HomeMy WebLinkAbout981099.tiff f4 4' MEMORANDUM ITO: BOARD OF COUNTY DATE: Jun 1998 COMMISSIONERS FROM: Trevor Jiricek, Health Departure} COLORADO SUBJECT: OK Compost The purpose of this memorandum is to request two additional standards for the proposed OK Compost facility. The rationale for this late and unusual request is based upon my observations at my most recent visit to the site. On Tuesday, May 26, 1998, I observed the OK Compost facility. The purpose of my visit was to observe site conditions prior to the upcoming hearing. On this date I observed several conditions that I believe warrant attention. They are as follows: 1) On the southern portion of the facility, I observed two (2) piles of uncomposted manure. One pile was approximately 10 feet high, 35 feet wide, and 100 feet long. The second pile was approximately 10 feet high, 35 feet wide,and 50 feet long. These appeared to be the same piles of uncomposted material that I observed on a previous visit that occurred on March 31, 1998, with Gloria Dunn. We have several concerns with these piles of manure. These piles of manure were specifically discussed during the Planning Commission hearing, on April 21, 1998. I stated that the piles were a concern to our Department because uncomposted manure offered a breeding area for flies. Mr. Cunning advised the Commission that these piles were much smaller than I had previously observed and that they would be composted. During a June 1, 1998, phone conversation with Mr. Cunning he acknowledged that these in fact were the same uncomposted manure piles that I observed on my March visit. Uncomposted manure offers a breeding area for flies and also an unnecessary source of odors when it becomes wet. 2) A row of partially uncomposted manure has been placed along the entire west and north sides of the facility. I would estimate this row of partially uncomposted manure to be approximately 2,000 feet in length. It varied in height and width from approximately 5 feet to 7 feet. We have two concerns with this practice. First, according to my June 1, 1998, telephone conversation with Mr. Cunning, this row of uncomposted manure was placed as a part of the sites surface water control plan. According to Mr. Cunning, it is meant to function as a "bio-berm". The construction of a "bio-berm" was proposed during the Colorado Department of Public Health and Environment's (CDPHE)review of this application. The CDPHE did not approve the "bio- berm" due to lack of data and literature that demonstrate "bio-berms" functioned adequately in • the place of conventional surface water controls. Our second concern is that again it appears that this manure isn't being turned adequately and it provides a breeding area for flies. Mr. Cunning acknowledged that this manure wasn't being turned frequently enough to break the fly breeding cycle. j. EXHIBIT 981099 12#1/2c BOARD OF COUNTY COMMISSIONERS June 1, 1998 Page 2 It should be noted that during the summer of 1997 the Health Officer, John Pickle, conducted a Health Officer hearing due to nuisance conditions at the facility as the result of excess flies. Also, during my May 26, 1998, visit to the site I observed flies in excess of what I have observed at other similar facilities. It appears that the facility has not been operated in a manner that would best control flies and fly breeding conditions. In the event the operators follow the proposed permit conditions, these issues would be addressed. However, based upon our current and previous observations of the facility, we believe that an additional condition is warranted. We recommend that the following condition be a part of any approval: 1) The applicant shall develop a method of tracking and recording the dates that record the following activities: a) The date each load of manure is delivered to the site; b) The date each load of manure is placed in windrows; c) The date each windrow has been turned; d) The date the manure has been removed from the facility. The method of recording shall be approved by the Weld County Health Department. During the calendar years 1998 and 1999, these records shall be provided monthly to the Weld County Health Department. From the year 2000 and beyond, these records shall be maintained at the site, at all times, for review. In addition, we recommend that a condition defining the time frame that the applicant must address all conditions of approval and record the plat also be a part of any approval. We recommend this condition because of the fact that the facility began operation without obtaining the appropriate permits and due to what appear to be poor management practices of the applicant. Composting Facility Weld County, Colorado Dear Ms. Dunn: The Solid Waste Unit of the Hazardous Materials and Waste Management Division (the Division) has completed its review of OK Farms Compost, Inc.'s Certificate of Designation Application to operate a composting facility in Weld County. It is the assessment of the Division that the facility can comply with the technical, environmental, and public health standards of the Act (C.R.S. 30-20-1 et seq.) and the Regulations (6 C.C.R. 1007-3), if the facility is constructed and operated as detailed in the submitted plan and subsequent addenda, and if the conditions of approval, as stated in this letter, are complied with. Based on this assessment, the Division recommends that this facility may be approved by the County based on these and local criteria. The conditions of approval are as follows: 1. That any technical, land use, or other issues raised by county staff during their review of the application be adequately addressed. 2. That the surface water control plan for the site, as detailed in Addendum #3 to the Certificate of Designation Application (dated September 12, 1997), be implemented in entirety, including permeability testing of soil from the base of each pond, as requested in our letter of October 21, 1997. 3. We have divided the recommendation into conditions of approval and development standards. We recommend that the applicant meet the following conditions prior to recording their plat: 1) The facility shall demonstrate that the surface water control plan, submitted by Tom Gibbens, dated September 10, 1997, has been constructed. At a minimum, the facility shall submit as- built drawings of the drainage features and the retention structures to the Weld County Health Department. 2) The facility shall provide evidence, to the Weld County Health Department, that any surface water retention structure has been constructed of a lining material which does not exceed a seepage rate of 1/4"/day (1X10-5 cm/sec). 3) A dust abatement plan shall be submitted to the Weld County Health Department for review and approval. The facility shall have sufficient water available to implement t dust control as required by the Weld County Health Department. 4) A fly abatement plan shall be submitted to the Weld County Health Department for review and approval. 5) An odor abatement plan shall be submitted to the Weld County Health Department for review and approval. 6) The facility shall provide evidence to the Weld County Planning and Health Departments that an appropriate financial assurance mechanism has been secured in accordance with the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2). We recommend that the following conditions be incorporated as development standards: 1) The Weld County Health Department, Weld County Planning Department,and the Solid Waste Section of the Colorado Department of Public Health and Environment shall be notified in EXHIBIT 981099 1 / 7 USR-1129, OK Farms Compost Page 2 writing of any new materials (other than manures/bedding and wood chips) proposed for composting. Written approval to proceed with composting shall be obtained from the Weld County Health Department and Colorado Department of Public Health and Environment prior to receipt of the new material. Submittal information shall include operational procedures and storage procedures. All materials considered for composting shall meet current and future regulatory requirements for that specific material. No dead animals shall be composted on site. 2) The facility shall maintain the surface water control plan, submitted by Tom Gibbens, dated September 10, 1997. 3) The facility shall have adequate equipment to dewater each retention structure. Each retention structure shall be dewatereed to a level that restores the full runoff storage capacity within a 15- day period following each storm event. 4) No stockpiling of raw material such as manure/bedding, food waste, biosolids, or any other approved putrescible material shall be allowed on site. All raw,uncomposted material shall be placed in windrows unit within 72 hours upon receipt at the facility. Windrows shall be no larger than 8-feet in height and 20-feet in width. This is not meant to include the temporary stockpiling of finished compost. In the event processing units, other than windrows, are to be incorporated at the site, a detailed description of the unit and processing requirements shall be provided to the Weld County Health Department for review and approval. The description shall include literature and other examples that demonstrate the unit is an effective composting process. 5) All windrows shall be turned a minimum of every ten(10) days. This shall not include bulking agents such as wood chips, grass clippings, etc. and liquids stored within approved closed storage tanks. 6) All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 7) No permanent disposal of wastes shall be permitted at this site. 8) Waste materials shall be handled, stored,and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9) The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A), as measured according to 25-12-102, Colorado Revised Statutes. 10) An individual sewage disposal system is required if any type of an office facility is located on the site for the facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. A vault system shall be acceptable. If a vault is installed, pumping 981099 USR-1129, OK Farms Compost Page 3 records shall be kept for review. A portable toilet facility shall be provided and maintained on site until such time a permanent individual sewage disposal system is installed. 11) The facility shall operate in a manner to control flies in accordance with its approved fly abatement plan. Additional fly control measures shall be implemented at the request of the Weld County Health Department in the event that flies (which can be determined to be associated with the facility) are in such a number to be considered a nuisance condition. The plan shall also be implemented in the event the Weld County Health Department receives a significant number of fly (associated with facility) complaints and, in the judgement of the Health Officer, there exists a fly condition requiring abatement. 12) Any solid waste as defined in the regulations pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2) received or generated at the site must be removed and disposed of at an approved sanitary landfill. 13) The facility shall have on site and available to the Weld County Health Department, Weld County Planning Department, and Colorado State Health Department at all times the specific procedures to handle the following: a. hazardous materials received on site b. contamination or discharge of water from the site c. odors in excess of established limit d. flies determined to be a nuisance condition e. dusty conditions 14) The facility shall be operated in a manner which controls odor in accordance with its approved odor abatement plan. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Additional odor abatement measures shall be implemented at the request of the Weld County Health Department in the event odor levels detected off site of the facility meet or exceed the level of fifteen-to-one dilution threshold or, in the judgement of the Weld County Health Officer, there exists an odor condition requiring abatement. 15) The facility shall be operated in a manner to control fugitive dust in accordance with its approved dust abatement plan. Additional dust abatement measures shall be implemented at the request of the Weld County Health Department in the event it is determined that dust (that can be determined to be originating at the facility) is a nuisance condition. 16) The Special Review Permit site and facility shall be operated in compliance with any required Air Emission Permit approved by the Air Pollution Control Division of the Colorado Department of Public Health and the Environment. 981099 USR-1129, OK Farms Compost Page 4 17) A metal sign shall be posted at the facility entrance near Colorado Highway 66. the sign shall be a minimum of three feet in width and four feet in length. The sign shall state the following: a. name of operation b. type c. emergency phone numbers of the facility operator 18) The facility shall comply with the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2) the facility shall also comply with any composting regulations promulgated Pursuant to the Solid Waste Act, Section 30, Article 20, Part 1, C.R.S. 19) Portable fueling equipment shall be kept within a bermed area. The berm shall be lined and designed to contain 120% of the total tank capacity contained within the bermed area. 20) Personnel from the Weld County Health Department and Weld County Planning Department shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 981099 SOUTHEAST WELD NATURAL RESOURCES 57 W. After our review of the application and a site visit by Natural Resources Conservation Service personnel , we have the following comments : EROSION ******* OK Farms Compost has been using this land as a composting facility long enough for them to develop four windrows of aged compost . No soil erosion problems are evident at this time . Weld loams, one to three percent slopes, are not considered highly erodible . However, the compost windrows will be susceptible to wind erosion and should be kept wet or covered by permeable plastic . Such a covering would have the added benefit of reducing odors and preventing insects from breeding in the compost . FUTURE DEVELOPMENT ****************** The applicant mentioned that there may be need for a vehicle maintenance building, septic leach field, and well sometime in the future . Moderate limitations exist for the development of septic systems because of slow percolation in these soils . Moderate limitations also exist for commercial buildings because of shrink-swell potential . RUNOFF ****** There is a natural drainage located to the southwest of this facility. Some provision needs to made for floodwater retention to prevent contaminated runoff from flowing into this drainage . The low percolation rates for the Weld soils will not allow runoff to seep into the soil as is claimed by the applic - EXHIBIT 981099 1 _1E_ WINDBREAK The applicant has expressed his intentions to plant trees along the south side of this facility. For this reason, we are including information on tree selection, and windbreak design and maintenance . K. Farms Compost The Weld County Public Works Department has reviewed the proposal. The following comments are recommended to be a part of any approval: 1. The access falls under the jurisdiction of the Colorado Department of Transportation (CDOT). The applicant needs to acquire the access permit from the State of Colorado at the Greeley Office. Please Tess Jones to verify the access point and adequate sight distance. The existing access is directly next to a wind break or a tree stand with limited sight distance to the west. 2. The storm water drainage: There does not appear to be any storm water drainage problem on the site. I have no conflict with this item. 3. Our department has been notified that there is a fly problem from this location. This falls under the Environmental Health Department. There is limited site distance to the west due to a windbreak or tree stand. The storm water drainage plan falls under the Environmental Health Department. This is an agricultural type runoff (dairy, feedlot, or poultry). Please contact Trevor Jiricek. Our department has been notified there is a fly problem at this location. Projected traffic along this portion of State Highway (SH) 52 indicates the need for a 150' total ROW, 75 feet each side of the highway centerline. Additional width to meet the projected need should be protected by reservation, or preferably dedication as permitted by County regulations. ACCESS The proposed compost facility lies adjacent to a section of state highway identified as a Category 3 highway. Category 3 highways will allow a single direct access to the state highway provided that no reasonable direct alternate access exists. The proposed increase of traffic as a result of the compost facility provides the Department with the warrant to re-evaluate access. The applicants should contact me to determine if access to their site can be achieved by another route. UTILITIES If new utility lines or connections are necessary within the state highway ROW, a utility permit will be required. Prior to such utility work, Mr. Henry Rangel of the Department should be contacted at (970) 350-2111. My comments are based upon the submittal as received August 16, 1996.
