HomeMy WebLinkAbout961393.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST ROBERT DE CRESCENTIS FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Robert De Crescentis, VI #9600062, is allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of August, 1996, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Robert De Crescentis, property owner, was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against the individual as hereinabove named to correct said violation. Brian Soukup, Location of violation: 7551 WCR 74 (There are several residences on the property, one is a remodeled store that was remodeled as a residence without the appropriate permits and they put in their own septic system, so I thought you guys might want to check into this. The mailing address for Brian Soukup is 706 S. College Avenue, Ft. Collins, CO 80521 His telephone number is 970-224-9204, extension 100. He does not live on the property. 2. Robert De Crescentis, Location of violation: 954 S. Denver Ave., Ft. Lupton There is no septic system or sewer system of any kind in the house located on this property. There is an outhouse on the south side of the property that the resident, Misael Amaya, is using. There are also two truck loads of rotting turnips on the property that stink to high heaven and the flies are terrible. One of the trucks is a flat bed type and the other is a semi-trailer. The turnips appear to be last years crop, so you can imagine what type of mess this is. 3. Ramona & Lucio Benavidez, Location of violation: 15129 Nancy Avenue, Aristocrat I sent you this one on your voice mail, but I wasn't sure if you got it. There is someone living in the shed on the north side of the property. There are no utilities or bathroom facilities and we were told that the person living in the shed was using the bathroom outside back by the fence. There was some toilet paper located back there according to a neighbor. If you have any questions about any of these please call me or if you need any further information, I do have zoning violations and files on all these people and the properties.
