Approved with Conditions
The Department of Planning Services has determined through the review,that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. Prior to recording the plat:
A. The following note shall be placed on the plat: All proposed or existing structures will or do meet the
minimum setback and offset requirements for the zone district in which the property is located.
B. All approved accesses shall be clearly shown on the plat.
C. The property owners of Lot A shall provide written documentation to the Department of Planning
Services demonstrating that all conditions of approval required by Site Plan Review#260 have been
satisfied. If Lot A does not meet said standards, the property owners shall enter into an

Improvements Agreement with Weld County guaranteeing completion of the required improvements.
2. All future construction on Lots A or B shall occur in accordance with the currently adopted Uniform Fire Code
and Uniform Building Code,as required by Mountain View Fire Protection District in a letter dated November
25, 1997.
3. The landscaping for Lots A and B, as identified on Site Plan Review plats#240 (New Vision Homes) and
#260(Darrell&Christina Felton),shall be replaced along the west boundary lines of said lots and adjacent
to I-25 East Frontage Road within 90 days of completion of the road construction. The landscaping on Lot
B shall be extended to the amended south boundary line, a distance of an additional 153 feet.
4. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office
of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements
of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60)days
from the date of approval by the Department of Planning Services. The applicant shall be responsible for
paying the recording fees.

Subject: AmRE-1717; SPR-240; SPR-260
After conducting follow-up property research, it has been determined that AmRE-1717, is not going
to be pursued by the applicant. I have concurrence from Mr. Jamie Finnick, from New Vision
Homes, that he no longer wishes to precede with this application. The existing property is located
on RE-1717, which also correlates appropriately to both SPR-240 and SPR-260.
After conducting research, it appears that the property owners attempted to conduct AmRE-1717
after both Site Plans 240 and 260 were completed. Both these site plans contained with them the
ability to not have a substantial change should AmRE-1717 be approved.
Therefore, based on this information and at the wish of the property owner, AmRE-1717 will be
considered inactive and there will be no adverse effect to SPR-240 and SPR-260.

Dear Mr. Finnick:
On January 8, 1998, you received approval from the Weld County Planning Staff for an amended
Recorded Exemption (AMRE-1717). As part of this case, you also participated in Site Plan Review
(SPR-260). It is my understanding that you have not satisfied the criteria of approval for either of
these two cases. Should my understanding not be correct, please provide the appropriate
documentation concerning satisfaction of these conditions.
As a part of this approval you were given (60) sixty days to record the plats. Should we not hear
from you within three (3) weeks concerning you progress on this issue, then these cases will be
forwarded to Code Compliance for violation action.
It is our desire to assist all of our client's, and we understand the difficulties in meeting land use
conditions; however, until conditions are met, those activities described in the Recorded Exemption
and Site Plan Review cannot lawfully take place.

Your recorded exemption application is being processed. If it is determined that the application meets the approval
criteria of the Weld County Subdivision Ordinance, you will be notified that the recorded exemption is approved.
If the staff determines that the application does not meet the approval criteria, you will be notified and asked to appear
before the Board of County Commissioners at a public hearing. You will be informed of the hearing date prior to the
hearing. The Board of County Commissioners will then consider your application and make a final decision on the
recorded exemption.

l.a.Domestic water is currently being provided by Central Weld County Water.
b. There is no irrigation water on the site. No irrigation water has been removed.
2. Sewage disposal is currently being provided by the St.Vrain Sanitation District.
3. The property is being used as a manufactured home sales center.
4. The proposed amended recorded exemption is being requested to replace land area
taken by CDOT as part the I-25 Exit 240 construction project.
Each lot will continue to be used as they are now. Lot A; a manufactured home sales center
and Lot B; a horse trailer sales center.
5. Lot A is presntly 7.65+ /-acres and is being used as a manufactured home sales center.
Lot B is presently 9.21+/- acres and is being used as a horse trailer sales center.
6. There are no distinguishing or unique physical characteristics present on either lot.
7. All existing structures meet minimum setback and offset requirements.
8. The property is located in a commercial zone thereby making a conservation easement
impractical.
9.No building envelope is being proposed.
10. This proposal is consistent with the Weld County Comprehensive Plan in that the property
is in a commercial zone and is currently being used for commercial purposes.
11. There are no newly proposed uses. The surrounding land uses are also commercial thereby
making it's continued commercial use compatible.
12. The property is in a commercial zone as designated in the Weld County Comprehensive Plan
and is being used for commercial purposes.

petitioned into Northern Colorado Water Conservancy District.
