NARRATIVE IN RESPONSE TO QUESTIONNAIRE
The Applicant is the owner of approximately 160 acres of agricultural ground, in the
southeast corner of the intersections of Weld County Road 13 and State Highway 402 (Weld
County Road 54) which is presently zoned agricultural. The Applicant's daughter and son-
in-law, occupy the residence on the property, and the property is presently being used as
pasture ground to the extent possible. The property has a significant amount of land
unusable for agricultural endeavors. The property is close enough to the Big Thompson
river, that a portion of it lies within the hundred year flood plain and there are three ponds
and a substantial amount of swampy ground on the property. The property in the past has
been used for grazing purposes. The Applicant proposes to use the property for agricultural
and recreational purposes consisting of hunting and fishing, which is consistent with the
Weld County Comprehensive Plan Wildlife Goals and Policies 1 and 3, Goals 1 and 2 of the
Agricultural Goals and Policies and all goals of open space, Parks and Recreation is as set
forth in the Weld County Comprehensive Plan (12/21/95). The Applicant's use of the
property will continue the agricultural intent and uses, as there will be grazing of cattle on
the property and there will be a continued use of the property to raise pheasants and
chukkers, and to fish in the ponds on the property. The Applicant has applied for and
obtained a commercial wildlife park license from the State of Colorado on the property.
A copy of the license is submitted with this request for a Use by Special Review. The
proposed use of the property is consistent with the future development in the area, as stated
in the Weld County Comprehensive Plan. The property will remain agricultural, and there
will be essentially no physical change to the terrain. The Applicant will continue to graze
cattle from time to time on the property, and will increase the number of wild pheasants and
birds on the property.
The surrounding property uses to the Applicant's property, is agricultural. To the
north is pasture ground, to the south is corn crops and pasture ground, to the east is pasture
ground, and to the west is pasture ground. The Applicant would continue to have a cow-calf
operation consisting of approximately ten cows. The entire 160 acres would, in essence, be
used for hunting and fishing, during various seasons. Fishing would be in the three ponds
on the property. The total surface area of the ponds is approximately six acres. The ponds
supply the water source for the livestock. The Applicant's present use and continued
proposed use is consistent and compatible with all the surrounding uses.
As indicated on the special review plat map,the northern portion of the Applicant's
property does lie within the one hundred year flood plain of the Big Thompson River. The
Applicant does not propose construction of any improvements in this area of the property
and the property would be continued to be used in its present manner in open agricultural
area. The Applicant's present use and proposed use, makes the best attempt to conserve
all the productive agricultural land and will,in fact, enhance the agricultural use of the land.

The Applicant is presently negotiating with the United States Department of Agriculture
Natural Resources and Conservation Service, to grant to the Department of Agriculture,
pursuant to the wetlands reserve program, an easement,which would maintain,enhance and
manage the wetlands and other lands for the conservation of natural values, including fish
and wildlife habitat,open space,esthetic values, and promote environmental education. The
Applicant retains the right to the quiet enjoyment and use of the property to developed
recreational uses, including hunting and fishing. The easement requirement also prohibits
certain uses, unless specifically approved by the United States Government as being
compatible uses with the wetlands, open space and other natural values of the property. A
copy of a typical warranty easement deed is submitted as an exhibit and part of the
application.
This site will be used for agricultural purposes, a cow-calf operation, and for
recreational hunting and fishing. There are three ponds on the property that can be used
for recreational fishing, and one pond that can be used for goose and duck hunting, in
addition to fishing. The Applicant further will use the property for recreational hunting,
including pheasant and chukker hunting. In addition, there will be a skeet and trap shooting
area for recreational skeet and trap shooting. Greg Baker and his family presently reside
on the property and will continue to reside on the property and manage the property. The
next closest residence is in the southwest corner and is a five acre recorded exemption. This
residence is approximately 300 feet away from the Applicant's property. There is a
residence across Weld County Road 13 to the west, approximately 450 feet to the west of
the residence on the Applicant's property, and a residence in the northeast corner of the
intersection of Weld County Road 13 and Weld County Road 54. There is a residence to
the south of the Applicant's property, along Weld County Road 521/4,which is approximately
600 feet to the south of the Applicant's property line.
If this application is approved, the Applicant will then contract with various
individuals for recreational hunting an fishing. This would consist of, during appropriate
seasons, day hunts for pheasants and chukker,water fowl hunting, fishing, field dog trialing,
trap and skeet shooting, all coordinated to their season and to their activity on the property.
for waterfowl hunting the Applicant would install removable duck and goose blinds. The
Applicant has also filed for a commercial operator's license through the Division of Wildlife
to raise and harvest pheasant, chukker, quail, turkey and waterfowl, which license is
renewable on an annual basis. A typical hunt will consist of four hunters, lasting a
maximum of four hours. Applicant could conduct a hunt in the morning and a hunt in the
afternoon. An average hunt in the Applicant's experience,will consist of two hunters in the
morning and two hunters in the afternoon and would typically be conducted on Friday,
Saturday, Sunday and Monday, between the hours of 8:00 a.m., and 5:00 p.m. A typical
hunting season ranges from September through June 1st.
Fishing in the ponds would be conducted on a four hour basis, with one to two
people maximum in the morning and in the afternoon. Fishing would be done on a catch
and release basis.

The Applicant's daughter and son-in-law,Greg and Geri Baker,will be the employees
who will live on the site. In addition, the Bakers anticipate there may be one part-time
person in the summer who would work from 8:00 a.m. to 5:00 p.m.
Animals on the site would consist of a cow-calf operation, and not to exceed eight
dogs, which would be lease dogs for hunting purposes. Applicant intends to raise his own
birds on the property, and anticipates up to 6,000 total birds in a year. The birds would
average, however, 500 to 750 birds at any one time on the property. No additional
equipment or buildings will be necessary for the dogs or the birds. The present
improvements include a corral and outbuildings from a previous 100 head feedlot located
on the property which the Applicant will use to house the dogs and birds. Bulk feed will
be delivered to the property once every two weeks by semi-trailer and would consist of
approximately 8 to 9 ton of feed for the dogs, birds and cattle. The Applicant anticipates
this to be a very successful operation in the future and in three to five years, will construct
a clubhouse on the property as indicated on the site plan south of the present residence on
the property. This would be the only new construction on the property and would consist
of a one story structure approximately 1,000 to 1,500 square feet.
Vehicles using the site would be the delivery of the feed once every two weeks,
consisting of a truck or semi-trailer for delivery of bulk feed, and the balance of vehicles
would be can or pickup trucks of the hunters or fishermen. Parking would be immediately
to the east of the existing feedlot area, and Applicant anticipates four to six of such vehicles
three to five days per week. The site is presently serviced by a septic system, which is
adequate for the Applicant's residence, and when the clubhouse would be built, the
clubhouse would be serviced by a septic system on the property. The Applicant has ample
water supply, from the pumps and the Little Thompson Water District. The waste from the
birds, would be used as compost and spread over the entire 160 acres as needed. Applicant
anticipates that the manure would be spread once per month, or as needed. Manure would
be removed from the bird cages on a weekly basis, and stockpiled until spread over the
property. Stockpiles would be located adjacent to the bird pens. Other trash from the
house and from the clubhouse, once built, would be removed on an every-other-week basis
by BFI Trash.
The Applicant will not be constructing any improvements that will require any
reclamation procedures. Applicant is presently working with the Colorado State Forestry
Department, on a plan, wherein the Applicant will plant trees every year consisting of 250
seedling trees per year over the next five years. In addition, as previously indicated, the
Applicant is working with the United States Department of Agriculture Natural Resource
Conservation Service, to maintain and enhance and protect the functional values of the
wetlands and natural features of the property for esthetic and environmental education
purposes.
The Applicant has been contacted by numerous people and has conducted a
marketing research concerning the need for such a facility in Weld County. Applicant's

research showed that numerous people are leaving the State, going to Kansas and Nebraska
to participate in such recreational day hunts, and fishing activities and are very desirous of
having a local facility. The closest similar facility that the Applicant is aware of is north of
Fort Collins. The Applicant's property is ideally suited for such an activity, for recreational
hunting and fishing, and is located in a desirable location to provide these recreational
activities to the residents of Weld County within a reasonable distance and at a reasonable
cost.
The property is located within the Johnstown Fire District, and fire protection, if
needed,will be from the Johnstown Fire District. Water is provided by the Little Thompson
Water District. Because the Applicant is not altering the property, there will be no
additional storm water drainage generated to be handled on site, and therefore, no
additional storm drainage plan is necessary.
The Applicant believes that the proposed use is consistent with the Comprehensive
Plan, rezoning district and the future uses of the adjoining properties. Applicant requests
the approval of his request for Use by Special Review.

WETLANDS RESERVE PROGRAM

THIS WARRANTY EASEMENT DEED is made by and between

(hereafter referred to as the "Landowner"),Grantor(s), and the UNITED STATES OF AMERICA, by and thronglr
the Secretary of Agriculture, Washington.D.C.20250(hereafter referred to as the"United States"), Grantee. The
Landowner and the United States are jointly referred to as the "Parties." The acquiring agency of the United States
is the Natural Resources Conservation Service(NRCS)of the Department of Agriculture.
Wimesseth
Purposes and Intent. The purpose of this easement is to restore,protect, manage,.maintain, and enhance "
the functional values of wetlands and other lands, and for the conservation of natural values including fish and
wildlife habitat,water quality improvement, flood water retention,groundwater recharge, open space, aesthetic -
values, and environmental education. It is the intent of NRCS to give the Landowner the opportunity to participate
in the restoration and management activities on the easement area.
Authority. This easement deed acquisition is authorized by Title XII of the Food Security Act of 1985, as
amended(16 U.S.C. § 3837),for the Wetlands Reserve Program. -
NOW THEREFORE,for and in consideration of the sum of
Dollars(S ),the Grantor(s),hereby grants and conveys with general warranty of title to the
UNITED STATES OF AMERICA and its assigns,the Grantee, forever,all rights,title and interest in the lands '
comprising the easement area described in Part I and appurtenant rights of access to the easement area, but reserving.
to the Landowner only those rights,title and interest expressly enumerated in Part II. It is the intention of the
Landowner to convey and relinquish any and all other property rights not so reserved. This easement shall -
constitute a servitude upon the land so encumbered, shall run with the land in perpetuity and shall bind the
Landowner, (the Grantor(s)),their heirs,successors.assigns, lessees,and any other person claiming under them.
SUBJECT, however.to all valid rights of record, if any. •
p ART I. Description of the Easement Area. The lands encumbered by this easement deed, referred to,hereafter as
the easement area, are described on EXHIBIT A which is appended to and made a part of this easement deed.
TOGETHER with a right of access for ingress and egress to the easement area across adjacent or other
properties of the Landowner. Such a right-of-way for access purposes is described in EXHIBIT B which is
appended to and made a part of this easement deed.
PART II. Reservations in the Landowner on the Easement Area. Subject to the rights. title. and interest conveyed
by this easement deed to the United States.the Landowner reserves:
A. Title. Record title,along with the Landowner's right to convey. transfer. and otherwise alienate title to
these reserved rights.
B. Ouiet Enjoyment. The right of quiet enjoyment of the rights reserved on the easement area.

C. Control of Access. The right to prevent trespass and control access by the general public.
D. Recreational Uses The right to undeveloped recreational uses, including hunting and fishing.and
including leasing of such rights for economic gain,pursuant to applicable State and Federal regulations that may be
in effect:a the time.
I=. Subsurface Resources The right to oil, gas,minerals,and geothermal resources underlying the
easement area, provided that any drilling or mining activities are to be located outside the boundaries of the
easement area unless activities within the boundaries are specified in accordance with the terms and conditions of
EXHIBIT C.
PART ill. Obligations of the Landowner. The Landowner shall comply with all terms and conditions of this
easement. including the following:
A. Prohibitions. Unless authorized as a compatible use under Part IV, it is expressly understood that the
rights to the following activities and uses have been acquired by the United States and are prohibited of the
Landowner on the easement area:
I. haying,mowing or seed harvesting for any reason;
2. altering of grassland,woodland,wildlife habitat or other natural features by burning,digging,
plowing, disking,cutting or otherwise destroying the vegetative cover;
3. dumping refuse,wastes,sewage or other debris;
4. harvesting wood products;
5. draining, dredging, channeling,filling,leveling,pumping, diking, impounding or related
activities,as well as altering or tampering with water control structures or devices;
6. diverting or causing or permitting the diversion of surface or underground water into,within or
out of the easement area by any means;
7. building or placing buildings or structures on the-easement area;
8. planting or harvesting any crop;and
9. grazing or allowing livestock on the easement area.
B. Noxious nlants and nests. The Landowner is responsible for noxious weed control and emergency
control of pests as required by all Federal, State and local laws. A plan to control noxious weeds and pests must be
approved in writing by the NRCS prior to implementation by the Landowner.
C. Fences. Except for establishment cost incurred by the United States and replacement cost not due to the
Landowner's negligence or malfeasance, all other costs involved in maintenance of fences and similar facilities to
exclude Ii'.estock shall be the responsibility of the Landowner.
D. Taxes. The Landowner shall pay anyand all real property and other taxes and assessments, if any,
which mac be levied against the land.
L. Reporting. The Landowner shall report to the NRCS any conditions or events which may adversely
affect the wetland. wildlife, and other natural values of the easement area.
PART IV. Allowance of Compatible Uses by the Landowner.
A. General. The United States may authorize. in writing and subject to such terms and conditions the
NRCS ma\ prescribe at its discretion,the use of the easement area for compatible economic uses, including,but not
limited to managed timber harvest,periodic haying, or grazing. Such authorizations may be granted or terminated
at any tin,a at the sole discretion of the NRCS.

B. I imitations. Compatible use authorizations will only be made if such use is consistent with the long-
term protection and enhancement of the wetland and other natural values of the easement area. The NRCS shall
prescribe :ne amount, method, timing, intensity,and duration of the compatible use.
PART V. Rights of the United States. The rights of the United States include:
A. Management activities The United States shall have the right to enter unto the easement area to
undertake, at its own expense or on a cost share basis with the Landowner or other entity, any activities to restore,
protect, manage. maintain,enhance,and monitor the wetland and other natural values of the easement area. The
United States, at its own cost, may apply to or impound additional waters on the easement area in order to maintain
or improve wetland and other natural values.
B. Access. The United States has a right of reasonable ingress and egress to the easement area over the
Landowners property, whether or not the property:is adjacent or appurtenant to the easement area, for the exercise
of any of the rights of the United States under this easement deed. The authorized representatives of the United
States may.utilize vehicles and other reasonable modes of transportation for access purposes.
C. Easement Manaement• The Secretary of Agriculture, by and through the NRCS may delegate all or
part of the management, monitoring or enforcement responsibilities under this easement to any entity authorized by
law that the NRCS determines to have the appropriate authority,expertise and resources necessary to carry out such
delegated responsibilities. State or federal agencies may utilize their general statutory authorities in the
administration of any delegated management, monitoring or enforcement responsibilities for this easement. The
authority to modify or terminate this easement(16 U.S.C. § 3837e(b)) is reserved to the Secretary of Agriculture in
accordance with applicable law.
D. Violations and Remedies-Enforcement. The Parties agree that this easement deed may be introduced
in any enforcement proceeding as the stipulation of the Parties hereto. If there is any failure of the Landowner to
comply w ith any of the provisions of this easement deed,the United States or other delegated authority shall have
any legal or equitable remedy provided by law and the right:
I. To enter upon the easement area to perform necessary work for prevention of or
remediation of damage to wetland or other natural values;and,
2. To assess all expenses incurred by the United States(including any legal fees or attorney fees)
against the Landowner,to be owed immediately to the United States.
PART VI. General Provisions
A. Successors in Interest. The rights granted to the United States shall accrue to any of its agents,
successors. or assigns. All obligations of the Landowner under this easement deed shall also bind the Landowner's
heirs, successors.agents.assigns. lessees.and any other person claiming under them. All the Landowners who are
parties to la is easement deed shall be jointly and severally liable for compliance with its terms.
B Rules of Construction and Snecial Provisions. All rights in the easement area not reserved by the
Landowner shall be deemed acquired by the United States. Any ambiguities in this easement deed shall be
construed in favor of the United States to effect the wetland and conservation purposes for which this easement deed
is being ac.uired. The property rights of the United States acquired under this easement shall be unaffected by any
subsequent amendments or repeal of the Wetlands Reserve Program. If the Landowner receives the consideration
for this easement in installments.the Parties agree that the conveyance of this easement shall be totally effective
upon the ;ray meat of the first installment.

Dear Mr. Baker:
This letter is in response to your request for a water service
commitment for 1 tap at the location described as follows:
N.W. 1/4, SEC. 30, T5N, R67W -- Weld COUNTY, CO
We currently have a 6" Dia. water line located along the East
side of WCR 13 with additional capacity available Therefore, we
will commit to provide service to this location via one standard
residential -5/8" X 3/4" water tap, with the following conditions:
1. In August of 1993 the Little Thompson Board implemented a
"system impact" fee of $1000 per lot for all lots to be added
to the system.This is due upon application for the tap.
2 . All improvements to District facilities required to
provide service will be the financial responsibility of the
developer in accordance with the District Rules and
Regulations. All improvements must conform to District
Specifications.
3 . The installation of a fire hydrant requires payment of a
$2 , 000 fire hydrant fee prior to final approval of the
subdivisions lines.
This commitment will expire one year from the date of this
letter if the tap has not -been purchased and installed by that
date. The current fee for the domestic 5/8" X 3/4" tap is $4 , 600. 00
These fees area subject to change without notice.
