RESOLUTION
RE: APPROVE VACATION OF SPECIAL USE PERMIT#12 - ALEX MARTIN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated November 13, 1968, the Board did approve Special
Use Permit#12 for an Expansion of a Feedlot Operation for Alex Martin, Jr., Box 127, Windsor,
Colorado 80550, on the following described real estate, to-wit:
A parcel of land in the SW% of Section 36,
Township 7 North, Range 67 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, the Board has received a request from the current owners, Paul Lind and
Sons, 9674 Weld County Road 74, Windsor, Colorado 80550, to vacate said Special Use
Permit #12, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Special Use Permit #12 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 28th day of April, A.D., 1999.

SUBJECT: SUP-12 Vacation
The Department of Planning Services is requesting that Special Use Permit#12 be vacated by the
Board of County Commissioners. Paul Lind, the property owner of approximately 135 acres located
at 9674 WCR 74 in Weld County, has asked that SUP-12, which permitted a Cattle Feedlot
operation on the site, be withdrawn to facilitate a Subdivision Exemption used in conjunction with
a Recorded Exemption (SE-760, RE-2449). These applications have been reviewed and approved
by Department of Planning Services' Staff. The specific details of SUP-12, which was approved on
November 13, 1968, are not available or were never specified; the resolution approving the permit
only states that it was not considered a"commercial feeding operation", but Board approval was still
required. The applicant understands that by vacating this permit the property is no longer eligible
for a Cattle Feedlot Operation under the guidelines of SUP-12, and that Agricultural Zone District
standards will apply. Included in this packet are copies of the letter from the applicant making the
request for vacation and the original resolution which approved the Special Use Permit.
