A public hearing was conducted on December 18, 1996, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to three notices dated December 2, 1996, and duly published
December 5, 1996, in the South Weld Sun, a public hearing was conducted to consider the request
of Boulder Creek Estates,LLC, for a Site Specific Development Plan and Amended Special Review
Permit #397 for an open pit sand and gravel mining operation and materials conveyance, as
submitted in the application materials, in the A (Agricultural) Zone District; JCK Gravel, Inc., for a
Site Specific Development Plan and Amended Special Review Permit#809 for an open pit sand
and gravel mining operation, asphalt and concrete batch plants and materials conveyance, as
submitted in the application materials, located in the A(Agricultural) Zone District; and JCK Gravel,
Inc., for a Site Specific Development Plan and Special Review Permit#1132 for a dry sand and
gravel mining operation, importation of sand and gravel material from Amended USR #397,
processing and sales, and concrete and asphalt batch plants in the A (Agricultural) Zone District.

Lee Morrison, Assistant County Attorney, made these cases a matter of record. Chair Kirkmeyer
informed the applicant that only four Commissioners are present and in the event of a tie vote,
Commissioner Webster would review the record and cast the deciding vote, or the applicant may
request a continuance. John Hickman of Western Mobile, Inc., stated he is representing the owner
of the property, Floyd Oliver, who wishes to proceed today. Todd Hodges, Planning Department
representative, explained these three cases are contingent upon each other. He noted the original
USR#397 was approved in 1980, and the original USR#809 was approved in 1987. Mr. Hodges
stated the site for USR#1132 is from a portion of the site for USR#809, which is why USR#809
is being amended. He further clarified the Flood Hazard Permit has been approved based USR
#809 being amended for the conveyance of the property. Mr. Hodges presented a brief summary
of the proposals and entered the favorable recommendations of the Planning Commission into the
record as written. Mr. Hickman stated approval of these Permits will consolidate and clean up the
existing operation, which is needed for neatness. He confirmed all Conditions of Approval and
Development Standards are agreeable. No public testimony was offered concerning these cases.
Commissioner Harbert moved to approve the request of Boulder Creek Estates, LLC, for a Site
Specific Development Plan and Amended Special Review Permit#397 for an open pit sand and
gravel mining operation and materials conveyance, as submitted in the application materials, in the
A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as entered into the
record. The motion was seconded by Commissioner Hall, and it carried unanimously.
Commissioner Baxter moved to approve the request of JCK Gravel, Inc., for a Site Specific
Development Plan and Amended Special Review Permit #809 for an open pit sand and gravel
mining operation, asphalt and concrete batch plants and materials conveyance, as submitted in the
application materials, located in the A (Agricultural) Zone District, based on the recommendations
of the Planning staff and the Planning Commission, with the Conditions of Approval and
Development Standards as entered into the record. The motion was seconded by Commissioner
Hall, and it carried unanimously.
Commissioner Hall moved to approve the request of JCK Gravel, Inc., for a Site Specific
Development Plan and Special Review Permit#1132 for a dry sand and gravel mining operation,
importation of sand and gravel material from Amended USR #397, processing and sales, and
concrete and asphalt batch plants in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Harbert, and it carried unanimously.
