HomeMy WebLinkAbout972494.tiffORDINANCE NO. 191-A IN THE MATTER OF THE REPEAL AND RE-ENACTMENT OF CERTAIN PORTIONS OF ORDINANCE NO. 191, WELD COUNTY MIXED USE DEVELOPMENT PLAN BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has the power and authority, under the Weld County Home Rule Charter and Article 28 of Title 30, CRS, to adopt planning goals and policies for the unincorporated areas of the County of Weld, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, previously adopted Ordinance No. 191, Weld County Mixed Use Development Plan, establishing comprehensive mixed use development regulations for unincorporated areas of the County of Weld, State of Colorado, and WHEREAS, the Weld County Planning Commission has recommended revisions to the Mixed Use Development Plan, and WHEREAS, said revisions include changes to Section 2.7.3, Design Standards, and WHEREAS, the Board of County Commissioners of Weld County hereby finds and determines that there is a need for revision to certain portions of the Mixed Use Development Plan for the County of Weld, to ensure that the Mixed Use Development Standards are consistent with the intent of having urban development standards in the area, this amendment is consistent with existing and future goals, policies, and needs of the County, and this Ordinance is for the benefit of the health, safety, and welfare of the people of Weld County NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that the Weld County Mixed Use Development Plan be, and hereby is, amended to read as follows: 2.7.3 Design Standards. All development within the MUD area shall comply with the Weld County Comprehensive Plan, Zoning, Subdivision and PUD Ordinances, and the Colorado State Highway Access Code 2CCR 601-1. Consistent with the urban -scale development standards in the MUD area, all parking areas for commercial and industrial development shall be paved according to geometric and road structure design standards. 972494 ORD191-A RE: ORDINANCE NO. 191-A PAGE 2 BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. >( The above and foregoing Ordinance Number 191-A was, on motion duly made and seconded, adopted by the following vote on the 26th day of January, A.
