RE: REGULATING, WARNING AND GUIDING TRAFFIC DURING THE TEMPORARY
CLOSURE OF A PORTION OF THE RIGHT-OF-WAY FOR FIRST STREET AND "B"
STREET IN JOHNSON SUBDIVISION FOR 120 DAYS AND DIRECTING STAFF TO
APPLY TO VACATE RIGHTS -OF -WAY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 42-4-410(6)(a), CRS:
"...local authorities, with their respective jurisdiction may, for the
purpose of road construction and maintenance, temporarily close to
through traffic or to all vehicular traffic any highway or portion thereof
for a period not to exceed a specified number of work days for
project completion and shall, in conjunction with any such road
closure establish appropriate detours or provide for an alternative
routing of the traffic affected...", and
WHEREAS, the Board, pursuant to said statute and upon the basis of traffic and personal
investigations, has determined that conditions exist which make it necessary to temporarily close
the road right-of-way to through traffic and to regulate, warn and guide vehicular traffic on said
County roads by posting signs thereon, and
WHEREAS, the subject rights -of -way are not improved and are not suitable for use by
traffic, and
WHEREAS, the vacation of these rights -of -way should be considered pursuant to Section 8
of the Weld County Subdivision Ordinance.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld
County, Colorado, deems it necessary to regulate, warn and guide vehicular traffic on County roads
and any intersections thereof, and it hereby authorizes and orders the posting of such traffic control
devices as shall be reasonably necessary to regulate, warn and/or guide traffic thereon for the
safety of the general public and that said traffic control devices shall conform to the Federal Manual
on Uniform Traffic Control Devices.

BE IT FURTHER RESOLVED that the Board of County Commissioners of Weld County,
Colorado, does declare and establish that Weld County Road rights -of -way denoted as a portion
of "B" Street between Lot 12, Block 1, and Lot 11, Block 1, Johnson Subdivision and West First
Street between Lot 7, Block 3, and Lot 6, Block 4, Johnson Subdivision be temporarily closed, with
said closure being effective May 10, 1995, for approximately 120 days, and further, that standard
official traffic control devices shall be erected at said closure giving notice of the restrictions.
BE IT FURTHER RESOLVED that the Public Works Department is directed to prepare an
application to vacate said rights -of -way pursuant to Section 6 of the Weld County Subdivision
Ordinance.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 10th day of May, A.D., 1995.

Johnson Subdivision - "B" Street:
Drew Scheltinga, Dave Becker, Bruce Barker, and Lee Morrison
(See work session minutes dated April 10.) The City of Greeley wanted to require
the developer of the Larson Subdivision to connect "B" Street between the Larson
Subdivision and the Johnson Subdivision. The Johnson Subdivision is outside
Greeley city limits. Some time ago, residents formed a special improvement
district to pave the roads. The commissioners agreed it would be unfair to
Johnson Subdivision residents to allow the City of Greeley to connect "B" Street.
On April 14, the board sent a letter to the city stating its position. The county
barricaded the street to keep construction vehicles out. In today's meeting, the
board decided to permanently close the road. The issue will appear on the
board's Wednesday, May 10, agenda as an item of business. Staff will be directed
to apply to replat the subdivision for purposes of vacating the right-of-way.
The new plat will show both B Street and W. 1st Street as dead ends. Notices of
a public hearing will be sent to all legally required addresses plus those in the
Johnson Subdivision.

Dear Mayor Morton:
The Board of Weld Commissioners has received letters and telephone calls from residents in the
Johnson Subdivision concerning a proposed street connection into the Larson Subdivision. It is our
understanding that the City is requiring the developer of the Larson Subdivision to build a street
connection to "B" Street approximately 300' west of 40th Avenue. Presently, the Larson
Subdivision has only one access, 43rd Avenue. If the proposed street connection were made, 40th
Avenue would be a second access to the Larson Subdivision.
In 1993, the residents of Johnson Subdivision created a local improvement district to pay the cost
of paving their streets. They are concerned that the extra traffic created by a second access into the
Larson Subdivision will deteriorate the condition of their streets. They are particularly concerned
about heavy vehicles because of the construction activity in the Larson Subdivision.

Thank you for a copy of the letter you sent to Mayor
Morton and the phone call from Drew Scheltinga.
However, the need for action is immediate. The construction
vehicles building the new city road are using 40th Ave. for
access now.
At least twice one of the neighbors has talked with the
construction workers to explain our road's condition. They have
agreed our road will be destroyed if used by these heavy trucks and
have told the drivers in these instances to use another access.
It's not feasible or right that one of us in Johnson Subdivision
should have to do this to protect our financial investment with
the county.
It is my understanding when subdivisions are approved they
are done so with committment they cause no ddditional expenses
or cost to the surrounding entities. The developer is informed
he must pay for any impact on adjacent land/people. Therefore,
it seems it the road must be opened, itsituld be the developer
of Larson Subdivision, Ray Larson, who is assessed to bring
40th Avenue and 38th Avenue and B Street up to standards for
increased and heavy use or for the roads not to be opened.
We were told it was the Greeley Fire Department who said
two entries must be made into Larson Subdivision. There are not
two now and people have been living there for sometime. Plus --
when the culvert is installed and the connection is made through
the storm drainage area on B St. between 43rd Ave. and 43rd Ave. Ct.,
there will be two entries.
If there is no way to refuse access, the solution for the
county appears to be posting signs on 38th and 40th Avenues
entrances at 4th Street stating " No vehicles over ? tons
and"Constuction Vehicles Use 42nd Avenue" in addition to barricades
at B Street entrance to the construction site until construction
of roads and homes in the subdivision is complete and tickets
issued to offenders. Our area is county and not city so we
don't understand how the city fire department has the right to
demand the use of county roads.
Whatever happens on down the line--- some action must be
immediate.

Dear Steven:
After a discussion with some of the Commissioners, there appears to be no change in the Board's
previous decision regarding this request. To reiterate: the response to your recent letter dated
December 6, 1993 was to not complete the connection between the two subdivisions. In support
of the Boar 1,s deci ion, our Department will not take any action to open the roadway. I appreciate
your brjzi ing issue to my attention, but regret that we are unable to provide any relief.

SUBDIVISION
The City of Greeley Public Works Department has received requests
from citizens who live in the Larson Subdivision (north of 4th
Street) to complete a local street connection Subdivision Johnson
Subdivision (County jurisdiction)
improvements include the extension of 2nd Street easterly to the
Johnson Subdivision boundary. Street right-of-way is established
within the Johnson Subdivision at this location, but no street
improvements are in place.
The Public Works Department is hereby requesting that a joint
project be initiated to complete the connection of this local
street between the two subdivisions. It will primarily improve
emergency access to the areas but will also improve local traffic
flow flexibility.

I reside in Johnson Subdivision, Weld County,
Greeley. In 1993 our neighbors formed a special
improvement district to pave our roads. We followed
required proceedures including meeting with Drew
Scheltinga, County Engineer. Questions about future
use of the roads were raised.
At that time traffic into and out of the subdivision
was monitored. The specs for the roads were determined
by the roads, use at that time.
Now, just two years later, the Larson Subdivision
to our west is expanding. It appears the city of
Greeley has plans to connect with our streets at B and
at 2nd Street.
This section of the city has experienced much
construction and thus when these roads are opened
our traffice will increase tremendously. Also since
it will be a straight shot in, I forsee many of the
construction deliveries in very weighty trucks being
made using 40th Ave. I'm not sure the road will hold
up to the weight and increased use.
I and other neighbors question the specs meeting
adthitional traffic and why we must‘tay for the
city to have access to the subdivision and others -by using
roads we financed. If these connections were planned
before we asked to be paved, we should have been so informed.
Attached is a map showing location of the area
in question.
