After consulting with Monica, Trevor Jiricek and Lee Morrison, I have responded to Mr. Burch that, because his complaint is with a property located in an incorporated municipality, it is not within the county's jurisdiction to intervene in resolving this situation. January 24, 1997 I spoke to you on the phone 1-24-97 and I was also referred to Roger Veho of Building Inspections at the same address. We are seeking assistance from the proper Government authority who has the responsibility to manage water drainage, irrigation systems and flood control for the County and/or State. We have a problem and need help. Our farm property is located between Road 32 and Road 34 East of 125. The Town of Mead is West and growing, houses are being built on which was previously farm land. The Mulligan Estates Development is having an impact on the historical water drainage and irrigation system upstream of our land. We are experiencing increasing sub -moisture and land waste due to the change in normal water drainage and possible septic system input. The problem has been discussed for more than a year between the Town of Mead , ourselves and the developer. It is our feeling that the developer does not intend to make adequate, long term provisions in the water handling systems through their project that will prevent damage to the land of the downstream landowners. The developer continues to build and change the landscape with little regard for the drainage issue. After numerous appeals and attempts to find a resolution, he has told negotiators: "I will route the water downstream, and if the land owners don't like it, they can sue me and let a Judge tell me how to fix the problem". This is the attitude we need help to countermand. Since we are downstream we are greatly concerned about the normal water drainage handling system and the overflow and flood control mechanisms on local lakes. One mechanism may have been disabled. Someone must also evaluate the area water control system using the 100 year flood scenario. The shale base in the area may also be having an affect on routing the induced water toward our land. We feel a good long term solution for all concerned can be found. We would feel better if the problem was evaluated by un-biased, qualified authorities who has the responsibility to plan and monitor water flow systems. If our problem is not the responsibility of your agency, please direct us to the proper agency. On 1-13-97 several of our family members attended the: Town of Mead -Board of Trustees, regular meeting. Our purpose was to listen to discussion concerning the Mulligan Lake drainage ditch problem. As you know, we are concerned about this issue because our property can be damaged if a wrong decision is made. It is our feeling that not much progress has been made in determining a long term resolution. We were surprised to hear that resolutions were proposed by the developer and accepted by the Mead Water Engineering staff without adequate follow-up and research. Our feeling is, the developer has suggested a resolution which minimizes economic impact on themselves with little consideration to down stream property owners. This communication is to inform you that we intend to inform State and County water authorities of our dilemma. We feel the issue must be reviewed by qualified water authorities whose interest it is to plan and ensure proper water handling systems. This also includes overflow and flood control mechanisms for local lakes. We feel there may be a longer term resolution that will be less cost redundant in the future as the community changes if the water system is looked at in a broader perspective. Most importantly, it would be undesirable if the community was a maze of ditches that could be a hazard to citizens. We would like to point out that every year more of our land is rendered unusable for agriculture because of water seepage coming from uphill development on the West and South of our boundaries. By not much stretch of the imagination we can visualize our property and homestead in a flood plain using the 100 year flood scenario for projecting water flow management. In area growth periods such as this, it is someone's responsibility in Government to ensure the property of others is not downgraded by self-serving prevailing powers and masters of obscurity. We all should be concerned about the appearance and purpose of the land. Short term thinking is a mistake, especially if we intend to stay in this community. We should try and make good decisions that will stand for a long period of time, or we will find ourselves wasting time on an old subject which is a distraction from new business. Those who intend to stay should be the conscience--- they are the only ones who care. Thank you for the time you have spent on this problem on our behalf. We regret seeking outside help. Our intention is to ensure all aspects have been considered. We feel certain that together with the efforts of the Mead Board of Trustees, and ours, the subject will be dispositioned properly.
