HomeMy WebLinkAbout982389.tiff RESOLUTION RE: APPROVE 1999 ISLAND GROVE REGIONAL PARK FACILITIES FEES SCHEDULE AND POLICIES AND PROCEDURES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on November 26, 1984, the Board did approve Ordinance#131, Establishing an Island Grove Park Advisory Board to Effect Coordinated Management and Planning for Both City and County Park Facilities in the Island Grove Area for the Mutual Benefit of the People of the City of Greeley and County of Weld, and WHEREAS, the Island Grove Advisory Board has presented the 1999 Island Grove Regional Park Facilities Fees Schedule and Policies and Procedures to the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and the City of Greeley, with terms and conditions being as stated in said 1999 Fees, Policies and Procedures, and WHEREAS, after review, the Board deems it advisable to approve said 1999 Fees, Policies and Procedures, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Island Grove Regional Park Facilities Fees Schedule and Policies and Procedures presented to the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and the City of Greeley, be, and hereby is, approved. All changes are highlighted in red. After many sub-committee meetings with Extension Service and Advisory Board, we finished the government usage section. A fee's comparisons of like facilities in Colorado was conducted (first page enclosed ) inflationary and utility rate increases were taken into consideration as well. Two public meetings were held October 22 and 28, with public input on rates and policies. On November 5th at the Island Grove Advisory Board meeting, we presented the fees, policies and procedures for Island Grove Regional Park for 1999. We received positive public comments from Mrs. Jenean Huckaby of the group Colorado Pony of the America's Club, Mr. Randy Anglin of the Rocky Mountain Little Britches Rodeo and nine others expressing their pleasure with having new non-profit rates. After public comments, the Advisory Board voted ( 4-0 ) approving the 1999 fees, policies and procedures to be passed on to the City Council and Commissioners for final approval. MISSION STATEMENT: "To provide and improve the quality of life of Weld County Citizens, through the development and enhancement of Island Grove Regional Park, which will provide the opportunity for an education and recreational facility for all citizens at the most economical, effective and courteous manner as possible." FEE POLICY 1. Fees for Island Grove Regional Park are set at the Annual October Advisory Board Meeting and go into effect January through December of the following year. All charges will be at a rate for the year of that event, and contracts will be signed starting in December of the previous year. Booking events on dates not on Annual user groups, corresponding dates are a first come, first serve basis and may be booked up to eleven (11) months in advance. Any event scheduled beyond a twelve(12) month period will be considered tentative, and each group, event, or individual should be advised accordingly. 2. It is the policy of the City of Greeley, Colorado to allow use of City of Greeley and Weld County owned facilities at Island Grove Regional Park on a rental basis to groups when such does not interfere with annual user groups, private and public on their corresponding dates. All tenants of the Island Grove Regional Park complex, all ground facilities and premises including annual events are reminded that it is their sole responsibility to initiate and complete proper forms for event bookings for future facility usage. Failure to notify the Island Grove regional Park Office in writing to reschedule the annual event within thirty(30) days of termination of their past event may result in cancellation of any rights of priority option for rental. The City of Greeley will not be held responsible for complying with this policy. 3. The City of Greeley and Weld County Government have, due to the economic impact to the region, waived rental fees only for these events or equipment use at Island Grove Regional Park: * Colorado Farm Show. * Weld County Fair * Greeley Independence Stampede * Greeley Arts Picnic * Cinco De Mayo However all of the above must pay all taxes due and the $.50 cent per seat used, for paid for view events plus horse stalls and Visions with Pride Building rentals if used. 1 Note: All City of Greeley Department(District 6 intergovernmental agreement)& Weld County Department ( CSU Extension Service programs 4-H/FCE etc.) are covered under Government usage. CITY OR COUNTY GOVERNMENT USAGE The following applies to the City of Greeley and Weld County Government. The City of Greeley and Weld County Government may have use of Island Grove Regional Park facilities and equipment if available without charge. City or County may book at NO CHARGE one year in advance, subject to availability of facility and equipment, the exception being corresponding dates or annual events which have priority. No City of Greeley or Weld County departments, an office and/or group may contract for facilities or equipment in its name for actual use by other groups or individuals. Third parties are only acceptable if both parties are governmental agencies or nonprofit governmental support groups. All government use must be scheduled within the regular hours of the Parks Staff schedule between 7:00 a.m. and 10:00 p.m., Monday through Friday. Saturday, Sunday and holidays must be approved by the Island Grove Facility Manager All meetings must be concluded by 10:00 p.m. unless approved by the Island Grove Facility Manger. No government use will be scheduled on county or city recognized holidays without approval from the Island Grove Facility Manager. Requests for use of facilities must be received by the Island Grove Regional Park Schedulers Office seven(7) working days in advance of scheduled date for event. All government users are responsible for ALL rough trash clean up including buildings, arena, grandstands, concessions and parking lots. (Trash to be deposited in 5-yard dumpster provided). Deep cleaning and pressure washing will be the responsibility of Parks Staff. All equipment and facilities must be in good condition immediately following the event or that government department is responsible for all damages, with the exception of reasonable wear and tear which may occur Setups will be done by the Parks Staff with the help from that agency, when appropriate. If a user (City or County) cancels less than ten (10) days before an event or fails to notify schedulers of cancellation, a user may be banned from future use of the facilities by the Island Grove Advisory Board. (Exception would be bad weather). 2 9e?1339 FEE SCHEDULE CATEGORIES Standard/Commercial: This applies to any private individual for profit organization, company, entity, or non-County resident organization, youth or adult. Weld County Adult Non-Profit: This applies to any organization with a majority (80%) of its membership residing within Weld County, sponsoring educational, civic, athletic, or public service events on a nonprofit basis. Organizations must be registered with the Secretary of State's office as a nonprofit organization. Upon request,the organization must provide proof of its nonprofit status, bylaw and membership list to the Parks office. Weld County Youth Non-Profit: This applies to any organization with a majority (80%) of its membership (18 years and under) residing within Weld County, sponsoring educational, civic, athletic or public service events on a nonprofit basis. Organizations must be registered with the Secretary of State's office as a nonprofit organization. Upon request,the organization must provide proof of its nonprofit status, bylaws and membership list to the Parks office. Classification of Usage Hours: Island Grove Regional Park's operation hours are 7:00 a.m. to 10:00 p.m. Island Grove Regional Park's overtime hours are between 10:00 p.m. and 1:00 a.m. Island Grove Regional Park's double time hours are between 1:00 a.m. and 7:00 a.m. 3 POLICIES AND PROCEDURES 1. The City of Greeley retains control and management of the contracted facilities at all times, and will have the right at all times to enforce all rules and regulations of any lawful authority relating thereto, and will have the right of access at all times and the right to eject all persons who fail or refuse to comply with the rules and regulations covering the use of contacted facilities, or who otherwise violate any lawful, enforceable and proper law, rules or regulations of local, state, or federal government. 2. The use of the buildings will be denied to groups who, in the judgment of the City of Greeley, and the Director of Parks have as their purpose. A. To advocate or promote racial or religious prejudices. B. To advance any doctrine or theory subversive to the constitution or laws of the State of Colorado or the United States, or C. To advocate social or political change by force or violence. 3. Lessees will not discriminate against any applicant, participant or employee on the basis of the person's race, creed, sex, national origin, disability, religion or age (as defined by law), or any other non-merit factor except when specific age, sex, or physical requirements constitute a bona fide occupational qualifications necessary for proper and efficient operation of Lessee activities. 4. The Lessee will be responsible for all of its own set up. The Lessee will be required to pick up all open trash and putting trash in containers outside the buildings, arenas and parking lots. Lessees must pay for trash removal. Lessees may be allowed to set up the day before an event at no charge if the set up is on a weekday and the facility is available. In all other cases rent starts when building is first opened for the Lessee, not when the event starts, and rent ends when all doors are locked. Lessees may be allowed one day after an event for clean up at no charge unless there is an event the following day, in that instance clean up must be completed after completion of an event. Staff will be responsible for taking down and stacking tables and chairs. Rough clean up will be Lessee's responsibility and there will be an additional charge per container for trash left. 5. The facilities will be closed and not available for rental on Good Friday, Easter Sunday, the day before Thanksgiving, Thanksgiving Day, Christmas Eve, Christmas Day, and New Years Day,the exception being the Bunkhouse. 6. The Lessee will be responsible for all damages to the property, except natural wear and tear, occasioned by reasonable and careful use thereof 7. The Park may require the Lessee to furnish security during the activity. Lessees will provide all staff and other personnel necessary to conduct the activity in the facilities. 4 98A389 8. Lessees will not lock front glass or S-1 doors of the Exhibition Building during the hours of 7:00 a.m. to 5:00 p.m., Monday through Friday, except holidays. In addition, Reserved parking for CSU Extension office, Parks Department and Greeley Independence Stampede staff must be maintained. Violators will be towed at Lessees expense. 9. Lessees of the arena or buildings will provide all security, ushers, announcers, signor for hearing impaired and other personnel necessary to conduct the activities described above and the city of Greeley and Weld County will not be responsible for any item left at any Island Grove Regional Park facilities. 10. All activities will cease at arranged time. Buildings will be closed and locked no later than 2:00 a.m., unless approved by the Island Grove Facility Manager. 11. Lessees, its agents, and the immediate family are limited to no more than six corresponding date events per calendar year. An event is defined as one continuous activity/celebration not exceeding three days at on time. For events such as the Weld County Fair, Greeley Independence Stampede and sponsored activities, reserved dates may be granted together at the discretion of the Director of Parks. Dances and concerts will be viewed as a single event unless connected with a larger park event. 12. Signed contracts must be received by the City of Greeley, Island Grove Concessionaire, Inc. Fire watch contracted at lease two (2)weeks prior to the scheduled date. All monies collected will be deposited upon receipt. 13. Lessees may not post or exhibit any signs, advertisements, show bills, posters or cards of any description in or on the facility without the prior permission of the Island Grove Facility Manager. 14. Anything left in the facility following the conclusion of the event may be removed or placed in off-premises storage arranged by Island Grove Facility Manager at the sole expense of the Lessee. The lessee expressly releases the City of Greeley, from all claims for loss or damage of any kind or nature arising out of such removal and storage. Drop shipments may be arranged five(5) days prior to your event and items must be removed or shipped five (5) days after your event. 15. Lessees may not undertake any plumbing, electrical, carpentry or mechanical work on any of the facilities without prior authorization of the Island Grove Facility Manager. Staff on duty may contact the Facility Manager for approval. 16. Events taking place between midnight and 6:00 a.m. on Sunday will be governed by the time either Daylight Savings or Standard Time, in effect on the previous day. 5 98;389 17. The City of Greeley staff members will have I.D.'s. Lessee of facility will advise that anyone wearing one will be allowed entrance to all areas of the facilities except where there is danger or it would interfere with the program or performance(I.D.'s are not to be used for seating). 18. Lessees are responsible for all City and State sales tax. (3% City, 3% for state), and the Island Grove Development fee of 15% on all food and drinks sold during the event. Envelopes are available at the Parks office and must be turned into a staff member or at the Parks office. 19. A lessee agrees to pay all sales and use tax generated from activities at Island Grove and additionally agrees to release sales and use tax informed and returns for activities in Island Grove. 20. If helium balloons are used for decorating in the buildings, a $25.00 fee will be assessed to your costs to cover damages which occur with the balloons and string,this fee will also be assessed if staff is required to retrieve loose balloons. This fee includes all co-sponsored events. 21. Lessees will provide staff a show/event premium, flyers, admission fees, time of event, and contact phone numbers in order to schedule staff and provide information for the public. 22. Like events will not be booked the same week or on consecutive weekends. 23. The rental fee schedule is as follows: If a total rental fee is less than $200, a rental fee will be due in full on date reservation is made, if total is greater than $200, lessees agree to pay lessors a $200 security deposit on date reservation is made, this security deposit will be applied toward lessees' total rental fee - the remainder of rental fees is due, in full, not less than two (2) weeks prior to a reservation date. Series of events that are held on consecutive weeks need only pay one $200 deposit, which will be banked and applied to the last event in the series. 24. Cancellations: If Lessee/Tenant cancels before a scheduled event, the $200.00 deposit will be forfeited as follows: * 90 days prior $150.00 of the $200.00 will be refunded. * 89 days to 14 days prior $100.00 of the $200.00 will be refunded. * Two weeks or less the deposit will be forfeited. (NO REFUND) Rent less than the $200 will be forfeited as follows: * 90 days prior $50.00 will be forfeited, the balance will be refunded. * 89 days to 14 days prior$100.00 will be forfeited, the balance will be refunded. * Two weeks or less all deposits/rent is forfeited. (NO REFUND) 6 9, . 35@ INSURANCE The Lessee agrees to indemnify, hold harmless, and defend the City of Greeley, City Council, Weld County Board of Commissioners for Weld County, and all employees and agents thereof, for any damage to either property or persons resulting from accidents, injury or other incidents resulting from Lessee's use of the facility. Not withstanding the foregoing and in addition to any insurance coverage carried by the Lessor. A lessee further agrees to indemnify, hold harmless, and defend the City of Greeley and County of Weld for any and all damages resulting from accidents, injuries or other incidents caused in whole or in part by any negligent act or omission of Lessee, or anyone directly or indirectly employed by Lessee, or whose act for which lessee may be liable unless a waiver of insurance is granted by the City of Greeley. The Lessee agrees that prior to the use of said facilities, it will furnish the Lessor with proof of insurance satisfactory to the City of Greeley Director of Parks. Such insurance will include contractual liability coverage and will provide insurance in the following amounts. For Public Events: ** A comprehensive general liability insurance policy with minimum limits of $600,000 combined single limits for each occurrence. ** Worker's Compensation and Employer's liability insurance, which will cover the obligations of the tenant, in accordance with the provisions of the Worker's Compensation Act, of Colorado, as amended. (Art. 40 to 47 of Title 8, C.R.S.) For Private Events: ** For private parties, liability insurance which includes coverage for bodily injury with a minimum limit of$150,000 combined single limits for each occurrence. For Public and Private Events with Alcohol: ** Alcohol is sold by licensed concessionaire only. Insurance for events where alcohol is served will be provided as a service by the concessionaire. At least 15 days prior to the scheduled event,the tenant will provide a certificate(s) of insurance to the city of Greeley/Island Grove Regional Park demonstrating that the aforementioned insurance requirements have been met and that such policy or policies will be in effect throughout the contracted period and at such times before that the contracted period as tenant may reasonably expect to be conducting activities within the area of contracted facilities. 983 '9 ALCOHOLIC BEVERAGES. FOOD AND CONCESSION RESTRICTIONS * Serving and sale of alcoholic beverages at Island Grove Regional Park buildings and grounds are to be by licensed concessionaire only. Lessees are responsible for security at all events. (See section for details) Insurance for events where alcohol will be served is the responsibility of the concessionaire. For alcoholic event service contact: Island Grove Concessionaire, Inc. 600 N. 14th Avenue Greeley, CO 80631 Joe Vickarelli (970) 356-8694 SECURITY FOR ALCOHOLIC EVENTS * Private dance's and/or concerts require two (2) professional security people per 400 people. * Public dance's and/or concerts require four(4) professional security personnel minimum and an additional one (1) a security person for every 200 persons more than 600. NOTE: Security is required whether alcohol is served at events or not. All exists must be unobstructed and the exit signs must be in a clear view to occupants in the buildings. In the event that a major disturbance occurs and the Police Department is called, the event will be closed and everyone will be evacuated. This is a rule, no matter what time it is and all rental fees are forfeited. Events more than 1,000 persons must have security arrangements approved by the City of Greeley Chief of Police or his assignee. All activities must cease at the time specified in the contract. * Public dances require all participants to be twenty-one (21) years of age or older with a picture I.D. stating birth date. * Occupancy loads for public or private events are: Exhibition Building 1500 4-H Building 400 Livestock Barn 150O * Security for your event must remain on the site until all patrons have left the facility. FIRE WATCH FOR ALCOHOLIC EVENTS * Events with alcoholic beverages must arrange for a fire watch, to be conducted during the event time of the special event occurrence arrangements approved by the City of Greeley Fire Chief or his assignee. Buildings only! * Exhibition Building and Livestock Barn= Two (2) Certified Firefighters * 4-H Building = One (1) Certified Firefighter (FIREFIGHTERS MUST BE STATE CERTIFIED!) 8 lO9 FIRE AND SAFETY STANDARDS All fire regulations prescribed by the City of Greeley Fire Marshal government agency, and enforcement agencies that will be strictly observed. The following rules must be observed and hazards corrected before opening an event to the public. * All buildings are"No Smoking," either City of Greeley or Weld County, at Island Grove Regional Park. Guests may smoke outside any building. * An exhibitor layout is subject to approval by Union Colony Fire Rescue Authority Fire Marshal (350-9512 or 350-9513) and Island Grove Facility Manager. * No Parking is allowed in fire lanes. No Traffic Parking Control Signs or Park Roadways can be altered without the approval of the City of Greeley Police, Fire and Parks and Recreation Department. * Motor vehicles on display will have battery cables disconnected and taped fuel tanks not more than 1/4 full and provided with locked caps or sealed in a manner approved by the Greeley Fire Marshal. * Demonstrations or operation of any heat producing devices or sources of ignition including but not limited to: Heaters, stoves,barbecues, candles,torches, lanterns, internal combustion engines, any other open flame device must be approved by the City Fire Marshal. * All decorations must be approved by the Island Grove Facility Manager prior to the reservation date, and decorations must be taken down immediately after the event. No nails, tacks or screws will be used to fasten anything to any part of the buildings or arena without permission of the Island Grove Facility Manager. All decorative material including, but not limited to, drapes, hangings, curtains and table coverings with overhangs, will be either made from nonflammable materials or rendered and maintained in a flame retardant condition by means of a solution and process approved by the Greeley Fire Marshal. * No glass containers are allowed in Island Grove Park. Greeley Municipal Code #13.40.055 Ordinance N. * Lessees must pay for trash removal. The lessee is responsible for all rough clean up including buildings, arena, grandstands, concessions and parking lots. (Trash is to be deposited in the 5-yard dumpster provided). There will be an additional charge per hour per person for clean up of trash left by Lessee or sponsored group. 9 956/589 FIRE PREVENTION BUREAU 910 7TH STREET GREELEY, CO 80631 (970) 350--9510 POLICY FOR PUBLIC DISTRIBUTION NUMBER 25-1 LIFE SAFETY REQUIREMENTS FOR ALL EXHIBITORS PARTICIPATING IN SHOWS AT ISLAND GROVE REGIONAL PARK This policy is meant to provide basic information for the most common conditions and situations. A permit and plan review are required for the events at Island Grove Regional Park. Any questions can be addressed to the Fire protection Bureau between 8:00 a.m. and 5:00 p.m. at (970) 350-9510. 1. A sponsor of show will submit both a floor and site plan to the Fire Department Prevention Bureau and the Parks and Recreation supervisory a minimum of ten days prior to the event. 2. All required exits from the buildings will remain unlocked and free of obstructions while the building is occupied. Exit signs must remain visible. A 48-inch aisle way to exit doors will be maintained inside and outside of buildings. 3. There will be no spraying of flammable or combustible paints or primers. This includes but not limited to aerosol cans. All touch-up must be done before arrival to City property. 4. A permit (one permit per show or event) is required from the Fire Department for all liquid fuel equipment or display inside any building or covered area. Equipment will have: a. At least one battery terminal disconnected. b. Fuel tanks will contain less than 5 gallons or be less than one fourth full, whichever is less. c. Fuel tanks will be sealed to prevent the escape of vapors. d. Fuel systems will be free of all leaks. 5. All fire extinguishing equipment must be unobstructed and visible. 6. All drapes, hangings, curtains, drops, and other decorative material, such as hay or straw, etc., will be treated or maintained in flame retardant condition. A certificate or other acceptable proof of fire retardant treatment will be provided to Fire Prevention personnel. 10 9,,2359 7. The sale, display, and storage of gun powder(smokeless or black) are not permitted on City of Greeley property. 8. No fireworks or other open flame will be allowed unless said devices have a permit issued by the City Fire Department. (Permit information is available through the Fire Prevention Office and application for permit requires 48 hours advance notice before an event. The inspection of fireworks can take place up to two hours before an event). 9. No liquid petroleum gas will be allowed in the buildings. All outside liquid petroleum gas requires a special permit from the Fire Department. 10. Compressed gas cylinders must be secured in all areas, especially food preparation areas. 11. Smoking is not permitted in any City or Weld County building or arena grandstands. 12. No parking is allowed in posted Fire Lanes. My unattended vehicle in a Fire Lane will be ticketed or towed at the owner's expense. 13. No parking is allowed within 20 feet of a fire hydrant. Nothing will be attached to any fire hydrant. Fire hydrants will remain fully visible at all times. 14. All electrical hookups will be made by a licensed electrical contractor. 15.
