ONE TO GRANT AGREEMENT FOR PROJECT NO. 3-08-0028-07 AMONG FEDERAL AVIATION ADMINISTRATION, CITY OF GREELEY, AND GREELEY-WELD COUNTY AIRPORT AUTHORITY AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Amendment No. One to Grant Agreement for Project No. 3-08-0028-07 among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, the Federal Aviation Administration, the City of Greeley, and the Greeley-Weld County Airport Authority, with terms and conditions being as stated in said amendment, and WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Amendment No. One to Grant Agreement for Project No. 3-08-0028-07 between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, the Federal Aviation Administration, the City of Greeley, and the Greeley-Weld County Airport Authority be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said amendment. ONE TO GRANT AGREEMENT FOR PROJECT NO. 3-08-0028-07 WHEREAS, the Federal Aviation Administration (hereinafter referred to as the "FAA") has determined it to be in the interest of the United States that the Grant Agreement between the FAA, acting for and on behalf of the United States, and the City of Greeley and County of Weld, Colorado, and the Greeley- Weld County Airport Authority (hereinafter referred to as the "Sponsor") , accepted by said Sponsor on the 26th. day of September, 1996, to be amended as hereinafter provided. NOW, THEREFORE, WITNESSETH: That in consideration of the benefits to accrue to the parties hereto, the FAA on behalf of the United States, on the one part, and the Sponsor, on the other part, do hereby mutually agree as follows: That the Special Conditions be amended to add the following: 17 . The sponsor agrees to request cash drawdowns on the letter of credit only when actually needed for its disbursements and to timely reporting of such disbursements as required. It is understood that failure to adhere to this provision may cause the letter of credit to be revoked. It is hereby understood and agreed that the maximum obligation of the United States as set forth in the terms and conditions of said Grant Agreement shall not be changed as a result of this amendment. The amendment adds the letter-of-credit method of reimbursement to this grant agreement. If the conditions of the amendment are satisfactory, it may be accepted by having the authorized sponsor officials execute the second page of the amendment, inserting execution date at the bottom of the first page. Certification by the attorneys should be completed following the acceptance and be dated on or after the acceptance date. Your normal procedures for accepting documents such as this in accordance with local and state law should be followed, but evidence of such procedures is not required by the Federal Aviation Administration. FAX 970%75&2643 TO: Don Warden November 14, 1996 Director of Finance & Administration FROM: Mike Reisma Airport Mana. - RE: Amendment No. 1 to Airport Grant Agreement The FAA has submitted Amendment No. 1 to AIP Project No. 3-08-0028-07 at the Greeley-Weld County Airport for the runway expansion project. This amendment adds provisions for letter of credit reimbursements. Mr. Jeff Parins of the City of Greeley Attorney's Office has indicated that this will not require City Council Approval, but simply the Mayor's signature. I understand that you have indicated that this does however require approval by the Weld County Board of Commissioners. Please find attached one copy of the amendment. Your assistance in processing this document for the County Board of Commissioners approval is appreciated. There are a total of six original copies still in my possession that will require execution upon the County's approval. Please call me at 356-9141 with any questions. Thanks.
