HomeMy WebLinkAbout961729.tiff SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING Tuesday, September 5, 1996 A regular meeting of the Weld County Planning Commission was held September 5, 1996, in the County Commissioners' Hearing Room (Room#101), Weld County Centennial Building, 915 10th Street, Greeley, Colorado. The meeting was called to order by Chairman, Arlan Marrs. The summary of the last regular meeting of the Weld County Planning Commission held on August 20, 1996, was approved with a correction. CASE NUMBER: USR-1124 PLANNER: Kern D. Keithley APPLICANT: Harlan Wall REQUEST: Site Specific Development Plan and Special Review Permit to park/store construction equipment. LEGAL DESCRIPTION: Part of the E2 of Section 29, T1 N, R65W of the 6th P.M., Weld County, Colorado. LOCATION: West and adjacent to Weld County Road 41, south and adjacent to Weld County Road 6. Kern D. Keithley presented a brief summary of the proposal and entered the favorable recommendation of the Department of Planning Services into the record as written. Ms. Keithley explained that the applicant is currently utilizing this portion of the site for this activity, however in order for the use to be in compliance with the Weld County Zoning Ordinance, as amended, the applicant must obtain a Special Review Permit. Staff believes that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance,as amended, and is consistent with the Weld County Comprehensive Plan Agricultural Goals and Policies. Ms. Keithley referenced the referral response received from the Weld County Health Department and their concerns for a individual sewage disposal system to be installed on this facility. The Department of Planning Services has received two letters from surrounding property owners in favor of this request. The Department of Planning Services' staff recommends that the Planning Commission approve Case Number USR-1124, Harlan Wall,with the three Conditions of Approval and eighteen Development Standards. ,;, 4 Marie Koolstra had concems with work being done at this location with the equipment. Ms. Keithley explained , /-A that equipment is currently being stored on this facility for parking purposes only, and that there is no construction activity taking place on this site. 961729 PLANNING COMMISSION MINUTES September 6, 1996 Page 2 Arlan Marrs had concerns on the applicants requirements for a Special Review Permit. Ms. Keithley stated that a complaint was received from an adjacent property owner. Julie Chester,the Zoning Compliance Officer for Weld County Planning Services addressed this complaint and the applicant then applied for this application. Arlan Marrs had concerns on the septic system requirements. Jeff Stoll explained that the Weld County Septic Regulations require that a septic system be placed on site when employees are there for repairs and services. Mr. Stoll explained that a vault type system would be acceptable. Arlan Marrs expressed concerns on the screening of this property. Ms. Keithley explained that screening is required through the Weld County Zoning Ordinance, as amended, on any commercial use. This application is considered a commercial use in the agricultural zone district. Due to the property location adjacent to Weld County Road 41 the Department of Planning Services would require screening from the public right-of- way. Glenn Vaad asked if one of the letters that was received from the surrounding property owners was from the property owner who made the original complaint to this property. Ms. Keithley explained that complaints are kept confidential and that she was not aware if the letters that were received came from the property owner who had complained. Rusty Tucker asked if a porta-potty system would be acceptable for a septic system. Mr. Stoll explained that this would require a vault type system due to the permanent situation of this application. The applicant, Harlan Wall, explained that this portion of property is located above the irrigation ditch and had no use because he could not irrigate this portion. Approximately ten years ago Dan Burger proposed to use this property to store equipment. The applicant stated they had no conflicts with replacing trees on the property for proper screening. Mr. Wall had concerns on what type of vault system the Weld County Health Department would require. Mr.Stoll explained that a vault system would consist of a minimum four hundred gallon concrete or plastic tank buried in the ground and a private housing/structure to be placed over the top of it. The Weld County Health Department will work with the applicant toward an acceptable system. Jack Epple asked what type of equipment is stored on this site. Mr. Wall explained that construction equipment is stored on this site. Mr. Burger stated he is presently using this site to store equipment which consists of: two service trucks, two cranes, three forklifts, a couple of boats and that there is some farming equipment stored on site, that is not owned by him. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. The Chairman asked the applicant if they were in agreement with the Conditions of Approval and Development Standards. The applicant was in agreement. Jack Epple motioned that Case Number USR-1124, Harlan Wall, be forwarded to the Board of County Commissioners with the Conditions of Approval and Development Standards with Planning Commissions recommendation for approval. Marie Koolstra seconded the motion. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Hodges APPLICANT: Public Service Company of Colorado REQUEST: Site Specific Development Plan and Special Review Permit for an addition of a 16" pipeline (to connect Chaulk Bluff Station to Colorado Interstate Station)to an existing Major Facility of Public Utility site. LEGAL DESCRIPTION: In Section 5, T11 N, R66W of the 6th P.M., Weld County, Colorado. LOCATION: East and adjacent to State Highway 85; approximately 3.5 miles north of Weld County Road 126 (Rockport). Todd Hodges presented a brief summary that this proposal is for an expansion to an existing facility and the original application was approved in 1991. This application is to expand to an existing station on the east side of Colorado State Highway 85, by adding approximately one-quarter mile of pipeline. Mr. Hodges entered the favorable recommendation of the Department of Planning Services into the record as written. Mr. Hodges referenced the referral responses received from the Weld County Sheriff Department, the State of Colorado Department of Transportation and the Weld County Health Department. Their comments or conditions have been addressed by the applicant and are incorporated within the Conditions of Approval and Development Standards. The applicant, Doug Dalton, explained that from the Chaulk Bluff Station this location within an easement will approximately expand one-quarter of a mile and cross the Colorado State Highway 85, to connect to the Colorado Interstate Gas facility. This will be a sixteen inch pipeline placed in anticipation of increased loads this winter. Glenn Vaad had concerns with a letter received from the Environmental Protection Services on liquids and solid wastes that would be generated during this project. Mr. Dalton explained that these liquids and solid wastes would be handled with the use of porta-potties. Rusty Tucker asked if construction for this expansion will be all underground. Mr. Dalton explained that the pipeline will be underground except at the connections to the two sites. Marie Koolstra asked if there were employees at these facilities. Mr. Dalton explained that the facilities are electronically controlled, but they are maintained by maintenance patrols and they go to the facilities two or three times a week to visualize the site. Arlan Marrs asked if the applicant was in the process of applying for a permit to cross Colorado State Highway 85. Mr. Dalton explained they were in the process at this time. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. The Chairman asked the applicant if they were in agreement with the Conditions of Approval and Development Standards. The applicant was in agreement.
