HomeMy WebLinkAbout952406.tiffRESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1823 - RADEMACHER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30- 28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1823, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1823 was submitted by Louis J. and Frances J. Rademacher, 13184 Weld County Road 13, Longmont, Colorado 80504, for property which is described as Lot B of Amended RE #988, located in part of the SW'/ of Section 30, Township 3 North, Range 67 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 149.616 acres and 1 acre. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1823 submitted by Louis J. and Frances J. Rademacher be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. No additional accesses shall be allowed to Lot A or Lot B. 3. Prior to recording the plat, the applicant shall show a 20 -foot wide access easement across the northem boundary of Lots A and B leading to an access point onto Weld County Road 13, which shall be for the benefit of said Lot A of this RE #1823 and for the benefit of Lot A of Amended RE #988. Rademacher. The parcel of land under consideration is described as Lot B of Amended RE -988 located in part of the SW4 of Section 30, T3N, R67W of the 6th P.M., Weld County, Colorado. The property is located east of and adjacent to Weld County Road 13 and approximately 1/2 mile south of State Highway 66, within the Urban Growth Boundary of the Town of Mead. One residence, occupied by the applicants, exists on the property at the present time. Little Thompson Water District and a septic system for sewage disposal serve the existing residence on the property; the same are proposed for a second residence, if this recorded exemption is approved. The Weld County Health and Public Works Departments have no objection to this request. The Town of Mead and Mountain View Fire Protection District also responded with no objection. Three accesses supply ingress and egress to the property from Weld County Road 13. As shown on the applicants' plot plan, the north access is a twenty (20) - foot -wide access and utility easement which serves the residence on Lot A of RE -988 and is proposed to serve the newly -created Lot A as well. Recorded Exemption 988, approved by the Department of Planning Services in 1987, divided a 154 acre parcel into two parcels of 153 acres and 1 acre, more or less. Lot A of RE -988 contains a residence owned by the applicants' son. Staff recently approved an amendment to this recorded exemption to allow an increase in the size of Lot A from 1 acre to 2.38 acres. The applicants are proposing to divide the 150.616 acre parcel into 149.616 acres and 1 acre, more or less. According to the application materials, Mr. and Mrs. Rademacher wish to provide a homesite for individuals who are involved in the farming operation. Approximately two-thirds of proposed Lot A is currently farmed; the east side is in natural grasses. The uses on proposed Lot B include agricultural production, a residence, a lake and the St. Vrain Valley SERVICE, TEAMWORK,INTEGIUTY, QUALITY 952406 RE -1823, Louis J. & Frances J. While the majority of the quarter section is identified as prime farmland by the United States Department of Agriculture Soil Conservation Service, the area where Lot A is proposed does not appear to be designated as such (see attached soils map). The applicants are planning to create a second, small residential parcel along the north boundary of their property which accesses the County road by way of a shared, 20 -foot -wide private access easement. While the Transportation goals and policies of the Comprehensive Plan encourage shared residential accesses to the County road system, the staff does have concerns that allowing a second land -locked parcel to occur at this location is in conflict with efficient and orderly development. The Department of Planning Services' staff requests that the Board of County Commissioners consider this proposal and determine if the standards of Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance have been met. RECORDED EXEMPTION QUESTIONNAIRE 1 Explain the reason for the proposed recorded exemption and how each proposed it will be used. The exemption is necessary to provide housing for individuals involved in agricultural production/farming. The proposed Lot A will be residential, and Lot B will remain agricultural. 2 Describe the location, size and present use of the area where each proposed new lot will be created. Please refer to the attached map which indicates the location of each lot. Lot A is proposed to be 1 acre, Lot B is approximately 75.3 acres. Lot B is currently agricultural. The western 2/3 of Lot A is currently agricultural. The eastern 1/3 is waste land and open space. 1 Explain how the proposal is consistent with the Weld County Comprehensive Plan and any adopted municipal plan, if applicable. The proposal provides for the necessary housing for individuals involved in agricultural production, and therefore supports continued, highly valuable, agricultural production in the County. I Portions of this map unit which have smooth, even slopes of less than 6 percent would qualify as Prime Farmland if Irrigated with an Adequate Supply of Water. 2 Small portions of this map unit may exceed the maximum allowable slope range for Prime Farmland or portions may occur on ridges where soil erosion criteria is exceeded. These areas would be excluded from Prime Farmland. 3 Portions of this map unit which have been drained and salinity reduced below a level of 4 mmhos/ cn would be included in Prime Farmland. 4 5 This map unit occurs in areas where soils differ greatly over short distances. The map unit is defined too broadly to assign a Prime Farmland designation. Portions of the map unit may qualify as Prime Farmland. Only those portions of the map unit which do not flood frequently are included in Prime Farmlands. Hello
