RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT #1223 FOR A HOME BUSINESS (CONSTRUCTION BUSINESS) IN THE
A(AGRICULTURAL)ZONE DISTRICT- BART AND GERI FISCHER
A public hearing was conducted on May 26, 1999, at 10:00 a.m., with the following present:
Commissioner Dale K. Hall, Chair
Commissioner Barbara J. Kirkmeyer, Pro-Tern

Commissioner Glenn Vaad

The following business was transacted:
I hereby certify that pursuant to a notice dated May 12, 1999, and duly published May 15, 1999,
in the Fort Lupton Press, a public hearing was conducted to consider the request of Bart and Geri
Fischer for a Home Business (construction business) in the A (Agricultural) Zone District. Lee
Morrison, Assistant County Attorney, made this a matter of record. Julie Chester, Department of
Planning Services, presented a brief summary of the proposal and entered the favorable
recommendation of the Planning Commission into the record as written. Ms. Chester gave a brief
description of the location of the site, stated nine entities responded favorably to the referral sent,
and one E-mail message of opposition has been received. Ms. Chester stated the application is
consistent with the Weld County Comprehensive Plan, Zoning Ordinance and Agricultural Zone
District, and the site will be served by the Left Hand Water District and three individual septic
systems. She further stated Use by Special Review#797 currently exists on the property and will
be required to be vacated as a Condition of Approval. Ms. Chester gave a brief description of the
surrounding uses and stated the operation will require two employees with minimal equipment,the
proposed use is less intensive than the previous permit, and the site is not located within any Urban
Growth Boundary area; however, it is located within the referral areas for the Towns of Erie and
Frederick and the City of Longmont.
In response to Commissioner Vaad, Ms. Chester stated Use by Special Review Permit#797 is for
a more intense use; however, the proposal is for a different use and must be reviewed by the
Board. Mr. Morrison clarified if the use had remained with less intensity, the permit could have
simply been amended. In response to Commissioner Geile and Vaad, Ms. Chester stated the
previous use transferred with the sale of the land requiring Use by Special Review Permit#797 to
be vacated. Chair Hall commented that regardless of the proposed intensity, the permit must be
reviewed due to the new use.

Bart Fischer, applicant, stated he thought Use by Special Permit#797 had been vacated when he
purchased the property. He explained he intends to upgrade and use the current facilities, and the
existing manufacturing structures will be used as storage. Mr. Fischer indicated the property owner
to the east would like to have screening placed between the properties.
No public testimony was offered concerning this matter.
Commissioner Geile moved to approve the request of Bart and Geri Fischer for a Site Specific
Development Plan and Special Review Permit#1223 for a Home Business(construction business)
in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the
Planning Commission,with the Conditions of Approval and Development Standards as entered into
the record. The motion was seconded by Commissioner Baxter, and it carried unanimously.
This Certification was approved on the 2nd day of June, 1999.
