Re: Application to rezone the following described property, a Tract of Land located in the
West Half of Section 29, Township 6 North, Range 65 West of the 6th P.M.., Weld
County, Colorado. Containing 39,242 SF (0.9009 Acres), more or less). See attached
Exhibit "A", legal description.
Dear Current Planner:
W.S.W., Inc. a Colorado corporation, requests a change of zoning for the above described
parcel from the existing Agriculture Zone to I-3 Zone. W.S.W., Inc. respectfully requests
that the I-3 Zone be extended to include the the parcel described on Exhibit "A". The
parcel lays adjacent to property W.S.W., Inc. owns, and is being acquired through an
exchange of property with Hoshiko Farms, Inc. and a boundary adjustment. The
Subdivision Exemption Application being submitted herewith.
On behalf of W.S.W., Inc., it is respectfully requested that a hearing be granted to
consider the application for the extension of the I-3 Zone to embrace this parcel as a part
of W.S.W., Inc.'s existing property.
The above parcel is owned by Hoshiko Farms, Inc., however, W.S.W., Inc., having used
this property for pipe storage and Hoshiko Farms, Inc. having farmed a small parcel of
the W.S.W., Inc. property for a number of years want to trade the parcels and by virture
of the Subdivision Exemption correct the existing boundary problem.
The requested zoning is consistent with the policies of the Weld County Comprehensive
plan, the requested zone and boundary adjustment corrects a boundary descrepancy created
long before W.S.W., Inc. acquired it's property, and prior to Hoshiko Farms, Inc.
acquiring it's property.
The proposed zoning is compatible with the current use of the property in that W.S.W.,
Inc. is not requesting an expanded use. The land to the east (Hoshiko Farms, Inc.) is
agricultural land. Property to the south, west and northwest is Zoned I-3. The union
Pacific Railroad is the west boundary of the W.S.W., Inc property. West of the Railroad
is US/Colorado State Highway 85.
W.S.W., Inc.'s existing offices and manufacturing facility are located on it's existing
property. additional septic system or sewer system is not required, nor will W.S.W., Inc.
need additional water or fire protection to the property. Soils have no limitations for
construction, and there are no plans to expand any type of buildings onto the above
descibed parcel.
Road and/or highway facilities providing access to the property are adequate and meet the
requirements of the proposed Zone District, W.S.W., Inc. is not requsting any changes in
road and/or highway facilities.
To the best of W.S.W., Inc.'s knowledge there are no sand or gravel resources on or
under the subject property. There has been oil and gas exploration and production in the
area, however, there has been no production on the land herein described parcel W.S.W.,
Inc. is acquiring from Hoshiko Farms, Inc.
The change of zone area, is not located in a Flood Hazard District or a Geologic Hazard
District, nor is it located in the AP (Airport) Overlay District.
This zone change request is not inconsistent with the efficient and orderly growth of the
area. It is consistent with the growth of the area in that the use and nature of the land will
not change by this zoning process. The subject land is currently zoned Agriculture,
however, its current use will not change with the 1-3 Zoning. Thus insuring this request is
consistent with the intent of the zone district requested herein.
The uses permitted in the I-3 will be compatible with the future development of the
surrounding area as permitted by the various existing zonings in the general area and with
future development as projected by the comprehensive plan of the county. The property is
located within a three (3) mile radius of Greeley and Eaton, Colorado,and is considered in
the future growth of the City of Greeley.
The subject property complies with the Overlay Districts outlined in the Weld County
Comprehensive Plan dated November 21, 1995.
