RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT
#1218 FOR A HOME BUSINESS (STORAGE UNITS) IN THE A (AGRICULTURAL)
ZONE DISTRICT - CHARLES AND GAIL SCHNUERLE
A public hearing was conducted on May 12, 1999, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 28, 1999, and duly published May 1, 1999,
in the Fort Lupton Press, a public hearing was conducted to consider the request of Charles
and Gail Schnuerle for a Home Business (storage units) in the A (Agricultural) Zone District.
Lee Morrison, Assistant County Attorney, made this a matter of record. Julie Chester,
Department of Planning Services, presented a brief summary of the proposal and entered the
favorable recommendation of the Planning Commission into the record as written. Ms. Chester
gave a brief description of the location of the site which is 5 acres In size, stated six of the
seven referrals responded favorably although the City of Greeley was opposed, and the
application is consistent with the Weld County Comprehensive Plan and Zoning Ordinance.
She stated the site receives water services from the City of Greeley and private wells, and there
is a septic system for the existing house and future office; however, the Health Department is
recommending public restrooms be made available. Ms. Chester stated the residence will be
maintained at its current condition and will be used as an office, and the applicant is proposing
to place landscaping along 95th Avenue to help mitigate noise to the surrounding uses. Ms.
Chester further stated the applicant submitted letters after the Planning Commission Hearing
which address some of the concerns, and she recommended Conditions of Approval #2.D, 2.E
and 2.F be deleted, submitted Exhibit H requesting Condition #2.B.4 be added to state, "The
revised Circulation Plan," and Condition #2.B.2 be amended to replace the word "retention" with
"detention." In response to Commissioner Kirkmeyer, Ms. Chester stated the applicant has
submitted the Drainage Plan as required by Condition #2.F to the Department of Public Works
and it has been approved. Responding to Commissioner Geile, Ms. Chester stated the City of
Greeley has annexed the road adjacent to the property; however, she is not aware of any plans
to annex the property at this time. Don Carroll, Department of Public Works, confirmed the City
of Greeley has annexed the road and the property to the east of the site. In response to
Commissioner Kirkmeyer, Ms. Chester stated Development Standard #19 is a standard

requirement of the Design Standards for commercial operations and, although this property is in
the Agricultural Zone District, the use is for a commercial operation, therefore the property has
the potential for commercial zoning in the future.
Charles Schnuerle, applicant, stated he feels the proposed landscaping will be appropriate for
the area and he has reviewed and agrees with the Conditions of Approval and Development
Standards. Mr. Schnuerle explained he plans to build the storage buildings in two phases and
due to the layout of the utilities, the restroom will need to be located in the second phase of the
buildings at the front of the property. Trevor Jiricek, Department of Public Health and
Environment, stated the Health Department is willing to allow the applicant to designate the
restroom facilities in the existing house as public restrooms until the second phase is complete.
Responding to Commissioner Geile, Mr. Schnuerle stated he has not considered annexing into
the City of Greeley, and added the City is not planning to annex the area for at least another
five years.
No public testimony was offered concerning this matter.
Commissioner Kirkmeyer moved to approve the request of Charles and Gail Schnuerle for a
Site Specific Development Plan and Special Review Permit #1218 for a Home Business
(storage units) in the A (Agricultural) Zone District, based on the recommendations of the
Department of Planning Services staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record, and to delete Conditions of
Approval #2.D, #2.E, and #2.F, add Condition #2.B.4 to state, "The revised Circulation Plan,"
and amend Condition #2.B.2 to replace the word "retention" with "detention." The motion was
seconded by Commissioner Vaad, and it carried unanimously.
This Certification was approved on the 17th day of May, 1999.
