RESOLUTION RE: AUTHORIZING THE COUNTY ATTORNEY TO DEFEND THE BOARD AND ALL NAMED DEFENDANTS IN THE CASE, EN- TITLED H. GORDON HOWARD vs. HAROLD W. ANDERSON, ET. AL, CIVIL ACTION NO. C-1330, IN THE FEDERAL DIS- TRICT COURT, DENVER, COLORADO. BE IT RESOLVED, that the Board of County Commissioners, Weld County, Colorado, authorizes the County Attorney to defend said Board and all named defendants in the case of H. Gordon Howard vs. Harold W. Anderson, et. al. , also, to employ co -counsel and to do whatever is nec- essary in bringing the matter to a speedy conclusion. BE IT FURTHER RESOLVED, AND IT HEREBY IS ORDERED that the County of Weld assume the cost of the defense of the above entitled action until final determination of the case. The sat i ordinance iaa so vague, uncertain, and indefinite, aad lacking in standards for justifying son'-ng, or rezoning that ;t is invalid and unenforceable, and contrary to due pbosese of law. 6. 'the etid lining ordinanae,restricting the use to which property may be put,bears no substantial relation to public health, safety, morals, or general welfare, and is so arbitrary, and unreasonable that it is in conflict with the Plaintiff's rights of due process of law under the 14th aaendaent to the United ttatea ta****a *e Constitution. 7. The County Board of Comaiesioners of Weld County has no valid or legal power vested in then to pass zoning ordinances, and in consequence thereof their passage of said aforementioned , oning ordinance is unconstitutional. The Provisions of the Colorado Constitution do not authorize the legislature to grant power to the goveann6 authorities of Counties to pass 'toning ordinances. S. The said zoning ordinance attempts to impose unreasonable restrictions on the Plaintiff's vested business sad property rights as a United States Citisen, which business and property rights were acquired before the enactment of the said invalid and unconstitutional ordinance, and are protected by the 14th amendment to the U. 3.Constttutlom. 9. The said unconstitutional zoning ordinance constitutes a continuous interference with, and nuisance to, and conflict with, plaintiff** property rights toss in such a manner as to deny the Plaintiff the protection of due process* of law under the 14th Amendment to the United States Constitution; and its enforcement would not benefit the health, safety, oonveniae, or general welfare of the territory in which Plaintiff's bus; neaa and property is situated, but would on the other hand, promote merely private rights, private desires, or private comfort, or satiny purely personal or aesthetic desires of the defendants, and therefore it is unconstitutionally in conflict with Plaintiff's rights under the said 14th asendsent to the U. 6.
