A meeting was held on February 7, 1998 with Randy and Julie Robb, Russell and Patricia Martinson, and Ronald and Mary Jurgensmeier. As a result of the meeting, we, as neighbors, agreed to withdraw our request for the county to deny the kennel permit if the following provisions were included in the permit contingencies. 1. The Martinson's take care of the barking dogs by having them debarked. 2. The permit to be granted on an temporary basis for one year and if the noise is no longer a problem that the permit be made permanent at that time. Our objections to the kennel permit were based on the noise and if that is resolved, we have no further objections. The current number of dogs the Martinson's moved onto the property with November of 1996 have already impaired the quality of our lives. These dogs, unlike the rest of the neighborhood dogs, bark everytime they are released into the yard. Their yips and yipes are high, schrill, and unnerving. This has driven us into the house. We can no longer use our deck as a place to relax. 2. This noise is so great that they can be heard in the basement of our house in corner the farthest from the Martinson's property. 3. If the number they moved in with and have now are this disturbing to us, there is no way we could ever condone adding a kennel and increasing the numbers. 4. Most of the neighborhood dogs bark only to protect territory or greet visitors, etc. These dogs bark when released outdoors and do not stop--the owners yelling silences them for only moments then they begin again. 5. We have lived at this location since 1969 and have had many neighbors, but these dogs have had the most negative and disturbing impact. 6. A kennel would drive down the property values. Who wants to buy a property which is next door to a kennel with a noise problem? We were approached by Patricia Martinson before they moved onto the property about gaining their neighbor's unofficial approval in regard to having dogs of the toy breed. Our recollection is vague about any mention of numbers of animals. We had no objection at that time since we have had dogs all of our lives. However, when the Martinsons moved onto the property, we were immediately aware of their dog's high shrill barking and that alerted us the fact that we now did have a problem with their dogs. We could not have anticipated the dogs would create the volume of noise or create such a disturbance. Even though our house and property is located diagonally across the street from the Martinson's, we can hear their disturbances whenever we are out in the yard. There are dogs all around the neighborhood and they bark but stop after a time and are not as annoying as these dogs. McDonnell 3003 East 18th Street Greeley, CO 80631 970-356-2280 RE: Case Number USR-1178 Request for a Permit for a kennel by Russell and Patricia Martinson I am requesting that you deny the request for a kennel permit based on the following concerns and issues: I. My property is directly bounded by their property on the north, east, and west. I have lost the use of my yard on the north due to the dogs behavior. The dogs, bark incessantly, and I have refrained from using my backyard to avoid the disturbances. 2. I have lived in this location for the last 20 years and my quality of life has been eroded by the addition of these dogs. Additional animals in a kennel would further erode that quality. 3. I have a lane that borders on the east side of their property, and my daughter cannot ride her horse down that lane because of the disturbance this creates. 4. Their incessant barking is bothersome not only to myself but to guests as well. 5. The proximity of mine and neighbor's homes to the proposed kennel and the lack of a county noise/barking dog ordinance does not make for a good environment. 6. This area is not conducive to and conflicts with a kennel because this area is zoned agricultural.
