This project falls primarily under the purview of the Weld County Planned Unit Development Standards. Our comments and requirements are as follows: COMMENTS: 1. Improvements Agreement: The applicant has provided an Improvements Agreement According Policy Regarding Collateral for Improvements (Private Road Maintenance). The street grading and street base/gravel improvements have been verified for cost and quantity. All transportation items appear to be adequate. 2. Storm Water Drainage: McRae & Short, Inc. has prepared a Final Plan Grading and Drainage Plan Map which was signed and stamped by Gerald B. McRae, a professional engineer. I have reviewed the document and have no conflict. REQUIREMENTS: 1. Signing: At the appropriate location, the applicant shall place a stop sign and a street sign identifying Avery Acres. 2. The Weld County Health Department has reviewed this proposal. We also,rvieyvpd1 Sketch Plan (S-462) and Change of Zone (Z-516) for this development. D proposed use and development for this final plan appears to be simile n development described in the sketch plan and change of zone materials. The application appears to have satisfied PUD Ordinance No. 197 in regard to water service. According to the submitted materials it is the owners intention to have the North Weld County Water District provide water. However, as indicated in the submitted materials the owner would like to reserve the option to request an exception to the public water requirement, as allowed in the PUD Ordinance, in the event they cannot work out an agreement with the water district. In this case, the lots would be developed using wells as their source of water. I spoke with John Anderson at the Colorado Division of Water Resources (352-8712) concerning the issuance of wells permits on the proposed lots. Mr. Anderson indicated that if the lots were to be served by wells, without an augmentation plan, they would issue "household use" only permits. These permits do not allow any exterior use of water for gardens, yards, animals, etc. Therefore, if the applicant cannot obtain water from the NWCWD then we recommend that the applicant be required to have an approved augmentation plan prior to the approval of an exception to the public water requirement. The application has satisfied PUD Ordinance No. 197 in regard to sewer service. Individual sewage disposal systems are proposed. The minimum proposed lot size (2.5 acres) and overall density of septic systems per acre (1 septic system per 39 acres) meets Department policy. In the event the applicant does not receive an exception to the public water provision, we will need to review the proposed public water supply. In the event the applicant receives an exception to the public water provision and you find that the submitted materials complete, we recommend that the following conditions be a part of any approval: 1) Individual sewage disposal systems are required for the proposed residential lots and shall be installed according to the Weld County Individual Sewage Disposal (I.S.D.S.) Regulations. 2) The development shall obtain water service from the North Weld County Water District. John and James Suaer Page 2 3) The "Right to Farm" covenant shall be placed on the plat. 4) In the event: that 5 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. 5) During development of the site, all land disturbance shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Department of Public Health and Environment, a fugitive dust control plan must be submitted. Please note: The Weld County Health Department, Environmental Protection Services recommends alternative strategies regarding water conservation and waste minimization. Considerations such as xeriscaping, low flow water fixtures, backyard composting and recycling are a few options available to home owners. We also recommend that preliminary radon mitigation measures be incorporated in the construction of new homes. Radon kits are available in our office.
