The Weld County Public Works Department has reviewed this proposal, the following requirements are
recommended to be a part of any approval:

COMMENTS:
The Planned Unit Development sketch plan is for seven residential lots on 80 acres and will access from WCR 51.
This is designated on the Transportation Plan Map as a Collector Status road and requires 80 feet of right-of-way
at full build out, there is now 60 feet.
The most current Average Daily Traffic Count on WCR 51 is 362 vehicles in a 24-hour period from May 6 and 7,
1998.
Storm Water Drainage: The drainage pattern on the property that will have additional impervious area does not
have off-site flows entering the site.
The runoff from the seven lots flows into Lindies Lake. The additional impervious area creates a small increase
of runoff into the lake due to the very low density. No storm drainage study will be required.
Traffic Impact Analysis: WCR 51 is a Collector Status road. The applicant has reserved an additional 10 feet of
right-of-way through the PUD section for future build out. Our collector roads are capable of handling a great deal
more traffic and the seven lots would increase the count about 40±trips in a 24-hour period. A 50-foot bus, pickup,
and deceleration lane at the entrance to the PUD will accommodate additional traffic. No traffic study will be
required.
The applicant is indicating that the surface of the road will be 22 feet of asphalt with six inches of base and a 65-foot
cul de sac at the end of each driveway. There should be a typical cross section on the plat identifying width and
depth of asphalt and base, width of shoulder, borrow pit ditches, and right-of-way which meets the County
standards.
REQUIREMENTS:
The applicant should submit a street name to identify the internal road system. If not, the county will assign a road
number to this PUD area. Stop signs will also need to be supplied.
The applicant must reserve an additional 10 feet of right-of-way through the Planned Unit Development section for
future build out of WCR 51.

The Weld County Health Department has conducted a thorough review of this proposal.
According to the submitted materials, based upon the number of proposed lots, this is an
urban scale development in what appears to be a non-urban area. Therefore, this
proposal does not appear to comply with PUD Ordinance No. 197. In the event that your
Department determines that the proposal complies with the PUD Ordinance, we have
prepared the following recommendation.
The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service.
Water will be provided by the North Weld Water District and sewer will be provided by
individual sewage disposal systems. The minimum proposed lot sizes (>3.5 acres) and the
overall density of homes per acreage (1 home per 11.4 acres) meets current Department
policy.
The potential environmental impact plan provided in the application materials and required
in section 6.3.1.2.1 of the PUD Ordinance appears to adequately address all potential
impacts as described in that section. However, we are concerned with the sedimentation
of Lindies Lake during construction of the proposed structures, septic systems, etc. Other
than this item, our staff is not aware of any potential environmental impacts or risks that
this proposed development may pose that may represent an increased environmental
impact or risk in excess of other similar developments. We have addressed potential
sedimentation of the ponds in a standard below.
Our staff observed numerous agricultural type homes in the vicinity of the site. Many of
these homes have livestock that include but may not be limited to cows and horses. It is
our opinion that any future property owner should be made aware that these agricultural
uses exist and that they may be exposed to noise, dust, flies, odors, etc. in excess of the
common urban experience. As a result, we recommend that the "Right to Farm" covenant
be required to be placed on any recorded plat.
In the event that you find the submitted application to comply with the PUD Ordinance, we
recommend that the following conditions be a part of any approval:
1) The applicant shall obtain water service from the North Weld County Water District.

2) Silt fences shall be maintained on the downgradient portion of the site during all
phases of construction on all lots in the development.
3) A Weld County Septic Permit is required for the proposed home septic systems and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. All septic systems shall be installed a minimum of two hundred (200) feet
from Lindies Lake, with the exception of Lot 2 which must lie a minimum of one
hundred fifty (150) feet from Lindies Lake.
4) The applicant indicated that animal units will be addressed in the covenant for Estate
Zoning. The common open space will allow for animals along this area.
5) The open space maintenance shall include removal of manure in a manner that will
prevent nuisance conditions and not allow runoff into Lindies Lake. The manure piles
shall not be allowed to exist or deteriorate to a condition that facilitates excessive
odors, flies, insect pests or pollutant runoff.
Please note: The Weld County Health Department, Environmental Protection Services
recommends alternative strategies regarding water conservation and waste minimization.
Considerations such as xeriscaping, low flow water fixtures, backyard composting and
recycling are a few options available to home owners. We also recommend that
preliminary radon mitigation measures be incorporated in the construction of new homes.
Radon kits are available in our office. Please contact our Department for further
information.

Dear Mr. Ballstadt:
I've reviewed the second submittal on Lindies Lake. With regard to Mr. Hall's Answers
to County Regulations,
• The potential for water pollution(6.3.1.2.1.7) is supposed to decrease, due to the
reduced use of pesticides and fertilizers. However, it appears herbicide use will
increase (6.3.1.2.1.1.5)with spring and fall weed spraying.
• Wetlands will be disturbed very little (6.3.1.2.1.8),but there is no mention of a survey
to delineate the wetlands. This should be performed before any lots are sold.
• The lots are large enough to use on site systems and soils reports indicate that on site
systems will work (6.3.3.2.2). No percolation tests were included in either of my
submittals and there was no subsurface investigation to determine depth to
groundwater. Onsite ISDS may need to be engineered.
None of the comments raised in my May 12 letter was addressed. I am concerned that
the lots may be sold with new owners unaware that they may face problems with shallow
groundwater, problem soils, and construction that requires wetlands permits. At this
time, CGS cannot recommend approval of the site. Please call me if there are any
questions.

Dear Mr. Ballstadt:
In response to your request and in accordance with Senate Bill 35 (1972) I visited this
property to review the plat. A Geologic and Mineral Evaluation prepared by Foundation
& Soils Engineering(March 1998)was included in the referral. The site is composed of
cultivated fields (the southern part of lot 2 and to the south) and vacant land in lot 1 and
the remainder of lot 2.
1) Wetlands. Lot 1 contains a wetlands area that should be delineated on the plat after a
wetlands survey is performed by qualified personnel. Any modification to wetlands areas
is subject to Army Corps of Engineers evaluation and approval.
2) Soil. Much of the soil on Lot 1 and the northern part of Lot 2 is soft and probably has
a high organic content. This characteristic is associated with a tendency toward long
term consolidation and subsequent building settlement. For this reason, it is imperative
that the building envelope for this lot be drilled and samples be collected for geotechnical
analysis. Locations where organic soils are found should be abandoned or the soils
should be totally excavated and replaced with a structural fill.
The soil on the remaining part of lot 2 and lots 3 through 7 consists of a fine-grained
sand. This material should provide good subgrade for foundations, although there may
be a tendency to cave in cut slopes. I recommend that the building envelopes for each lot
be examined before construction, either by excavating test pits or drilling, to obtain
information on the soil profiled, depth to bedrock and depth to groundwater. Samples
should be collected at the foundation level for geotechnical analysis of strength, density,
moisture content, and swell-consolidation potential. Foundations should be designed
based on the results of the tests.

Shallow bedrock that is present will increase the cost of excavation.
Areas of excavated fill dirt on lots 1 and 2 should be removed. If this material is to be
used as engineered fill, the geotechnical characteristics must first be determined.
3) Groundwater. Shallow groundwater,which is almost certainly present on lots 1 and 2,
but should be investigated at each lot, signifies limitations for home design and siting of
leach fields. No basement construction should be undertaken in areas of shallow
groundwater (within 8 ft of the surface), and it may be necessary to set the foundations on
raised pads to avoid flooding and/or seepage. Basement construction may be feasible for
lots 3 through 7, but any subgrade construction should be accompanied by perimeter
drains.
Leach fields should be sited a minimum of 50 ft from the lake and wetlands areas. Where
groundwater is present at depths of 5 ft or less from the surface, leach fields should be
engineered, either mounded absorption systems or mounded
evapotranspiration/adsorption systems.
In summary, the issues for development concern areas that are prone to wetness, either
from surface flooding or groundwater on lots 1 and 2, and the potential for unsuitable
soils for foundations on these same lots. Before development begins, a subsurface
investigation should be performed and the wetlands area should be delineated. Building
envelopes should be outlined for lots 1 and 2. CGS recommendation of approval of this
PUD is contingent on these items. Please call me if there are any questions.

Dear Mr . Ballsadt,
The following comments are in regard to the Lindies Lake
PUD . The North Side Lateral ditch runs along the east side of
the above mentioned property. The map refers to this canal as
the Greeley No . 2 ditch . This canal has been in existence for
nearly 100 years and The North Side Lateral Company has a
prescriptive easement along the canal . This easement is
necessary for the ditch company to continue to operate as it has
over the years . The right-of-way is necesary for operation and
maintenance of the canal, including but not limited to access for
water delivery, weed control, canal burning, excavation, storage
of materials, etc .
The proposed common area trail that is indicated on the map
appears to be right along the canal and therefore is within this
right-of-way. Due to liability concerns the North Side Lateral
Company prohibits access to the right-of-way by other persons and
vehicles . Permission must be granted by the ditch company to
utilize its right-of-way. Permission has not been granted for
this development .
In light of this the North Side Lateral Company oppoocs this
portion of the development proposal . The ditch company does not
oppose the idea of a trail being a part of the plan but would
note that there is sufficient area along the east side of the
lake to permit the building and enjoyment of a trail . The ditch
company would encourage the placement of the trail away from the
canal and its easement .

I've recently met with Bill „Walsh regarding Lindies Lake PUD and he provided me with
additional material for review. My comments below are based on his discussion; the Preliminary
Subsurface and Percolation Investigation prepared by Foundation& Soils Engineering,Inc.
(April 1998); and two letters from the Department of the Army Corps of Engineers(May 6, 1998
and August 17, 1998) concerning the wetlands.
1) Wetlands. Mr. Walsh plans to dredge the lake to improve storage. In doing so,wetlands along
the west and north sides of the lake will be disturbed. The Corps letter of August 17 states that no
permit will be required for the work. Therefore,no further investigation is required by the
developer.
2) Groundwater. The depth to groundwater ranges between 5 and 10 ft below ground level.
Without additional fill material,basement construction is not recommended in the area. Mr.

j'{ �akslt is tentatively considering adding fill to the lots to build up the grade,and proposes homes
with walkout basements as a possible design. The feasibility of this design should be evaluated
by the engineering consultant on a lot-by-lot basis after earthwork is completed.
Perimeter drains should be an adjunct of any home with subgrade construction. I recommend that
dewatering equipment be present on site during foundation excavation. This is mandatory if
drilled pier foundations are used.
3) Soils. The geotechnical tests performed on three samples indicate the onsite soils have a low
to nil potential for swell or consolidation,indicating the soil is a good subgrade for construction.
A possible plan to build up the grade on the lots is to deposit the dredged material from the lake
onto the lot sites. The dredged material is likely to contain significant organic material, which
would make it unsuitable for foundation subgrade,due to the potential for long-term
consolidation. Before using this material as fill in building envelopes or under driveways,this
soil must be analyzed for geotechnical parameters and judged to be acceptable. The lakebed soil
could be used suitably for fill in other parts of the lots.

4) Septic systems. Foundation& Soils Engineering recommend engineered systems for four of
the five lots tested(the plat has since changed to include seven lots). I agree with this
recommendation based on the presence of shallow groundwater and shallow bedrock. Before
installation of the septic systems,each site should be perc tested and the depth to groundwater
and bedrock should be determined.
In summary, the concerns at the site relate to shallow groundwater. Lot-specific testing will need
to be performed before the construction of homes and the installation of septic systems is
undertaken. Soil from the lakebed must be analyzed to assess its suitability as fill material at
building sites. Please call me if there are any questions.
