This letter shall further serve to advise you that all of the
above entitled parties are the owners of the surface and most of
the oil, gas, minerals and mineral rights located on the
following described property located in Weld County, Colorado:
(The Peckham Junction Farm)
A part of the SW 1/4 of Section 14 , Township 4 North,
Range 66 West of the 6th P.M. , Weld County, Colorado,
described by metes and bounds as follows: Beginning at
the South Quarter Corner of said Section 14 , thence
North 0°05 ' East along the East line of the said SW 1/4
of Section 14, a distance of 1524. 1 feet to an
intersection with the Southeasterly right of way line
of the Union Pacific Railroad Company; thence South
41°14 ' West a distance of 1393 . 5 feet following said
right of way line; thence South a distance of 496 feet
to the South line of said Section 14 ; and thence East
a distance of 913 . 65 feet to the point of beginning;
subject to liquor clause as contained in deed recorded
in Book 293 , page 277 of the Weld County records,
together with all water, water rights, ditches or ditch

that part or parcel of land particularly described as
follows: Commencing at the Northwest Corner of said
tract and running thence East along the North line of
said tract 634 feet to a point 50 feet West of the
center line of the railroad track; thence in a
southwesterly course on a line parallel with and 50
feet West from the railroad tract 964 feet to a point
on the West line of said tract of land; thence North
along the West line of said tract 731 feet to the place
of beginning, making a triangular piece of land on the
West side of the railroad track containing three (3)
acres, more or less, together with 15 shares of the
capital stock of The Farmers Independent Ditch Company

A parcel of land situated in the NE 1/4 NE 1/4 of
Section 14, Township 4 North, Range 66 West of the 6th
P.M. , Weld County, Colorado, more particularly
described as follows: Beginning at a point in the East
line of said Section 14 , 100. 87 feet South of its
intersection with the southeasterly right of way line
of the Union Pacific Railroad, said point of
intersection being 713. 38 feet, more or less, South
from the northeast corner of said Section 14 ; thence
from said point of beginning South along the East line
of said section 508.86 feet, more or less, to the
southeast corner of the NE 1/4 NE 1/4; thence along the
South line of said NE 1/4 NE 1/4 South 89°53 ' West
472 .95 feet to a point marked by an iron pin, said
point being 60. 15 feet East of the intersection of the
South line of said NE 1/4 NE 1/4 with the southeasterly
right of way of said railroad; thence from said point
North 42°51 ' East 695. 41 feet to the point of
beginning. The East line of said section is considered
to bear true North and all bearings are referred

Excepting that portion conveyed by deed dated May 1,
1986, recorded May 22 , 1986 in Book 1113 under
Reception No. 02054547 of the Weld County records
executed by Ida Dinner, Rae Barnett Weiland, Sidney E.
Dinner, Albert J. Dinner and Melvin Dinner, as
grantors, to Ralph Nix Produce Company, a Colorado
corporation, covering the property as more particularly
described therein, containing 8.88 acres, more or less
This letter shall further serve to acknowledge receipt of the
notice mailed by the Weld County Department of Planning Services
dated November 12 , 1998 , submitted to Surrounding Property/
Mineral Owners concerning Case No. Z-519 scheduled for public
hearing before the Weld County Planning Commission on Tuesday,
January 5, 1999 at 1: 30 P.M. in Room 104 , Weld County Centennial
Center, 915-10th Street, Greeley, Colorado.
The owners of the Peckham Junction Farm as hereinabove described
are, in addition to a series of irrigation wells located on the

above described property, also the owners of shares of water
stock in The Farmers Independent Ditch Company and shares of
water stock in The Western Mutual Ditch Company, all of which are
utilized in connection with irrigated farming operations on the
farming properties owned by the owners of the Peckham Junction
Farm and other irrigated farming properties located nearby.
Based upon the examination of the file in Case No. Z-519, as well
as contact with other parties who are personally familiar with
the property requested to be developed by Mr. and Mrs. Wiedeman
and Mr. and Mrs. Hunt, and who are also familiar with the farming
operations on that property, as well as the farming operations on
the Peckham Junction Farm, it is necessary to indicate that there
are serious problems that exist with reference to the development
plans outlined by Mr. and Mrs. Wiedeman and Mr. and Mrs. Hunt
concerning the property in question.
I am enclosing herewith copy of a portion of the plat map
pertaining to Township 4 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado, with particular reference to Sections 14
and 15 of Township 4 North, Range 66 West of the 6th P.M. , Weld
County, Colorado.
There currently is in existence and has been for many years an
underground pipeline 15 inches in diameter that provides
irrigation water from The Farmers Independent Ditch to the
Peckham Junction Farm which is located underneath the property
planned for development purposes by Mr. and Mrs. Wiedeman and Mr.
and Mrs. Hunt. I am also informed that in addition to the
underground water pipeline there is also a gas pipeline which
similarly is located underneath the property planned for
development by Mr. and Mrs. Wiedeman and Mr. and Mrs. Hunt.
As you will note from examination and review of the enclosed plat
map, the Farmers Independent Ditch traverses in a northeasterly
direction through Sections 29, 21, 15 and 11 of Township 4 North,
Range 66 West of the 6th P.M. , Weld County, Colorado. Irrigation
water from the Farmers Independent Ditch is removed from the
ditch itself in the SW/4 of Section 15 into an open ditch, the
first part of which is dirt, the end portion of which is
concrete. This open ditch, as you will note, traverses from the
SW/4 in a southeasterly direction across the SE/4 of said Section

15 to the East line of said Section 15, where it enters a culvert
underneath Weld County Road 33 . On the east side of the culvert
the water goes into an open box and thence into an underground
pipeline and traverses in a southeasterly direction to the end of
the underground pipeline into an open box at the east line of the
Wiedeman and Hunt property. Irrigation water then flows through
a culvert underneath U. S. Highway 85 and the Union Pacific
Railroad Company right of way where it ultimately empties into a
open ditch near the South line of the parcel which is now the
migrant housing parcel. An open ditch then flows in an easterly
direction along the migrant housing parcel and the Peckham
Junction Farm (Ida Dinner, et al. ) parcel as outlined in the
enclosed plat map.
The open box located near the West end of the Wiedeman property
and the place where the irrigation water from the Farmers
Independent Ditch enters the underground pipeline is
approximately 1052 feet from the north side of the blacktop of
Highway 256 (from the west end of the underground pipeline) . The
east end of the irrigation water pipeline is approximately 120
feet from a service pole on the north side of Weld County Road
256. The underground pipeline, when installed in 1987 , simply
replaced an open ditch that existed for probably 100 years or
more, prior to the installation of the underground irrigation
pipeline.
It is also my understanding that there is, in addition to the
underground water irrigation pipeline, a natural gas pipeline
which is in the same area of the planned development.
If it is possible, engineering-wise, to reroute the underground
irrigation pipeline and also the gas pipeline at the expense, of
course, of the Wiedemans and the Hunts, it is possible that
development problems might be essentially resolved. It would, of
course, be necessary that suitable and adequate easements and
accessibility would be required and that no improvements could be
constructed or installed over and above the pipelines.
As you will note, I have submitted a copy of this objection to
the planned development to Mr. and Mrs. Wiedeman and Mr. and Mrs.
Hunt so that they can, in turn, contact me or my brother, Albert
J. Dinner, so that these pipeline problems can be discussed and

satisfactory resolutions hopefully worked out.
