HomeMy WebLinkAbout951720.tiffRESOLUTION RE: APPROVE ENTRY BY WELD COUNTY VEGETATION MANAGEMENT SPECIALIST UPON VARIOUS LANDS WHEREAS, theBoard of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on either July 25, 27, or 28, 1995, the Weld County Vegetation Management Specialist mailed notices to various landowners within Weld County advising them that lands owned Dr occupied by them contain Canada thistle and/or musk thistle, noxious weeds, and WHEREAS, said notices stated that said noxious weeds must be controlled or eradicated within ten days from the date of said notices and gave recommendations as to what methods are to be used for such control or eradication, and WHEREAS, a copy of said list, containing the legal descriptions of the lands and the names of those landowners who have failed to comply with said recommendations, is attached hereto and incorporated herein by reference, and WHEREAS, the County Vegetation ManagementSpecialist has requested that the Board approve his entry upon lands, as set forth in the abovementioned list, to affect the control or eradication of noxious weeds, and WHEREAS, at its meeting of August 16, 1995, the Board did Find as follows: 1. That those landowners mentioned on the list -are the owners iof said land within a pest control district. 2. That Canada thistle and/or musk thistle, noxious weeds, are found upon said lands. 3. That said landowners received appropriate notice and such notice specified the best available means for control oraradication ofsaid noxious weeds. 4. That said landowners have not complied with the requirements as stated by the County Vegetation Management Specialist. CRS. 35-5.5-109, I must seek approval or right of entry from the Board of County Commissioners to enter on private land to carry out weed control measures. The property is designated in the Weld County Assessors Office as parcel(s) number(s) 131315000095 and131315000094. The noxious weeds present on the property include; Canada thistle (Cirsium arvense) and musk thistle (Carduus nutans) Because these weeds are going to seed and producing viable seed that will infest neighboring lands, they must be mowed, cut or disced under to keep from blowing. Section (35-5.5-109,C.R.S.) requires you to control the weeds by using at least one of these methods. Please be advised that if you do not control or eradicate these weeds by August 4,1995, 1 will ask the Board of County Commissioners of Weld County for permission to enter the property to use one of these methods of control or eradication at your expense, as provided in Section (35-5.5-109(5a) C.R.S.) I will be glad to answer any questions you may have regarding the control or eradication of the noxious weeds on the property.
