This operation will be a fish hatchery and rearing facility. The months of operation will be 12 months, 365 days a year.. This facility will have a non-closed pond system. The water will gravity flow from one pond to another to ensure proper oxygen and circulation. The water will flow southeast through the ponds into a 5 acre-foot tail pond. There is a 20 h.p. pump installed in the tail pond for the farmer to pump water underground from the tail pond to the west cement irrigation ditch, which the farmer will then irrigate his land. Colorado Fisheries, Inc. will be using Waste and Sludge Reducer Beneficial Bacteria to remove fish excrement. The amount to be applied is not yet determined, but will most likely be 3 to 5 pounds per pond per week. Water Division 1, Water District 1 Dear Mr. Nguyen: We have received your proposal of March 11, 1999, requesting approval of a substitute water supply plan to allow the construction of a fish hatchery operation at the Tateyama property. Water from five wells on the property will be used for this operation. Historically, water from the wells combined with surface water was placed in a concrete ditch and pumped out for irrigation of 163 acres. The wells are augmented under the Cache la Poudre Water Users Association plan and used to provide supplemental water to the surface rights. The surface water rights consist of 4 shares of Larimer and Weld Irrigation Company, 4 shares of Larimer and Weld Reservoir Company, and 2 shares of Windsor Reservoir and Canal Company. Water use for this proposal will consist of evaporation from 6 rearing ponds (0.5 acre exposed water surface), tailwater pond (1 acre exposed water surface), and a recharge pond (0.5 acre exposed water surface). The total evaporation from 2 acres of exposed water surface is 5.8 acre-feet (see attached table). Groundwater will be pumped from the wells through an underground pipeline to the rearing ponds. The water will collect in the tailwater pond and be pumped back to the concrete ditch to be used for irrigation as has been historically done. Colorado Fisheries has acquired 1 share of the Larimer and Weld Irrigation Company and 1 share of the Latimer and Weld Reservoir Company. You have estimated the consumptive use credit from the 2 shares to be 17 acre-feet. With an irrigation requirement of 1.57 acre-feet per acre, 10.8 acres will be dried up. The 2 shares will be pulled from the ditch and measured. The return flow component is estimated at 45%with 22.5% assumed to be surface return flows and 22.5% assumed to be subsurface return flows. The surface return flow component will be routed immediately back to Lone Tree Creek. The remaining 77.5% will be placed in the recharge pond (22.5% to maintain historic subsurface return flows and 55% consumptive use credit). You have computed the accretions to the river and determined that they would cover the depletions caused by evaporation (see attached table). The well permit applications for this proposal were returned to the applicant. Resubmit the applications back to this office with an additional application for the recharge pond. The provisions of Colorado Revised Statute 37-90-137(2)prohibits the issuance of a permit for a welt to be located within 600 feet of any existing well, unless the State Engineer finds that circumstances so warrant after a hearing held in accordance with the procedural rules in 2CCR402-5. This hearing may be waived if you are able to obtain statements from the owners of all wells within 600 feet, verifying that they have no objection to your use of the proposed well. 2. The 10.8 acres irrigated by the 1 share of the Larimer and Weld Irrigation Company and 1 share of the Larimer and Weld Reservoir Company must be permanently removed from irrigation. The total exposed pond surface area shall not exceed 2 acres. 3. The applicant must diligently pursue obtaining a permanent plan for augmentation with the Water Court. Renewal of this plan may depend on progress made toward a permanent plan. Approval of this plan does not imply approval by this office of any related litigation. 4. Approval of this plan is for the purposes stated herein. This office must first approve any additional uses for which the water may be used. The replacement water, which is the subject of this plan, cannot be sold or leased to any other entity during the term of this approval. • 5. Adequate records of diversions and replacements must be provided to the Division Engineer and the Water Commissioner on a monthly basis or other interval acceptable to both of them on a form approved by them. 6. All releases of replacement water must be sufficient to cover all out-of-priority depletions and be made under the direction and/or approval of the Water Commissioner. The replacement may be aggregated to maximize beneficial use. The Water Commissioner and/or Division Engineer shall determine the rate and timing of an aggregated release. 7. The name, address, and phone number of a contact person who will be responsible for the operation and accounting of this plan must be provided to the Water Commissioner and the Division Engineer. 8, This plan may be revoked or modified at any time should it be determined that injury to other vested water rights has or will occur as a result of the operation of this plan. 9. Should a request for renewal of this plan be needed, such renewal request must be submitted to this office at least 45 days prior to the expiration date of this plan. -10. Should this substitute water supply plan expire without renewal or be revoked prior to adjudication of a permanent plan for augmentation, all use of ground water must cease immediately. 11 This plan shall be valid through May 31, 2000, unless otherwise revoked or modified.
