons and proper storage of dry manure, there should be little, is any, risk of contamination to this ditch. Though not shown on their plans, it is recommended that a settling pond be constructed to help minimize the amount of sludge accumulation in the lagoons. It is my understanding after talking with the applicant that this is their intention. Though not shown on their plans, animal density should be at or near the recommended range for dry -lot facilities in semi -arid climates (see attachment). Based on my review and observations, and with consideration of the above recommendations, Weld County Extension has no objection to this proposal. Sincerely, Keith R. The district has no objections to this proposal but would like to see several precautions taken. First, the district would like to see grass buffer strips planted along the irrigation ditch to filter runoff. Second, the district would recommend that all manure storage lagoons be lined to prevent seepage. Representatives from the NRCS have been working with Ms. Daniels on the design of the waste management systems for this dairy and are confident that the systems are adequate for the proposal.
